AUTHORIZE the Director of General Services, or designee, to EXECUTE the Second Amendment to Lease on behalf of the County, and to EXERCISE any options to extend the Lease. 3. DETERMINE that the project is a Class 1, Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). 4. DIRECT the Director of Community Development, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment of the handling fees to,the Community Development Department and County Clerk for filing of the Notice of Exemption. FINANCIAL IMPACT The Second Amendment to Lease will obligate the County to pay a total rent of approximately $85,200 over the three-year extension of the term. The Second Amendment to Lease was anticipated and budgeted in the .Building Inspection Department's approved FY 2007/2008 budget. The County can terminate the lease with a six-month written notice to the Lessor. BACKGROUND The County has leased the premises since January 1, 2001,. This Second Amendment to Lease will provide for the continued use of the office space by the Building Inspection Department. WHEREAS, Lessor and Lessee entered into that certain Lease Agreement dated December 11, 2001,(hereinafter called the "Lease") covering those certain premises containing approximately 1,578 square feet, identified as 1,191 Central Blvd., Suite C in the City of Brentwood, County of Contra Costa and the State of California(the "Premises"), located in the TownCentreTrofessiorial Building, Brentwood, California; WHEREAS, Lessor and Lessee entered into that certain Lease Extension-Agreement dated March 17, 2005, by and between HPH Properties, LP and County of Contra Costa, a political subdivision of the State of California; NOW, THEREFORE, inconsideration of the Premises, the agreements of the parties hereinafter set forth and other good and valuable,consideration, the receipt and adequacy of which is hereby acknowledged, Lessor and Lessee hereby agree as follows: 1. The Lease shall be extended for a three (3) year period, commencing April 1, 2008, and ending on March 31, 2011 (the "Extension Period"). Lessee shall have the right to terminate this lease by providing Lessor with a six (6) month written notice of its intent to terminate the lease. 2. Base Rent during the Extension Period shall be as follows: A: TWO THOUSAND TWO HUNDRED NINETY AND NO/100 DOLLARS ($2,290.00) per month commencing April 1, 2008 and ending March 31, 2009. B. TWO THOUSAND THREE HUNDRED SEVENTY AND NO/100 DOLLARS ($2,370.00) per month commencing April 1, 2009 and ending March 31, 2010. C. TWO THOUSAND FOUR HUNDRED FORTY-FIVE AND NO/100 DOLLARS ($2,445.00) per month commencing April 1, 2010 and ending March 31, 2011. 3. Lessor shall provide janitorial services as outlined in Exhibit A, attached hereto and made a part hereof. Lessee shall reimburse the Lessor for the janitorial expense on a monthly basis. 4. Except as specifically amended above, all other terms, conditions, and covenants of the Lease shall continue and remain unchanged, and the Lease is hereby ratified and confirmed. Nightly a) Carpeted Areas: Thoroughly vacuum and spot clean carpets and floor mats to remove spots and spills. b) Uncarpeted Areas: Thoroughly sweep (being sure to pick up all dust balls) and spot mop with a germicidal solution to remove all marks, spills and stains. c) Walls, Doors, and Frames: Spot clean to remove all finger marks and smudges. Thoroughly clean all glass entry way doors. d) Drinking Fountains: Sanitize and polish all drinking fountains. _e) .Light Bulb Replacement: Check for burned out light bulbs) and replace (less than 15 feet high). f) Trash Can and Liners: Empty all trash cans andreplace liners as necessary. g) Counter Tops: Wash reception and kitchen counter tops, where applicable. h) Waste Materials: Break down cardboard and place at Recycle .Pickup Point. Deposit other waste materials in outside trash dumpster. i) Gum Removal: Remove all gum from under tables and chairs where applicable. 2. Weekly a) Uncarpeted Areas: Remove area rugs/mats, sweep and damp mop to remove all loose dirt and grit. Thereafter buff all vinyl, tile and linoleum floors to a uniformly bright condition as required. b) Chairs & Tables: Thoroughly wipe down all chairs and tables with a mild germicidal solution, leaving the same in a streaki�free condition (pay particular attention to the children's reading areas in all library locations). f 3. Monthly a) Dusting: Dust all mini-blinds, partitions, window sills, and other horizontal surfaces. Remove all cobwebs from walls] and ceilings including ventilation grills 15 feet and lower. b) Wipe all telephones with treated dust cloth. C) Carpeted Areas & Carpet Mats: Thoroughly vacuum and edge carpeted floors using pile lifter to remove all embedded dirt and grit. 4. Bi-Monthly (Every 2 months) Area Rugs and Carpets: Thoroughly vacuum, edge, and "Bonnet Buff all carpeted areas and area rugs. 5. Yearly a) Uncarpeted Areas: Completely strip down all vinyl, tile, and linoleum floors to the bare floor surface, totally free of any wax, sealer or other finish. After stripping, apply 3 coats of finish. At the next service date, or after 24 hours, buff the floors to a uniformly bright condition. Walls, baseboards, furniture and adjoining,carpeted areas shall be free of wax, water, and other marks. b) Carpeted Area and Area Rugs/Mats: Thoroughly vacuum, hot water extract all carpeted floors including stairways and area rugs to remove any spots, stains or other spills, and leave same in a uniformly clean condition. Transit District (BART) for County to deliver, install, and operate a Library Book Dispensing Machine at the Pittsburg / Bay Point BART station located at 1,700 West Leland Road, Pittsburg, under the terms and conditions more particularly set forth in the Permit to Enter. 2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Permit on behalf of the County. 3. DETERMINE that the project is a Class 1(a) Categorical Exemption under the California Environmental Quality Act (CEQA). 4. DIRECT the Director of Community Development, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the, Director of General Services, or designee, to arrange for the payment of the handling fees to'the Community Development Department and County Clerk for filing of the Notice of Exemption. FINANCIAL IMPACT The Contra Costa County Library requested and received $287,898 from the California State Library Services Technology Act's Grant Programs for FY 07-08 to introduce automated book dispensing machine to the County. The cost of installing and operating the book dispensing machine at the Pittsburg / Bay Point BART station will be paid for by those funds. BACKGROUND A County Regional Needs Assessment for County Libraries previously presented to the Board reported that inequities in library service delivery exist in Far East County. An additional challenge facing County Libraries is meeting the needs of county-wide commuters.
