HomeMy WebLinkAboutMINUTES - 05132008 - C.42 TO: BOARD OF SUPERVISORS Contra FROM: William Walker, M.D., Health Services Director _ o Costa By: Jacqueline Pigg, Contracts Administrator DATE: April 30, 2008 County SUBJECT: Approval of Standard Agreement#28-315 with the California Department of Public Health SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&'BACKGROUND JUSTIFICATION RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee (Randy Sawyer), to execute on behalf of the County, Standard Agreement #28-315 with the California Department of Public Health to pay the County an amount not to exceed $96,000, for the Hazardous Materials Program to evaluate the County's Industrial Safety Ordinance Risk Management Chapter and the implementation of the Ordinance, for the period from May 1, 2008 through April 30, 2009, including mutual indemnification to hold harmless the State from any claims arising out of the performance of this Contract. FISCAL IMPACT: Approval of this agreement will result in an amount not to exceed $96,000 of funding from the California Department of Public Health, for the Hazardous Materials Program, Chemical Plant Safety. No County funds required. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The Board of Supervisors approved the Industrial Safety Ordinance in December 1998. The Ordinance's Risk Management Chapter expands on state and federal law for the prevention of accidental releases from petroleum refineries and chemical plants in the unincorporated areas of the County. The City of Richmond adopted the Risk Management Chapter in January 2000. The California Department of Public Health Occupational Health Branch is interested in evaluating the effectiveness of the Industrial Safety Ordinance. The initial understanding is that the Industrial Safety Ordinance has contributed to a better overall safety record from the petroleum refineries and chemical plants in Contra Costa Count.
