RECOMMENDED ACTION:
ADOPT Resolution No. 2008/*** approving deposit of$455,000 by the Contra Costa County Flood Control&Water
Conservation District (FC District) to the Flood Control Revolving Fund; approving loans from the Flood Control
Revolving Fund in the amount of$425,000 to Flood Control Zone 9 to provide funding for in-kind services for the
.Pinole Creek Greenway Demonstration Project Grant and related capital improvements and in the amount of$30,000
to Drainage Area 48B (DA 48B) for drainage area administration,project planning, and development coordination;
Pinole and Bay Point areas.

FISCAL IMPACT:
There is no fiscal impact-to the General Fund. Funds are deposited by the FC District into the Flood Control
Revolving Fund and loaned from the Flood Control Revolving Fund to another drainage entity. The borrowing
drainage entity agrees to pay the loan principal and interest over a five-year period.
Flood Control Zone 9(FCZ 9)currently does not have sufficient funds available to provide in-kind services for the
City of Pinole's River Parkways Grant and for construction of needed flood containment berms and floodwalls.
FCZ 9 needs to borrow $425,000 from the Flood Control Revolving Fund. Drainage Area 48B (DA 48B) has
currently accumulated unfunded costs of $16,000 for administration, project planning and development
coordination activities and is estimated to need an additional$3,000 this fiscal year and$11,000 in fiscal year 2008-
2009 for similar activities. DA 48B needs to borrow $30,000 from the Flood Control Revolving Fund. The FC
District currently has funds that are temporarily not needed and are available to deposit to the Flood Control
Revolving Fund.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
In 1966,the FC District,in cooperation with the U.S.Army Corps of Engineers(Corps),constructed improvements
in lower Pinole Creek. Since the passage of Proposition 13 in 1978,FCZ 9 has received no property tax revenue to
support the maintenance of existing flood control improvements or the construction of future flood control facilities
in Piriole Creek. The State of California provided limited funding, in the form of Special District Augmentation
Funds, until 1992. Since that time, FCZ 9 has depended on its reserve funds and revolving fund loans for
maintenance of the storm drain facility and construction of future flood control facilities.
The City of Pinole (City)was awarded a Proposition 50 River Parkways Grant from the State of California for the
Pinole Creek Greenway Demonstration Project.The Demonstration Project will modify the lower reaches of Pinole
Creek by excavating a floodplain bench to increase channel capacity and will improve public access paths and install
interpretive signage. The plan originally proposed to address sections of the creek both upstream and downstream of
the Union Pacific Railroad crossing.However,the project will have to be phased in order to resolve utility conflicts
at the existing bridge on Railroad Avenue. FC District staff has collaborated with the City and their consultants to
develop a restoration plan that minimizes sediment removal to limit environmental disturbance. The FC District's
hydraulic analysis of the restoration plan indicates the need to construct berms and flood walls along portions of the
creek to restore the level of flood protection provided by the original Corps project. Therefore, FCZ 9 requires
funding for the design and construction of the berms and flood.walls and for continuing support of the grant funded
creek restoration elements of the project. The FC District and City anticipate that the citizens of Pinole and Hercules
will recognize the value of the restored reach of Pinole Creek as a community amenity and will ultimately approve a
community finance measure to fund the complete restoration of Pinole Creek as well as its long-term maintenance.
FC District staff has been engaged in detailed analysis.of drainage improvements in DA 48B required to serve
development proposed by private developers and encouraged by the County Redevelopment Agency. The FC
District anticipated drainage fees generated from development would pay for the staff costs accumulated to date.
Unfortunately, economic factors have delayed initiation of the project. DA 48B requires funding to cover expenses
accrued to date and expected next fiscal year for drainage area administration,project planning, and coordination.
SUBJECT: _ ADOPT RESOLUTION APPROVING DEPOSIT BY THE FLOOD CONTROL DISTRICT TO

The FC District currently has finds that are temporarily not needed and are available to be deposited into the Flood
Control Revolving Fund. The attached resolution requests approval of the deposit from the FC District to the Flood
Control Revolving Fund and a loan from the Flood Control Revolving Fund to FCZ 9 and DA 48B.
CONSEQUENCES OF NEGATIVE ACTION:
If the proposed deposit and loans are not approved,the Pinole Creek Greenway Demonstration Project grant money
will be lost due to inadequate local cost sharing and the project will not be built; and staff will be unable to
adequately review and comment on development proposals in DA 48B.

SUBJECT: Approving Deposit by the Contra Costa County Flood Control&Water Conservation District

WHEREAS said Revolving Fund loan to Drainage Area 48B (DA 48B) is needed to fund drainage
area administration, project planning, and development coordination.
WHEREAS said loans shall be repaid to the depositing entity within five to ten years from the date of
disbursement from the monies available to FCZ 9 from proposed property assessments and DA 48B from
drainage area fees. Repayment shall include interest on the unpaid balance at 2.15 percent per annum,which
is the current rate received on similar types of investments by Contra Costa County as determined by the
County Treasurer.
NOW THEREFORE BE IT RESOLVED, as the Governing Board of Contra:Costa County Flood
Control and Water Conservation District, that said deposits and loans are approved.
