REASONS FOR RECOMMENDATION'S AND BACKGROUND:
The COWIN IS plallnim, to replace Bethel Island Brid e and Is CIII-I-CIItIV in negotiations with the property owners IOC
land and improvements located at 5980 Bethel Island Road. The COLIIIIV IIILISt relocate the District 4vlI0 IS Cl11TCIAV
occupying the office building at 5980 Bethel Island Road.
The District received a Notice of Eligibility on July 9, 2007. which described the relocation advisory and
financial assistance it would be elio ible to receive upon its displacement from the Project site. Financial
assistance includes payment for actual. reasonable and necessary moving and related expenses. In addition, the
District is eligible to receive a payment. not to exceed $1.0,000.00. for expenses actually- incurred in relocating
and reestablishin its operation at a replacement site. Ilowever. in lieu of a payment 1.Or actual moving and
related expenses and actual reestablishment expenses. the District may choose a fixed payment of$1,000.00 to
$20.000.00. Under this option, no other moving or related expenses are eligible for payment.
The District has elected to:reccive a fixed payment in lieu of payment for actual moving and related expenses
and reestablishment expenses and will be movin`7 in the near future.
CONSEQUENCES OF NEGATIVE ACTION:
TIIC County Could be liable for additional relocation expenses.

SUBJECT: Claim for In-Lieu Payment—Reclamation District 799
Bethel Island Bridge Replacement Project
On June 21, 2007, the County of Contra Costa (County) made an offer to purchase the property
at 5980 Bethel Island Road, occupied by the Reclamation District 799 (District), for construction
of the Bethel Island Bridge Replacement Project. As an eligible occupant of the property, the
District is entitled to certain benefits in accordance with the Uniform Relocation Assistance and
Real Property Acquisition Policies Act of 1970 (Uniform Act) and the County's Relocation
Assistance Program.
The District received a Notice of Eligibility on July 9, 2007,which described the relocation
advisory and financial assistance it would be eligible to receive upon its displacement from the
Project site. Financial assistance includes payment for actual, reasonable and necessary moving
and related expenses. In addition, the District is eligible to receive a payment, not to exceed
$10,000, for expenses actually incurred in relocating and reestablishing its operation at a
replacement site. However, in lieu of a payment for actual moving and related expenses and
actual reestablishment expenses, the District may choose a fixed payment of$1,000 to $20,000.
Under this option, no other moving or related expenses are eligible for payment.
The County is now seeking to take legal possession of the property occupied by the District at a
hearing on its Amended Motion for Order for Prejudgment Possession which is scheduled to be
heard on June 12, 2008 in Contra Costa County Superior court. A 90-Day Informational Notice
to Vacate was delivered to the District on March 12, 2008 and a 30-Day Notice to Vacate will be
issued at the same time the Order granting the County possession is served on the District.
The County has retained the services of an outside relocation consulting firm, Overland, Pacific
& Cutler, to explain to the District the relocation process and the benefits it may be eligible to
receive, as well as provide assistance in planning the District's move and reestablishing its
operation.
The District has elected to receive a Fixed Payment in Lieu of Payment for Actual Moving and
Related Expenses and Reestablishment Expenses. As a non-profit organization, the payment is
based on the average of two years' annual gross revenues, less administrative expenses. Under
the Uniform Act, any payment in excess of$1,000 must be supported with financial statements
for the two 12-month periods prior to the acquisition of the property.

Attached is a Claim for Fixed Payment in Lieu of Actual Moving and Related Expenses in the
total amount of$20,000. The District has provided Financial Statements and Independent
Auditor's Reports for 2006 and 2007 as documentation to support the total amount being
claimed, as follows:
