SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
As the Board of Supervisors:
a) APPROVE and AUTHORIZE the General Services Director or his designee to
execute a Funding Agreement for the Hookston Greenspace Project with the Contra
Costa County Redevelopment Agency in an amount not to exceed $175,000 for a
term beginning January 1, 2008 and terminating December 31, 2009; and
b),AUTHORIZE the Auditor-Controller to disburse from time-to-time Park Dedication
Funds from account 8136-275503381 in an aggregate amount not to exceed
$40,000.
As the Governing Board of the Redevelopment Agency:
a) APPROVE and AUTHORIZE the Redevelopment Director to execute a Funding
Agreement with Contra Costa County for the Hookston Greenspace Project.

FISCAL IMPACT
Funds from the Redevelopment Agency and County Park Dedication Funds are available for
payment of the noted costs.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The County owns the former Southern Pacific Railroad right-of-way from San Ramon to
Concord. The right-of-way is referred to as the Iron Horse Corridor. In the early 1990's the
Redevelopment Agency funded the purchase of a portion of the Iron Horse Corridor referred to
as Hookston Station. The purchase was part of a larger County program to preserve the
former Southern Pacific Railroad Company right-of-way for future transportation purposes.
The Redevelopment Agency utilized its funding from the Pleasant Hill BART Station
Redevelopment Project(now renamed the Contra Costa Centre Redevelopment Project Area).
When acquired, the Hookston Station property had a variety of private uses operating
pursuant to ground leases. Those uses have largely been terminated, and the property is
substantially vacant.
In 2006 the County adopted the Iron Horse Corridor Adopt-the-Corridor Handbook to
provide guidance to the many neighborhoods abutting the corridor as to permitted
landscape and related improvements. The Colony Park Neighbors Association has
proposed improvements in the Hookston Station Area. Those improvements have been
approved by the Iron Horse Corridor manager in the Public Works Department. The
recommended actions will provide a portion of the required funding needed to undertake
the improvements via a County Capital Project Program administered through the General
Services Department. For improvements, the Redevelopment Agency will fund for up to
$75,000 and the County, via Park Dedication funds, will fund up to $40,000. Park
Dedication funds are restricted revenues that may only be used to develop and construct
park and recreation improvements including landscape elements as proposed. In addition,
the Redevelopment Agency will cover the General Services Department costs of
preliminary and final design and construction inspection in an amount not to exceed
$60,000.

FUNDING AGREEMENT
WHEREAS, the Contra Costa County Redevelopment Agency ("Agency") administers funds for
infrastructure and community improvements in the Contra Costa Centre Area; and
WHEREAS,'.the Agency utilized its funds to acquire a portion of the Iron Horse Corridor in the
Hookston Station Area; and
WHEREAS, the Hookston Station property generated rent revenue from private leasehold
interests in existence at the time the Agency funded the acquisition of Hookston Station; and
WHEREAS, the Hookston station property has been largely cleared of private uses; and
WHEREAS, the County of Contra Costa administers a park dedication fee program for park and
recreation improvements; and
WHEREAS, the Colony Park Neighbors Association, (CPNA) has requested that the County of
Contra Costa approve a landscaping program for that portion of the Iron House Corridor in the Hookston
Station Area pursuant to the Adopt-The-Corridor Program Handbook (the "Handbook"); and
WHEREAS, the Contra Costa County Public Works Department has reviewed the proposed
landscaping improvements for consistency with the Handbook, and has approved the plans attached
hereto as Exhibit A.
WHEREAS, the CPNA has requested that the County General Services (GSD)undertake the
design and the installation of the landscaping improvements that is of benefit to the Hookston Station
Area; and
WHEREAS, said improvements and their costs have been reviewed by Agency staff, and found
to be of areawide benefit and within the appropriate cost parameters.
THEREFORE, the undersigned agrees as follows:
1) That said construction conforms with the County's Adopt-the-Corridor Handbook;
2) That the cost of the phase one landscaping improvements are approximately$115,000
3) That the Redevelopment Agency of Contra Costa County will reimburse the GSD for the
cost.of said improvements, including planning, design, contract and construction
administration,fabrication, and installation costs, not to exceed the smaller of costs or
$175,000 for and from the following:

The GSD shall submit a demand letter and proof supporting documentation, such as
completed work, to the Redevelopment Agency and County with any request for
reimbursement pursuant to this agreement. The Redevelopment Agency shall have up to
thirty days to review and act upon any reimbursement request. However, the
Redevelopment Agency and County agrees, in good faith, to process any demands for
reimbursement as quickly as practicable.
4) That should,for any reason, the GSD fail to complete said improvements, or fail to construct
in accordance'with the County Adopt—the-Corridor Handbook, any amounts due shall,be
withheld until corrections satisfactory to the Agency are completed.
5) Nothing contained in this Funding Agreement is intended, nor shall be construed, to create
rights,inuring to the benefit of third parties
