(Flood Control Zone 3B Funds) (Districts 11 &IV)Project No. 7520-6138345 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: DETERMINE that there is a need to continue the emergency action taken by the Board of Supervisors on April 10,2007,pursuant to Public Contract Code Sections 22035 and 22050,to implement the Lower Walnut Creek Interim Protection Measures project, Pacheco area. (Flood Control Zone 3B Funds) (Districts H & IV)Project No., 7520-6B8345 DATE: April 22, 2008 PAGE: 2 of 2 1 REASONS FOR RECOMMENDATIONS AND BACKGROUND: j i A. On April 10, 2007, the Board of Supervisors declared an emergency and authorized the Chief Engineer to proceed in the most expeditious manner to repair or replace the Lower Walnut Creek flood control facility as directed by the US'Army Corps of Engineers. B. Repair status: The Contra Costa County Flood Control and Water Conservation District(District)prepared the Lower Walnut Creek Corrective Action Plan and presented it to the US Army Corps of Engineers for consideration on June 11, 2007, A status report, including this Corrective Action Plan(CAP),was presented to the Transportation,Water and Infrastructure Committee'on June 25, 2007. Project plans were prepared and the District contracted with Pacific States Environmental Consultants to constrict the first phase of the Lower Walnut Creek Interim Protection Measures project pursuant to the CAP. This first phase of the project was completed in early December 2007. However, additional work is required to fully implement the CAP. The CAP is currently under review byUS Army Corps of Engineers Headquarters. The full scope and schedule of the CAP will not be known until completion of the federal review. l CONSEQUENCES OF NEGATIVE ACTION: Nonconcurrence with the above recommendation may significantly delay implementation of the remaining CAP work in Lower Walnut Creek flood control facility and prevent the District from meeting the correction schedule required by the US Army Corps of Engineers.
