(County Service Area L-100 Funds)(District 1) DATE: JUNE 17, 2008 PAGE: 2 of 2 FISCAL IMPACT: There is no impact to the County General Fund. The services related to this item are funded by the County Service Area L-100 (100%). REASONS FOR RECOMMENDATIONS AND BACKGROUND: The Public Works Department has submitted a request to LAFCO to annex certain areas along San Pablo Dam Road into the CSA L-100. This request was submitted based on a desire by the majority of the residents in the areas to be annexed for street lights in their neighborhoods. Residents along the section of San Pablo Dam Road from May Road to D'Avila Way approached the County requesting additional street lights be installed.The Public Works Department agreed to pursue installation of street lights if the majority of the property owners agreed to annex their properties into County Service Area L-100 and assess themselves for the annual operation and maintenance costs of those street lights. Homes and subdivisions located within this area were built prior to the requirement that property owners install street lights and annex into the County's street light program (County Service Area L-100). On June 12,2007,the County conducted a public hearing to determine if there was sufficient property owner support to annually collect operation and maintenance assessments from the property owners that would benefit from the future installation of street lighting facilities associated with the San Pablo Dam Road Street Light Installation Project. At the same meeting, the Clerk of the Board determined, based upon the results of the mailed balloting election, that a majority of the property owners who voted supported the annually levy of assessments for the operation and maintenance of street lights once installed with 64% in favor and 36% opposed. In order to complete the annexation of territory into County Service Area L-100(CSA L-100),the County requested on April 10, 2008, on behalf of the affected property owners, that LAFCO initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, commencing with Section 56000 of the California Government Code. As part of that request an Indemnification Agreement is required. After annexation of territory into CSA L-100, parcels within CSA L-100 will receive a special and direct benefit over and above that received by the general public in the form of street lighting services. This service is a miscellaneous extended service (the "Extended Service") as defined in Section 1012-2.406 of the Contra Costa County Code. CONSEQUENCES OF NEGATIVE ACTION: Without Board approval, the annexation cannot be completed and the residents will not receive the street lights they have requested.
