SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt Position Adjustment Resolution Number 20567, to establish the classification of Forensic Manager (6CGA) and allocating it on the
salary schedule at salary level B85 2037 ($8,029-9,760); and transfer one position (# 10028 and incumbent) to the Forensic Manager
classification, as recommended by the Assistant County Administrator-Director of Human Resources.
FISCAL IMPACT:
This action is the final personnel transactions that make up the reorganization of the Office of the Sheriffs Forensic Services Division
which will result in a net County cost savings as a result of cancellation of existing positions from previous personnel transactions.
BACKGROUND:
The Office of the Sheriff has been in discussions with Human Resources and two labor organizations regarding the restructuring of the
Forensic Services Division. The restructuring in part is based on the Grand Jury's findings and recommendations to respond to
changing technology and backlog concerns in the Forensics Division.

This newly established non-sworn managerial class appropriately reflects the duties and responsibilities in 'support of the new
restructure and insure adequate management, supervision and oversight to the Forensic Services Division. The Manager will be
responsible for the development and implementation of operating policies, provide general direction to Forensic Supervisors, and will
report directly to the Chief of Forensic Services.
CONSEQUENCE OF NEGATIVE ACTION:
If this request is not approved, the reorganization of the Forensics Division will not have adequate managerial support nor appropriately
compensate the incumbent for duties performed outside of her classification.

I am currently working as a Supervising Forensic Toxicologist at Sheriff's
Crime lab.My classification is scheduled to be administratively re-titled as
Forensic Manager. As an incumbent I object to this due to the fact that Human
Resources denied enforcing an arbitration decision (CSMCS Case #ARB-07-005) to
award my current position to get pay equity with Supervising Criminalist
position. A petition to enforce arbitration has been filed in Superior Court
dated 6/2/08 -Contra Costa County is the Respondent . An Unfair Practice
Charge has also been filed with PERB for retaliation by Human Resources
related to this grievance issue. The Board.is requested to remove this item
from the Board Agenda until the Pay Equity.related arbitration Ruling/Petition
is settled by Court.
