SUBJECT: HEARING ON THE RECOMMENDATION OF THE COUNTY PLANNING COMMISSION
REGARDING A PROPOSED AMENDMENT TO THE RESIDENTIAL SECOND UNIT
ORDINANCE (CHAPTER 82-24) THAT WOULD ALLOW FOR THE ESTABLISHMENT OF
LARGER SECOND UNITS ON PARCELS OF FIVE ACRES OR MORE WITHIN
AGRICULTURAL ZONING DISTRICTS. (COUNTY FILE#ZT070001)(ALL DISTRICTS)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDATION
CONTINUE the public hearing for the proposed text amendment to 1:00 p.m. on April 1,
2008.
II. BACKGROUND
In September of 2007, the'Board directed the Community Development Department to
prepare an amendment to the Second Unit Ordinance to increase the allowable size of
second units located on a parcel of five acres or more and zoned for agricultural uses, as
well as to increase the size of an attached accessory structure. The proposed Ordinance
was scheduled for the March 181h hearing. Staff has received a request to continue the
item to the April 1't hearing.

RESIDENTIAL SECOND UNIT ORDINANCE WHICH WOULD ALLOW FOR THE
ESTABLISHMENT OF LARGER SECOND UNITS ON PARCELS OF 5-ACRES OR MORE
LOCATED WITHIN AGRICULTURAL ZONING DISTRICTS

NOTICE is hereby given.that on Tuesday, March 18, 2008 at 11:30 a.m. in the County
Administration Building, 651 Pine Street, Rooin 107 (Corner of Pine and Escobar Streets),
Martinez, California, the Contra Costa County Board of Supervisors will hold a public hearing to
consider the following matter:
Consider a recommendation by the County Planning Commission to:
a. Find that the proposed text modifications to County Code 82-24 relating to the
County's Residential Second Unit Ordinance are consistent with the General Plan as
described in County Planning Commission Resolution No. 9-2008.
b. Accept the determination by the Community Development Department that, per
section ,15305 of the California Environmental Quality Act (CEQA), the proposed
text amendment is a minor alteration in land use limitations and qualifies as a Class 5
categorical exemption:
c. Adopt the proposed text modifications to the County Code Chapter 82-24 relating to
the County's Residential Second Unit Ordinance.
The proposed ordinance will affect all unincorporated areas of Contra Costa County.
For purposes of compliance with the California Environmental Quality Act (CEQA), staff has
determined that, per section 15305 of the California Environmental Quality Act(CEQA),.the
proposed text amendment is a minor alteration in land use limitations and qualifies as a Class 5
categorical exemption.
If you challenge the project in court, you may be limited to raising only those issues you or
someone else raised at the public hearing described in this notice, or in written correspondence
delivered to the County at, or prior to, the public hearing.
Prior to the hearing, Community Development staff will be available on Tuesday, March 18, .
2008 at 11:15 in Room 105, Administration Building, 651 Pine Street, Martinez, CA, to meet
with any interested person in order to (1) answer questions; (2) review the hearing procedures
used by the Board; and (3) clarify the issues being considered by the Board. if you wish to attend
this meeting with staff, please call Ruben Hernandez, Community Development Department, at
(925) 335-1339 by 3:00 P.M. on Monday, to confini. your participation.
