County SUBJECT: Local Agency Formation Commission Employee Benefits Administration SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE attached Resolution 2008/210 permitting LAFCO employees to continue to participate in County administered benefit programs in exchange for LAFCO's continued reimbursement to the County for the full costs of the LAFCO employees' participation in these programs. FISCAL IMPACT: There is no fiscal impact. LAFCO will reimburse the County for the costs of employee participation. BACKGROUND: The Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 requires that Local Agency Formation Commissions (LAFCO) be independent of the County. Furthermore, Government Code § 56384(a) stipulates that the Executive Officer must be appointed and employed by LAFCO, and may appoint other staff as needed. Contra Costa LAFCO is currently staffed with an Executive Officer and a Secretary-Advanced Level who is a County employee that is charged to LAFCO. LAFCO would like to exercise its' right under Government Code § 56384(a) to appoint the Secretary-Advanced Level to a LAFCO position. LAFCO staff has been participating in County benefit programs as County employees. The combination of LAFCO's 2007-2 Resolution and attached Resolution 2008/210 provides a benefit package for LAFCO employees and access to County administered programs. In addition, Government Code § 56385 provides that LAFCO may provide for health and medical benefits for its employees and that LAFCO must preserve the vacation, sick leave and compensatory time accruals, CONTINUED ON ATTACHMENT: X YES SIGNAT1 IPP ` RECOMMENDATION OF COUNTY ADMINISTRATOR. Resolution 2008/210 requests that the Board of Supervisors authorizes LAFCO employees to continue to participate in the following County administered benefit Programs, in exchange for LAFCO's continued reimbursement to the County for the full costs of the LAFCO employees' participation in these programs: • Medical and Dental Plans; • Health Care Spending Account; • Long Term Care; Dependent Care Assistance Program; Deferred Compensation Plan; • Long Term Disability Insurance; Management Life Insurance, and; •. Workers' Compensation and Continuing Pay.
