HomeMy WebLinkAboutMINUTES - 04152008 - C.36 J • w • • V TO: BOARD OF SUPERVISORS Contra FROM: William Walker, M.D.,Health Services Director Costa By: Jacqueline Pigg, Contracts Administrator DATE: April 1,2008 County SUBJECT: Approval of Standard Agreement#28-764-1 with the State Department of Mental Health SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND JUSTIFICATION RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee (Donna Wigand), to execute, on behalf of the County, State Agreement #28-764-1 (07-757307-000) with the State Department of Mental Health, which replaces and supercedes Agreement #28-764, to increase the payment limit by $523,286, to a new total payment to the County of$21,568,159, and to set the term of the agreement to July 1, 2004 through June 30, 2008. The parties are agreeing to indemnify and hold one another harmless for claims resulting from the indemnifying party's acts or omissions. FISCAL IMPACT: Approval of this Agreement results in an increase of$523,286 from the State Department of Mental Health. No County match is required. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): In November 2004, California voters passed Proposition 63, the Mental Health Services Act ("MHSA") intended to transform the public mental health system by increasing funding to a State- mandated program under the Welfare and Institutions Code. The MHSA contains several different areas of funding, with the goal of creating a better program of mental health services in California's local communities. In or about December 2005, in order to receive funding under the MHSA for Community Services and Supports ("CCS"), Contra Costa County Mental Health submitted a three-year proposed plan, which demonstrated broad input and community collaboration for County mental health issues. The State Department of Mental Health approved the County's proposed plan in June 2006 and gave final budget approval of September 2006. The County programs monitor the progress of serving citizens' mental health needs. The original term of the performance contract with the State was June 1, 2006 through June 30, 2008. The State wishes to execute a new MHSA Agreement, replacing and superceding the existing performance contract. The new Agreement incorporates fiscal years 2004-2005 and 2005-2006. During these fiscal years, Contra Costa County Mental Health conducted an extensive planning process with over 1,100 community stakeholders to prepare the three-year proposal to the State. The State has approved funding and is reimbursing the County for this planned period. The new Agreement also adjusts the funds to the County for fiscal years 2006-2007 through 2007- 2008. In sum, approval of State Standard Agreement #28-764-1 will change the term of the performance contract to July 1, 2004 through June 30, 2008, and the amount of funds received by the County from the State will be increased $523,286 to a new total of$21,568,159. Three certified sealed copies of the Board Order should be returned to the Contracts and Grants Unit.
