SPECIFIC RE(II.IES RS)OR RI::CONIMEND:10 10N(S)&-,BACKGROUND:AND JUSTIFICATION
RECOMMENDED ACTION:
1)ETERMINE that the proposed assignment of easement for Assessor's Parcel Numbers 008-010-037 and 008-»0-
044.. IS not subject to the California Environmental Quality Act(CEQA),pursuant to Article 3,Section 1-5061 (b)(3)
of the CEQA guidelines: DIRECT the Director of Community Development, or designee, to file a Notice of
Exemption with the County Clerk-, DIRECT the Public Works Director.or designee.to arrange for payment of the
$50.00 handling lee to the Coultty Clerk for filing and a $23.00 tee to Community Development for processing of
the Notice of Exemption.
APPROVE and AUTHORIZE the assignment of storm drain easements to Contra Costa Count Flood Control and
Water Conservation District (District), pursuant to Government Code 2 -525.6.
AUTHORIZE the Chair, Board of Supervisors, or designee. to execute the Assignment of Easement on behalf of
Contra Costa County (County): and

DIRECT the Real Property Division to have said Assignment of Easement delivered to the District for acceptance.
FISCAL IMPACT:
There is no impact to the County General fund.
BACKGROUND AND REASONS FOR RECOMMENDATIONS:
The County accepted an Offer of Dedication for a storm drain easements on May 28,2003 in the Discovery Bay area
for Kellogg Creek and Frisk Creek Project. Said property is being transferred to the District for flood control
maintenance.
CONSEQUENCES OF NEGATIVE ACTION:
Title for flood control maintenance responsibility will not lie with the correct public agency.
