RECOMMENDED ACTION:

APPROVE the sale and conveyance of surplus property to Tamara E. Coral and Jason Toomey pursuant to Streets
and Ilighway Code 960;
AUTHORIZE the Chair, Board of Supervisors er- designee., to execute the Grant Deed and Sales Agreement on
behalf of the Contra Costa County; and
DIRECT the Real Property Division to cause said Grant Deed to be delivered to the Grantee for acceptance and
recordine.

FISCAL IMPACT:
There is no impact to the County General Fund. This parcel was purchased with Contra Costa Transportation
Authority(CCTA) funds. All funds received for the sale of this parcel will be refunded back to CCTA.
BACKGROUND AND REASONS FOR RECOMMENDATIONS:
In 1998,the County acquired right of way for the State Route 4,Bailey Road to Railroad Avenue Project.CCTA no
longer needs the reminder of this property for State Highway purposes and wishes to dispose of the parcel as surplus
property.
CONSEQUENCES OF NEGATIVE ACTION:
.County would own and be liable for the maintenance of the property.

of the State of California, recorded September 09, 1998 as Document No. 98-0217304-00 in the
Office of the County Recorder of Contra Costa County, California, more particularly described
as follows:
BEGINNING at the southeastern corner of the above referenced Lot 23: thence along the
eastern line of said Lot 23, N00°29'00"E, 98.80 feet; thence leaving last said line on a non
tangent curve to the left, from which point a radial line bears N05°52'44"t1.1, having a radius of
5538.09 feet, through a central angle of 01 041'03", an arc distance of 162.80 feet to the

REAL PROPERTY SALES AGREEMENT
THIS AGREEMENT is made and entered into this 10th day of March, by and between
Contra Costa County, a political subdivision of the State of California, hereinafter called
"Grantor" and Jason Toomey and unmarried man and Tamara E. Conn an unmarried
woman, as Joint Tenants, hereinafter called "Grantee."
In consideration of the covenants and conditions hereinafter contained, it is mutually
agreed as follows:
1. Grantor hereby agrees to sell and convey that certain real property described
in Exhibit "A", attached hereto and made a part hereof, to the Grantee for
the sum of Twenty-three Thousand Dollars ($23,000.00).
2. The right, title and interest in the property to be sold shall not exceed that
vested in the Grantor, and said property is sold subject to all existing
easements, covenants, conditions, restrictions, reservations, and all other
encumbrances, whether the same be recorded or unrecorded.
3. Grantee shall pay all costs of escrow, title insurance, and recording fees, if
applicable.
4. Grantor shall retain possession of the property up to the date of recording
the deed.
5. Grantee shall deposit with the Grantor the full purchase price by March 13,
2008 prior to the approval of this transaction by the Board of Supervisors.
The Grantee understands that this sale is subject to approval by the County
Board of Supervisors, and the Grantor reserves the right to cancel the at
anytime prior to the recording of the deed. In the event of cancellation of
sales, all monies deposited shall be refunded without payment of interest.
6. Upon approval of the sale by the County Board of Supervisors and upon
receipt of payment in full for the property being sold, Grantor will cause to be
delivered to Grantee a quitclaim to the property properly executed by the
Grantor.
7. The property described herein is being sold and conveyed on an "as is" basis
and Grantor makes no warranty, claim or guaranty, or any kind, as to the
condition and/or possible uses of the land or any improvements thereon.
Grantee understands that the property is not capable of independent use and
agrees and approves of the combining of this property with her adjacent
property to create one parcel.
The parties herein have set forth the whole of their agreement and the performance of this
agreement shall relieve the grantor of all further obligations or claims on this account.
