RECOMMENDATION:
ADOPT Resolution Number 2008-42 egarding salary reallocations for the Senior Deputy District Attorney,Assistant
District Attorney, Chief Assistant Dlstrl�t Attorney, District Attorney-Public Administrator, Assistant Public Defender, Chief
Assistant Public Defender, Public Defender(2KD1, 2KD3, 2KD2, 2KA1, 25D2, 25D1, 25A1), Assistant County Counsel,
Chief Assistant County Counsel, and County Counsel (2ED1, 2ED2, 2EA1), and DCSS Attorney Basic, Advanced, and
Supervising Attorney(29VA, 29TA, 29HA) classifications.
FISCAL IMPACT:
The cost associated with this action is approximately$435,746 for Senior Deputy District Attorney, Assistant District
Attorney, Chief Assistant District Attorney, District Attorney, Assistant Public Defender, Chief Assistant Public Defender,
Public Defender, approximately$128,111 forlAssistant County Counsel, Chief Assistant County Counsel, and County
Counsel, and approximately$110,268 for DOSS Attorney Basic, Advanced, and Supervising Attorney classifications.
BACKGROUND
The Board of Supervisors requested a comprehensive evaluation of the management attorney classes within the District
Attorney, Public Defender, and County,,Counsel Offices to determine the degree of compaction between unrepresented
management classifications and represented classifications due to a ecently negotiated wage djustme t for the
Deputy District Attorneys. Additionally, the Board of Supervisors r que ted an analysis of inte I parit emal market
comparisons, and the past practice of"rolling up"or applying neg bated wage packaes to u r n d nagement

within the chain of command. Attorneys in the Department of Child Support Services(DCSS)were formerly a part of the
District Attorneys Office and the DCSS Attorney classes were subsequently evaluated as a separate part of the study.
Based on the results of the study,which, in part, s't'owed compaction exists (less than 10%spread) between
management and the classifications management supervises, we are recommending a salary reallocation of the above
listed classifications.
The reallocation requested above addresses the compaction, internal equity and "roll up"of the negotiated Deputy
District Attorney wage package. It does not address external market comparisons. The management classification, even
after the adjustment will remain below the external market.
CONSEQUENCE OF NEGATIVE ACTION:
Internal equity will be compromised.

SUBJECT: Adopt Salary Reallocations for unrepresented
attorney classificationslin the District Attorney,
Public Defender, County Counsel, and Child
Support Services Departments
THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS in its capacity as governing Board of the
County of Contra Costa and all districts of which it is ex-officio governing Board RESOLVES THAT:
I. Contra Costa County will implement the following salary increases for the classifications of Senior
Deputy District Attorney—Exempt(201),Assistant District Attorney—Exempt(2KD3), Chief Assistant
District Attorney—Exempt(202), District Attorney Public Administrator—Exempt(2KA1),Assistant Public
Defender—Exempt(25D2), Chief Assistant Public Defender—Exempt(25D1), Public Defender—Exempt
(25A1):
Effective 7/1/06 2.5%increase
Effective 7/2/07 2.5%increase
Effective 1/1/08 2.6%increase
In lieu of a retroactive pay calculation,the County will make a"lump sum payment'to each eligible
employee, not including those who have retired or terminated,without back interest, as follows:
A. The period-of 7/1/06 through and including 6/30/07 is computed as follows:The employee's regular
pay and hourly-based earnings, including overtime pay and other earnings computed as a
percentage of base pay,will be added together for each applicable pay period to determine an
appropriate pay base.Thisbase pay then will be multiplied by 2.5%(Two point five tenths percent)

B. The period of 7/1/07 through and including 12/31/07 is computed as follows:The employee's
regular pay and hourly-based earnings, including overtime pay and other earnings computed as a
percentage of base pay,will be added together for each applicable pay period to determine an
appropriate pay base.This base pay then will be multiplied by 2.5%(Two point five tenths percent)
compounded.
C. The period of 1/1/08 through and including 5/31/08 is computed as follows:The employee's regular
pay and hourly-based earnings, including overtime pay and other earnings computed as a

percentage of base pay,will be added together for each applicable pay period to determine an
appropriate pay base.This pay base then will be multiplied by 2.6%(Two point six tenth percent)
compounded.
The products of these calculations will be added together and that sum will be added to the employee's
August 10, 2008 paycheck where it will be listed separately as"Lump Sum Pay".The lump sum pay"
amount will then be included in the calculation of the employee's required deductions such as taxes and
retirement
II. Effective July 2, 2008, Contra Costa County will implement the following salary increases for the
classifications of
District Attorney Public Administrator—Exempt(2KA1) 5.4%increase
Public Defender—Exempt( 25A1) 6.4%increase
Chief Assistant Public Defender—Exempt(25D1) 5.1%increase
Assistant Public Defender—Exempt(25D2) 0.3% increase
III. Effective January 1, 2008, Contra Costa County will implement an 8.7%salary increase for the
classifications of Assistant County Counsel—Exempt(2ED1)and Chief Assistant County Counsel—
Exempt(2ED2).
In lieu of a retroactive pay increase,the County will make a"lump sum payments to each eligible employee,
not including those who have retired oriterminated,without back interest for the period of January 1, 2008
through and including May 31, 2008, computed as follows:
The.employee's regular pay and hourly)-based earnings,including overtime pay and other earnings
computed as a percentage of base pay,will be added together for each applicable pay period to determine
an appropriate pay base.This pay base will be multiplied by 8.7%(eight point seven tenths percent).
The product of that calculation will be added to the employee's August 10, 2008 paycheck where it will be
listed separately as Lump Sum Pay".IThe lump sum pay"amount will then be included in the calculation of
the employee's required deductions such as taxes and retirement.
IV. Effective January.1, 2008, Contra Costa County will implement a 10.0%salary increase for the
classifications of County Counsel—Exempt(2EA1).
In lieu of a retroactive pay increase,the County will make a plump sum payment°to each eligible employee,
not including those who have refired or terminated,without back interest for the period of January 1, 2008
through and including May 31, 2008,computed as follows:

an appropriate pay base:This pay base will be multiplied by 10%(ten percent).
The product of that calculation will be added to the employee's August 10, 2008 paycheck where it will be

the employee's required deductions such as taxes and retirement
V. Effective July 2, 2008, Contra Costa County will implement the following salary increases for the
classifications of
Attorney Basic—Child Support Services (29VA) 7.8%increase
Attorney Advanced—Child Support Services (29TA) 7.8% increase'
Supervising Attorney—Child Support Services(29HA) 8.8%increase
