(District III) FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The developer, Windemere BLC Land Company, LLC, has completed the road improvements per the Road Improvement Agreement, and in accordance wi 1 the Title 9 of the County Ordinance Code. CONSEQUENCES OF NEGATIVE ACTION: The completion of improvements will not be accepted, the cash bond will.not be released, and the surety bond will not be exonerated. RESOLVED that the improvements have been COMPLETED as of June 17, 2008 thereby establishing the six-month terminal period for the filing of liens in case of action under said Road Improvement Agreement: DATE OF AGREEMENT NAME OF SURETY May 6, 2003 Fidelity and Deposit Company of Maryland BE IT FURTHER RESOLVED the payment (labor and materials) surety for $199,500.00, Bond No. 08641755 issued by the above surety be RETAINED for the six month lien guarantee period until January 17, 2009, at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED thI t the Windemere Phase III Tank Access Road, the hereinafter described public improvements, as shown and dedicated for public use on the Final Map of Subdivision 03-08508 filed August 21, 2006, in Book 493 of final maps at Page 43, Official Records' of Contra Costa County, State of California, are ACCEPTED AS COMPLETED. Upon Acceptance by the Board of Supervisors, the developer, Windemere BLC Land Company, LLC, shall retain the trail improvements for ' maintenance and ownership in accordance with the GHAD plan of control. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the $3,990.00 cash security for performance (Auditor's Deposit Permit No. 402241, dated March 18, 2003). plus interest in accordance with Government Code Section 53079, if appropriate, to Windemere BLC Land Company, LLC, pursuant to .the requirements of the Ordinance Code; and the Road Improvement Agreement and surety bond, Bond No. 08641755, dated March 6, 2003 are exonerated.
