FISCAL IMPACT The 2009 Housing Element update is required by California Government Code§65580-65589.8. It is an unfunded state mandate, but certain activities related to the preparation of the Housing Element update may be eligible for an SB 90 claim. BACKGROUND/REASONS FOR RECOMMENDATION The County's current Housing Element was adopted by the Board of Supervisors in December 2001, and it covers the period from 1999 to 2006. The Housing Element was subsequently included in the reconsolidation of the County General Plan in 2005. As required by State law,the Housing Element for local jurisdictions in the nine-county Bay Area region must be updated no later than July 1, 2009(Govt. Code§65588(e)(2)). The Department previously reported to the Board of Supervisors in a Board Order for the Annual General Plan Progress Report, submitted on March 13, 2008, that the 2009 Housing Element update would be a significant work activity for the Department during 2008 and 2009. This Board Order is a follow-up report intended to describe to the Board the process and key activities associated with the 2009 Housing Element update. CAO County Counsel County Housing Authority BY , DEPUTY May 13, 2008 Board of Supervisors Report on Process for 2009 Housing Element Update Page 2 BACKGROUND/REASONS FOR RECOMMENDATIONS - continued A critical piece of the Housing Element update is the jurisdiction's Regional Housing Needs Allocation (RHNA). Housing Element law requires a quantification of a jurisdiction's share of regional housing need as established by the Council of Governments.The RHNA is a minimum projection of additional housing units needed to accommodate the project household growth of all income levels by the end of the Housing Element's statutory planning.period or cycle. Each jurisdiction's RHNA is distributed among four income categories to address the required provision of planning for housing among all income levels and should be reported in the Housing Element under the following income categories: • Very Low(0-50% Average Median Household Income) • Low(50-80% Average Median Household Income • Moderate ((81-120% Average Median Household Income) • Above Moderate (over 120% Average Median Household Income) In the Bay Area region, the RHNA is determined by the Association of Bay Area Governments(ABAG), acting in its capacity as the Council of Governments.ABAG released the proposed final RHNA on March 20, 2008. The County's RHNA for the 2009 Housing Element will likely be 3,508 housing units. This number includes 815 units affordable to very-low income households,598 units affordable to low-income households, 687 units affordable to moderate income households, and 1,408 units affordable to above- moderate income households. For comparison, the RHNA requirement under the current Housing Element planning period or cycle is 5,436 total units. Other areas of the Housing Element that will require significant updating are the inventory of vacant and underutilized parcels suitable for residential development and demographic information. Staff does not anticipate significant changes in the housing programs described in the Housing Element. In addition, the revised Housing Element must respond to legislation passed since 2001. New laws include the following requirements: • Identify the need for emergency shelters and designate zoning districts adequate to accommodate the need. In those zones,shelters must be allowed without a conditional use permit or other discretionary permit and are exempt from the California Environmental Quality Act. Analyze the need for supportive and transitional housing and describe a program to reduce constraints on the development of this housing (Senate Bill 2, Chapter 633, Statutes of 2007). • Determination of available land suitable for urban development or conversion to residential use may exclude lands where flood management infrastructure is inadequate to avoid the risk of flooding(Assembly Bill 162, Chapter 369, Statutes of 2007). It is noted that A.B. 162 calls for local jurisdictions to update flood protection policies in their General Plan's Safety Element in conjunction with the Housing Element update. Updating the Housing Element requires public outreach and engagement. The Department would welcome any advice and assistance from Board members about effectively engaging the public in Housing ,Element update process. As an initial step, staff identified several activities to engage the public. These efforts include the following: • Conduct focus group meetings with small groups of individuals that have knowledge or interest in a specific section of the Housing Element. V� May 13, 2008 Board of Supervisors Report on Process for.2009 Housing Element Update Page 3 BACKGROUND/REASONS FOR RECOMMENDATIONS - continued • Host larger meetings for members of the general public at locations throughout the County and at times that are convenient for the public. • Provide information at other scheduled events, such as the Housing Fair scheduled for May 17th during National Affordable Housing Week, May 11-17, 2008. Notices of meetings regarding the Housing Element update will be advertised in newspapers and distributed through service agencies.All meeting notices will be sent to each Supervisor's district office. Additionally, a webpage for the Housing Element update will be created on the County's website where meeting notices, reports, and other material related to the update will be posted for public review. Attached for the Board's consideration,is a schedule/time for the Housing Element Update. The draft schedule anticipates that initial revisions to the Housing Element will be substantially completed by the end of June 2008. Focus group meetings would be held in mid-summer. General public meetings will be held in the late summer to early fall. Staff intends to take the first draft of the Housing Element to one or more County Planning Commission (CPC) study sessions in the fall. Based on County Planning Commission and public input,a revised draft will then be submitted to the State Housing and Community Development Department(HCD)for its initial review. Staff anticipates additional revisions will follow the HCD review. Staff expects to take a final revised Housing Element.to a public hearing at the County Planning Commission in May 2009. The Board hearing to consider adoption of the revised Housing Element is anticipated in mid to late June 2009.
