SUBJECT: AMENDMENT TO GRANT FROM THE U.S. BUREAU OF RECLAMATION FOR
ACQUISITION OF PROPERTIES BY THE EAST BAY REGIONAL PARK DISTRICT FOR
THE IMPLEMENTATION OF THE EAST CONTRA COSTA COUNTY HABITAT
CONSERVATION PLAN
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
AUTHORIZE the Director of the Department of Conservation and Development, or his designee, to
execute all documents necessary to amend an existing grant contract with the U.S. Bureau of
Reclamation (USBR) to: a) extend the contract by one year from September 30, 2009 to September
30, 2010; b)adjust the scope of the grant to provide additional land acquisition options; and c)increase
the grant amount by $250,000, from a prior total of$991,631 to a new total of$1,241,631, to support
land acquisition consistent with the East Contra Costa County Habitat Conservation Plan / Natural
Community Conservation Plan (HCP/NCCP) by the East Bay Regional. Park District (EBRPD).
FISCAL IMPACT
No impact to general fund. Most of the funding would be passed through the County to EBRPD land
acquisitions from USBR. County costs to administer the pass-through, estimated to be less that
$15,000, would be covered by the grant.

BACKGROUND/REASONS FOR RECOMMENDATIONS
Contra Costa County has an existing grant contract with the U.S. Bureau of Reclamation
for$991,631 to fund acquisition of up to 690 acres of important habitat for threatened and
endangered species in Eastern Contra Costa County. As the coordinating agency for
coalition of local agencies involved in the HCP/NCCP, the County applied for and received
this grant prior to formation of the East Contra Costa County Habitat Conservancy
(Conservancy), the joint exercise of powers authority established to implement the
HCP/NCCP. The existing contract provides that the County will use the grant funds to .
assist with EBRPD's acquisition of any of three parcels on a willing seller basis. At the time
the Board approved the existing grant contract, the Board declared its intent to transfer the
responsibility for administering this grant to the Conservancy upon the Conservancy's
request.
The USBR is now proposing three changes to the existing contract: a) a one-year time
extension for the expenditure of funds, b) addition of two parcels to the list of eligible
parcels, and c) a $250,000 increase to the grant amount. These changes would occur
through two separate contract amendments. One amendment would simply add one of the
new properties. The other amendment would add the fifth parcel, extend the term, and
increase the grant amount. This second amendment would also stipulate that the
additional funds and not more than $300,000 of the existing funds be used for this fifth
parcel. Staff are seeking authorization to execute all necessary documents to accomplish
these two grant contract amendments.
With the exception of up $15,000 of County staff expenses to administer the grant, all
funds would be contributed toward willing-seller land acquisitions by EBRPD. The
proposed acquisitions are consistent with the conservation priorities described in the HCP
and would help to achieve conservation objectives for several endangered or threatened
species.
