ADOPT Resolution No. 2008/ 4ti5 approving Quitclaim Deed ofDevelopment Rights(creek structure setback),
Subdivision 95-07984,project developed by Shapell Industries,Inc.,as recommended by the Public Works Director,
San Ramon (Dougherty Valley) area. (District III)
FISCAL IMPACT:
None.
_BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
A portion of the Grant Deed of Development Rights (creek structure setback) needs to be quitclaimed for bridge
construction.
_CONSEQUENCES OF NEGATIVE ACTION:
The bridge structure will be located in a creek structure setback area.

SUBJECT: Approving Quitclaim Deed of Development Rights (creek structure setback),
Subdivision 95-07984, San Ramon (Dougherty Valley) area. (District III)
The Public Works Director having reported that on October 22,2002,the Board accepted a
Grant Deed of Development Rights from Shapell Industries, Inc. (owner), as a requirement for
Development Number Subdivision 95-07984.
On the recommendation.of the Public Works Director,IT IS BY THE BOARD RESOLVED
that the Chairperson is AUTHORIZED to execute the following "Quitclaim Deed" of the
development rights to"Shapell Industries,Inc."The document was prepared by Contra Costa County
Public Works Department..
Being a portion of Parcel "AA"as shown on the map of Subdivision 95-07984,recorded in
Book 448 of Maps at page 29, Contra Costa County Records.

For valuable consideration,receipt of which is hereby acknowledged,the County of Contra Costa,a
political subdivision of the State of California, hereby remises, releases and forever quitclaims to
Shapell Industries, Inc., all of its right, title and interest in the real property, specifically
"development rights", as defined in the deed to the County of Contra Costa, recorded October 281
2002, Recording Series number DOC-2002-393875-00, of Official Records, Contra Costa County
Records, State of California;over the certain parcel of land situated in Contra Costa County,being a
portion of Parcel AA,of Subdivision 95-07984,filed October 28,2002,in Book'448 of Maps,page
29, Contra Costa County Records, State of California, described more particularly in Exhibit"A,"
and shown on the plat map, Exhibit`B" attached hereto and made a part hereof.
No transfer tax due. This is a quitclaim of development rights only.
