I DIRECT the Real Property Division to have the above referenced Grant Deed and an Assignment of Easement recorded in the Office of the County Recorder. SDMD4 (.now called Drainage Area 127, Fund 256300) funds are to be coliected and provided to the District in perpetuity for the continued maintenance of Rhcern Creek. I REASONS FOR RECOMMENDATIONSI AND BACKGROUND: i The property rights for the Rheem Creek Flood Control Channel are currently in the name of the County. The channel improvements were constructed by the Army Corps of Engineers in the 1960s with the understanding that the County would maintain these facilities. Portions of Rheem Creek are now located within the City of Richmond and the City of San Pablo due to annexations. Since the County cannot spend maintenance money within the incorporated city limits, the property rights are being transferred to the District for continuation of maintenance. i A Determination of Exemption from CEQA under State CEQA guidelines pursuant to Article 5, Section 15061(b)(3) has been previously approved.
