DIRECT the Clerk of the Board to publish a Notice of Filing of the Annual Report and fixing of a public hearing date thereon in accordance with Government Code Section 25210.77a (Government C e Section 6066) and County Ordinance Code Section 1012-2.608. (County Service Area L- 100 Funds) (All Districts) Project No.: 7394-6X5001 DATE: June 17, 2008 PAGE: 2 FISCAL IMPACT: There will be no impact to the County General Fund. The levy of the annual street lighting charges will provide revenues to be used solely for street lighting operation and maintenance costs. REASONS FOR RECOMMENDATIONS AND BACKGROUND: The proposed levy of annual street lighting charges benefits all property owners within County Service Area L- 100 by providing street lighting during hours of darkness.' The street light program provides for operation and maintenance of street lights in the unincorporated areas of the County. This action provides for the continuation of existing charges to provide street lighting as provided for in County Service Area L-100, Government Code Section 25210.1 and following, and in accordance with Ordinance No. 79-42, adopted by the Board of Supervisors on March 27, 1979. This action does not result in an increase in service charges assessed to parcel owners within County Service Area L-100. Attachment A included with this Board Order includes the Annual Report as required by the Government Code. Section 25210.77a(a) of the California Government Code requires the legislative body to direct a Report be prepared each fiscal year for CSA L-100 which shall contain; 1) a description of each parcel of real property receiving a particular extended service and 2) the amount of the assessment for each parcel for such fiscal year. 2. Section 25210.77a(a) of the California Government Code requires the Report to be filed with the Clerk of the Board of Supervisors. 3. Section 25210.77a(b) of the California Government Code requires upon filing of the Report a public hearing be fixed. 4. Section 53750 of the California Government Code, requires property owners within CSA L-100 be noticed and balloted if there is a proposed increase in the assessment. NOW, THEREFORE THE BOARD OF SUPERVISORS ORDERS AND RESOLVES AS FOLLOWS: 1. The FY 2008-09 Annual Report for CSA L-100 has been prepared and filed with the Clerk of the Board of Supervisors per attachment Exhibit A. 2. The Board directs a public hearing (the "Hearing") be fixed on July 8, 2008 at 9:30 a.m. in Room 107 of the Board of Supervisors' Chambers, 651 Pine Street, Martinez, California 94553. 3.
