(District III) FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The developer, Windemere BLC Land Company, LLC, has completed the road improvements per the Road Improvement Agreement, and in accordance with the Title 9 of the County Ordinance Code. CONSEQUENCES OF NEGATIVE ACTION: The completion of improvements will not be accepted, the cash deposit will not be released, and the surety bond will not be exonerated. (District III) DATE: June 17, 2008 PAGE: 2 NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of June 17, 2008 thereby establishing the six-month terminal period for the filing of liens in case of action under said Road Improvement Agreement: DATE OF AGREEMENT NAME OF SURETY January 13, 2004 The Continental Insurance Company BE IT FURTHER RESOLVED the payment (labor and materials) surety for $80,500.00, Bond No. 929 285 606 issued by the above surety be RETAINED for the six month lien guarantee period until December 17, 2008, at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that Windemere Phase II Ridgeline Trail, the hereinafter described public improvements, as shown and dedicated for public use on a separate instrument, Offer of Dedication Trail Easement, recording series number DOC-2003-0587787-00 recorded on December 02, 2003, Official Records of Contra Costa County, State of California, is ACCEPTED AS COMPLETE. Upon Acceptance by the Board of Supervisors, the developer, Windemere BLC Land Company, LLC, shall retain the trail improvements for maintenance and ownership in accordance with the GHAD plan of control. BE IT FURTHER RESOLVED that there'is no warranty period required, and the Public Works Director is AUTHORIZED to refund the $1,600.00 cash security for performance (Auditor's Deposit Permit No. 415831, dated December 4, 2003) plus interest in accordance with Government Code Section 53079, if appropriate, to Windemere BLC Land Company, LLC, pursuant to the requirements of the Ordinance Code; and the Road Improvement Agreement and surety bond, Bond No. 929 285 606, dated November 21, 2003 are exonerated.
