Recommended Action: AUTHORIZE the Director of Airports, or designee, to NEGOTIATE long-term ground lease and development terms between the County, as Landlord, and Magnuson Aviation, LLC the party that has submitted an aviation development proposal for approximately 1.6 acres of land on the west side of the Byron Airport. II. FINANCIAL IMPACT: There is no negative impact on the General Fund.The Airport Enterprise Fund would realize lease and other revenues and the County General Fund could realize sales and property taxes and other revenues if a lease is successfully negotiated. REASONS FOR RECOMMENDATIONBACKGROUND: The proposed hangar development will be located on approximately 1.6 acres of land owned by the County and located on the southwesterly side of the Byron Airport(see attached map). The site is proximate to the Byron Airport runways,adjacent to other aviation uses and designated for aviation uses on the Byron Master Plan.The parcel is under the jurisdiction of the Byron Airport and entirely within the unincorporated County. In August 2007, the Contra Costa County Public Works—Airports Division received a letter of interest to develop the approximate 1.6 acres on the subject site.The proposed development concept includes executive hangars and an aircraft inspection hangar development on the 1.6 acres off Eagle Court and immediately west of the Airport office building. In accordance with prior discussions with the Federal Aviation Administration's (FAA) Airports District Office(ADO)regarding development at Byron Airport,the County notified existing commercial tenants at Buchanan Field and Byron Airport to solicit other competitive interest in the property. The development competitive solicitation process provided a response deadline of February 7,2008,for all competitive interests in the sites to be submitted to the County Airport Office. The County received no additional letters of interest in developing the subject properties. Negotiation of lease terms would expand economic development activity at the Byron Airport, provide additional revenues to the Airport Enterprise Fund, and allow Contra Costa County to expand aviation related business available at the airport.A business proposal must be consistent with the Airport Master Plan and General Plan for consideration. Review of the development under the California Environmental Quality Act will be undertaken concurrently with the negotiation of the development terms and ground lease. IV.
