SUBJECT: APPROVAL TO SUBMIT APPLICATION AND EXECUTE GRANT AWARD WITH STATE
OFFICE OF EMERGENCY SERVICES FOR FUNDING OF THE VICTIM/WITNESS
ASSISTANCE PROGRAM FOR FISCAL YEAR 08/09
SPECIFIC REQUIEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
Approve and authorize the District Attorney to submit an application and execute a grant award agreement,and any
extensions or amendments thereof,.pursuant to State guidelines, with the State Office of Emergency Services for
funding of the Victim/Witness Assistance Program in the amount of$488,498 for the period July 1, 2008 through
June 30, 2009 (Federal/State Funds Budgeted-No Match).
FINANCIAL IMPACT:
The grant application will fund staff salaries and benefits to provide services to victims and witnesses ofcrimes.
The grant funds a victim/witness assistance program manager,four fulltime and one 20/40 victinl/witness assistance
program specialists and clerical support. As in all State Office of Emergency Services (OES) grants, the County
agrees to the following conditions: to provide all matching funds required for said project, (including any
amendment thereof)under the Program and the funding terms and conditions of OES, and that any cash match will
be appropriated as required;that any liability arising out of the performance of the grant award agreement,including
civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency; the
State of California and the OES disclaim responsibility of any such liability; and, that grant funds received frorn
OES shall not be used to Supplant expenditures controlled by the governing board. Expenditures and revenues for
this program are included in the District Attorney's 2008/09 proposed budget. There is no local march required by
this Program.

REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The State Office of Criminal Justice Planning/Office of Emergency Services has funded the Contra Costa's
Victim/Witness Assistance Center since'the early 1980's. In 1986,responsibility for the program was transferred via
Board of Supervisors resolution from the District Attorney to the County Probation Officer and the County
Probation Officer operated the program until 2004. On June 22, 2004, the Board of Supervisors designated the
District Attorney as the provider of comprehensive victim and witness services for Contra Costa County, effective
July 1, 2004. Fiscal Year 2008/09 is the fifth year that the District Attorney is applying for the State Office of
Emergency Services funds available to support the cost of the Contra Costa's Victim/Witness Assistance Program.
CONSEOUENCES OF NEGATIVE ACTION:
Failul'e to approve the recommendation will. result in the inability of the District Attorney to apply for the
Federal/State funds available through the OES to support victim/witness assistance services in Contra Costa County.
