FISCAL IMPACT The proposed amendment to raise the cap on tax increment that may be received will trigger AB 1290 tax increment pass-through requirements once the current limit of$116 million is reached. All taxing agencies, including the County and County controlled agencies would begin receiving pass through payment at that time, which is estimated to occur in FY 08/09 or later. The recommended action is to simply establish the hearing date. BACKGROUND/REASONS FOR RECOMMENDATIONS On June 12, 2007,the Board of Supervisors and the Governing Board of the Contra Costa County Redevelopment Agency authorized proceeding with a Sixth Amendment to the Bay Point Redevelopment Plan. The Plan Amendment is needed to • Raise the limit on the amount of bonds secured by a pledge of tax increment that may be outstanding at one time from $60 million to $220 million; and • Increase the limit on the total amount of tax increment that the Agency may receive over the term of the plan from $116 million to $689 million. These amendments, when approved, will permit the Redevelopment Agency to complete the redevelopment program at Bay Point, including the Transit Village Project in the Orbisonia Heights area, the Bay Point Waterfront initiative, and the Bella Vista area infrastructure program, employment area infrastructure improvements, as well as other affordable housing initiatives. The Contra Costa County Board of Supervisors RESOLVES THAT: The Board of Supervisors of the County of Contra Costa (the "Board") has been informed by the Redevelopment Agency of the County of Contra Costa (the "Agency") that the Amendment to the Redevelopment Plan for the Bay Point Redevelopment Project (the "Plan Amendment") and a Report on the Plan Amendment (the "Report") have been prepared; and The Agency has submitted copies of the Plan Amendment and Report to this Board for its review; and There is a need for a joint public hearing with the Agency to consider the Plan Amendment and Report, and to have interested groups and citizens be heard on the Plan Amendment and Report. NOW, THEREFORE, BE IT RESOLVED that the Board hereby approves the convening of a joint public hearing with the Agency on Tuesday, May 20, 2008, at 11:00 a.m., at the Board Chambers, 651 Pine Street, Room 107, Martinez, California for purposes of considering the Plan Amendment and Report. BE IT FURTHER RESOLVED that the Clerk of the Board is hereby directed to publish, in cooperation with the Agency, the "Legal Notice - Joint Public Hearing" (the "Notice") which has been prepared by Agency staff, a copy of which is on file with the Agency Secretary and by this reference incorporated herein, not less than once a week for four successive weeks in the Contra Costa Times, newspapers of general circulation published and circulated in the County of Contra Costa. BE IT FURTHER RESOLVED that the Board hereby directs the Clerk of the Board to cooperate with the Agency in mailing a copy of the Notice to the last known assessee of each parcel of land in the Project Area, at the assessee's last known address as shown on the last equalized roll of County of Contra Costa. BE IT FURTHER RESOLVED that the Board hereby directs the Clerk of the Board to cooperate with the Agency in mailing a copy of the Notice to the occupants of each address in the Project Area. The Contra Costa County Board of Supervisors RESOLVES THAT: The Redevelopment Agency of the County of Contra Costa (the "Agency") is preparing the Amendment to the Redevelopment Plan for the Bay Point Redevelopment Project (the "Plan Amendment"), which provides for tax increment financing pursuant to Health and Safety Code Section 33670 ("Tax Increment"); and The County of Contra Costa is the community amending the Plan Amendment and is authorized to make the election described in Health and Safety Code Sections 33607.5(b) and 33607.7(b)(2). NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Contra Costa ("Board ") elects to be paid the amounts set forth in Health and Safety Code Section 33607.5(b) for each fiscal year payments are to be made pursuant to Health and Safety Code Section 33607.7(b) as a statutory pass-through payment from the Agency Tax Increment. BE IT FURTHER RESOLVED that it is the policy intent of the Board that the amount received as a statutory pass-through payment each fiscal year by the County will be appropriated for programs and activities that benefit the community covered by the Plan Amendment and support the redevelopment program, as determined in the annual County budgeting process. The Contra Costa County Redevelopment Agency RESOLVES THAT: The Redevelopment Agency of the County of Contra Costa (the "Agency") staff has prepared the Amendment to the Redevelopment Plan for the Bay Point Redevelopment Project (the "Plan Amendment") and a Report on the Plan Amendment (the "Report")-, and The Agency has authorized submittal of the Plan Amendment and Report to the Planning Commission for its report and recommendation and to the Board of Supervisors of the County of Contra Costa (the "Board") for their review; and Pursuant to the California Community Redevelopment Law, the Agency desires to hold a joint public hearing with the Board on Tuesday, May 20, 2008 commencing at 11:00 a.m. at the Board Chambers, 651 Pine Street, Room 107, Martinez, California, for the purpose of considering the Plan Amendment and Report thereon; and Any person or organization desiring to be heard at that public hearing will be afforded an opportunity to do so. To that end, and pursuant to State law, the Agency desires the publication of a "Legal Notice - Joint Public Hearing" (the "Notice") in a newspaper of general circulation. The Agency further desires written notice be sent to all property owners, businesses and residents within the boundaries of the Bay Point Redevelopment Project as more particularly set forth below. A copy of the Notice substantially in the form to be published and mailed is on file with the Agency Secretary and is incorporated in this Resolution by this reference; and The Agency further desires that copies of the Notice be mailed to each taxing agency levying taxes on any property in the Bay Point Redevelopment Project as more particularly set forth below. NOW, THEREFORE, BE IT RESOLVED that the Agency approves the convening of a joint public hearing with the Board on May 20, 2008 at 11:00 a.m. at the Board Chambers, 651 Pine Street, Room 107, Martinez, California, for the purposes of considering the Plan Amendment and the Report. 1 320\24\542747:1 BE IT FURTHER RESOLVED that upon approval by the Board of a joint public hearing on that date, the Deputy Director of the Agency is directed to: (a) publish the Notice not less than once a week for four successive weeks prior to the public hearing in the Contra County Times, newspaper of general circulation for the County of Contra Costa, (b) mail a copy of the Notice to the last known assessee of each parcel of land in the Project Area designated in the Plan Amend►nent, at the assessee's last known address as shown on the last equalized assessment roll of Contra Costa County; (c) mail a copy of the Notice to the occupant of each address in the Project Area, thereby providing additional notice to businesses and residents in the Project Area; and (d) mail a copy of the Notice to the governing body of each of the taxing agencies which levies taxes upon any property in the Project Area designated in the proposed Plan Amendment. The Contra Costa County Redevelopment Agency RESOLVES THAT: The Redevelopment Agency of Contra Costa County (the "Agency"), has prepared the proposed Amendment to the Redevelopment Plan for the Bay Point Redevelopment Project (formerly known as the "West Pittsburg" Redevelopment Project] (tile "Plan Amendment"). together with an accompanying Report to Board of Supervisors (the "Plan Amendment Report"), and an accompanying Proposed Negative Declaration (the "Negative Declaration"); and Pursuant to the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.; the "CRL"), the Agency desires that a public hearing (tile "Joint Public Hearing") on the Plan Amendment and the accompanying Plan Amendment Report and Negative Declaration be jointly convened by the Agency and the Board of Supervisors of Contra Costa County (the "Board") on May 20, 2008 at 11:00 a.m.; and Pursuant to CRL Sections 33346, 33347, and 33453, prior to the Joint Public Hearing, the proposed Plan Amendment and accompanying documents must first be submitted to the Planning Commission of Contra Costa County for its recommendations and report; and The Planning Commission is required to detcnnine if the Plan Amendment conforms to the General Plan of Contra Costa County,and may make recommendations to the Board and the Agency regarding the adoption of the Plan Amendment; and Pursuant to the CRL, the Plan Amendment, the Plan Amendment Report, and the Negative Declaration must also be formally submitted to the Board for its review prior to the Joint Public Hearing; and The Agency now desires to submit the Plan Amendment, the Plan Amendment Report, and the Negative Declaration to the Board and the Agency regarding adoption of the Plan Amendment. NOW, THEREFORE, BE IT RESOLVED that the Executive Director of the Agency is hereby authorized to submit the Plan Amendment, the Plan Amendment Report (together with any further supplements thereto), and the Negative Declaration to the Planning Commission of Contra Costa County for its report, recommendation, and review as herein above stated, and the Planning Commission is hereby authorized to conduct such hearings and reviews as are appropriate. The report and recommendation of the Planning Commission shall be due to the Board prior to the Joint Public Hearing. BE IT FURTHER RESOLVED that the Executive Director of the Agency is hereby authorized to submit the Plan Amendment, the Plan Amendment Report, and the Negative Declaration to the Board for its review prior to the Join Public Hearing. 320\24`•.542755.1
