SHIU, PUBLIC WORKS DIRECTOR Costa DATE: March 11, 2008 5 County SUBJECT: Modified Proposition 1 B expenditure plan for first appropriation, Countywide, (Proposition 1 B Funds) (All Districts) SPI:.-CIFIC REQUEST(S)OR RE.COMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE the modified Proposition l B expenditure plan for first appropriation of Proposition 1B Funds. FISCAL IMPACT: No impact to the General Fund. Contra Costa County is expected to receive approximately$24.5 million as part of Proposition 1 B to fund road improvement projects. The first allocation is approximately $9.7 million. REASONS FOR RECOMMENDATIONS AND BACKGROUND: In 2006, Governor Schwarzenegger signed a $37.3 billion package of bonds for highways, schools, levees and affordable housing. The package contained several components including Senate Bill 1266(SB 1266),the Highway Safety, Traffic Reduction, Air Quality and Port Security Bond Act of 2006. The act, approved by the voters as Proposition 1 B at the November 7, 2006 general election, authorizes the issuance of $19.9 billion of general obligation bonds to fund a variety of transportation priorities including reducing emissions and improving air quality in trade corridors, highway-railroad grade separation and crossing improvement roj7ecctts, state highway safety and CONTINUED ON ATTACHMENT: 0 SIGNATURE: Lam! In addition to Proposition 113, four other bond measures known as Proposition IA (Proposition 42 protection), Proposition 1C (housing), Proposition ID (education) and Proposition IE (levees and flood protection) were included on the ballot. Of the $19.9 billion, $2 billion is designated for cities and counties to fund the maintenance and improvement of local transportation facilities. The specific allocation for each agency is based on the number of registered vehicles and the number of miles of road. Based on that formula, Contra Costa County (unincorporated) is expected to receive $24.5 million over the life of the program. On October 10, 2006, in anticipation of the voters passing the package of bonds, the Public Works Department presented a plan to the Board of Supervisors for projects to be funded by the bond proceeds. The plan consisted of twelve projects throughout Contra Costa County that would benefit the users of the transportation system. This list was created based on several factors including public safety, preservation of the existing system, infrastructure eithancement, economic benefit development, community image and community interest. Availability of other finding, an ability to obtain additional funding, and project readiness were also considered. The 2007 Budget Act and Chapter 181, Statutes of 2007, Senate Bill 88 (SB88), includes the first installment of $950 million of the Proposition 1B funds for State fiscal year 2007-08 for cities and counties. Of this amount, Chapter 314, Statutes of 2007(AB 196), specified$550 million be allocated to cities and$400 million be allocated to counties. Based on the formula, Contra Costa County's share for fiscal year 2007-08 is $9.7million. "The program allows three subsequent fiscal years to expend the funds from the date that the funds are allocated by the State Controller,and any funds not expended within that period will be returned and reallocated to other cities or counties. The funds are to be used for improvements to transportation facilities that will assist in reducing local traffic congestion and further deterioration,improving traffic flows,or increasing traffic safety. In order to receive funds,counties and cities must submit a plan to the Department of Finance for use of the amount of funds available in fiscal year 2007-08. At the end of each fiscal year, new plans must be submitted for the use of any new Proposition 1 B funds provided in the most recent Budget Act.
