Compliance with the CMP will ensure the County receives its allocation of state gas tax revenues under Section 2105 of the Street and Highways Code and will maintain its eligibility for other state and federal transportation revenues. The County receives approximately$4.9 million annually from this revenue source and dedicates this revenue for transportation purposes. BACKGROUND/REASONS FOR RECOMMENDATIONS The County biennially ,submits a compliance checklist `to the Contra Costa Transportation Authority (Authority) to. receive the County's portion of the 18 percent of sales tax funds available for local street maintenance and improvements under Measure C-1988. Two related actions must precede completion and submittal of the Checklist: 1. California' Environmental Quality Act (CEQA) review of the proposed 2008 Capital Improvement Program (CIP) for.Parks and Sheriff Facilities; and 2. Adoption of this CIP for Park and Sheriff Facilities. Consistent with CEQA provisions and adopted County CEQA Guidelines Department staff has found that the adoption of the CIP for Parks and Sheriff, Facilities is not subject to review under CEQA.(see Exhibit A). This activity is exempt under CEQA given the provision that CEQA only applies to activities that have the potential to cause significant adverse effects to the environment. All activities in the CIP are either fully committed, constructed, awaiting occupancy, or undergoing separate environmental review. Under,the provisions of Section 15061(b)3; of CEQA and County CEQA guidelines, it can be seen with certainty that there is no possibility that adoption of the CIP for Parks and Sheriff Facilities could have a significant effect on the environment. The CIP for Parks and Sheriff Facilities (see Exhibit B) was prepared as part of the County's Development Mitigation Program. The CIP is authorized by Implementation Measure 4-n of the County General Plan. Any capital projects sponsored by the County and necessary to maintain adopted levels of performance must be identified in a five=year CIP. Funding sources for the complete cost of the imp rove ments,"and phasing, if any, must also be identified in the CIP. The CIP demonstrates that development anticipated between 2008 and 2014 will maintain compliance with the performance standards for parks and sheriff facilities. Table 5 of the CIP shows no expansion or acquisition of sheriff facilities is proposed for the seven-year period for'patrol and investigation use.The existing"surplus".capacity is expected to be sufficient to accommodate population growth during this period. The Checklist covers actions and decisions taken by'the County during the 2006 and 2007 calendar years. The Checklist covers the following areas: — Complying with Action Plans for Regional Routes of Significance; Participating in the Regional Traffic Mitigation Program (RTMP); Providing Housing Options and Job opportunities; Complying with performance standards for transportation and other urban services; Participating in cooperative multi-jurisdictional planning; Maintaining a 5-Year Capital Improvement Program; - Implementing a Transportation System Management Ordinance; Meeting minimum.expenditures for street and road maintenance; and Posting signs for construction projects receiving more than $250,000 in.Measure C funds. Biennial Compliance Checklist and CIP for Measure C-1998 February 12, 2008 Page 3 BACKGROUND/REASONS FOR RECOMMENDATIONS (Continued) The County has satisfied all Checklist requirements during 2006 and 2007 calendar years. All traffic level of service.standards and performance standards for other urban services in the unincorporated area were maintained. The County implemented all the required plans, programs and ordinances for mitigating local and regional transportation impacts of development projects, providing housing and job opportunities, and constructing the necessary capital improvements for urban services. County road projects and expenditures have met the Measure C-1988 requirements. The Board of Supervisors has participated in or taken actions during the year consistent with the multi-jurisdictional transportation planning process established by Measure C-1988. The Contra Costa Transportation Improvement and Growth Management Program identifies standards for the development of parks relative to population growth. As documented in the Capital Improvement Program for Park and Sheriff's Facilities, there exists a limited surplus (1 acre) to ensure consistency with these adopted standards in the timeframe of the Program (2008-2014). Because of this limited surplus, Community Development Department and Public Works Department staff will examine the Program and projects within in greater detail to ensure County compliance with adopted standards. Staff will report to the Transportation, Water and Infrastructure Committee before the end of the year on the status of this examination. In 2007 the Contra Costa Transportation Authority amended the CMP to eliminate the separate checklist requirement and rely on the Measure C checklist to determine a local agencies conformance with the Land Use evaluation component of the CMP (RECOMMENDATION: #3). In addition, the policies and programs of Contra Costa County ensure conformance with the CMP in regards to several additional measures, consistency with level-of-service standards, implementation of a land use impact analysis program and implementation of a deficiency plan in the event level-of-service standards are not maintained. CONSEQUENCES OF NEGATIVE ACTION Failure to adopt the CIP for Parks and Sheriff Facilities and/or approve the Checklist will prevent the County for qualifying for its Fiscal Year allocations for 2007/2008 of"return to source"funds. Funds will be available for allocation beginning July 1, 2008. Failure to establish compliance with the Congestion Management Program (CMP)will cause the County to be out of compliance with the Congestion Management Statute, cause the State to withhold the County's allocation of gas tax revenues under Section 2105 of the Streets and Highways Code, lead to a reduction in road maintenance projects in unincorporated areas. INRODUCTION This document is Contra Costa County's Capital Improvement Program (CIP) for providing park and Sheriff Facilities in the unincorporated area of the County. A companion document, the County Road Improvement&Preservation Progam, describes transportation projects to mitigate the transportation impacts of n;xv development. Both documents respond to the requirements of the Contra Costa Transporttation Authority's (CCTA)Biennial Compliance Checklist, which is used to measure how.well individual jurisdictions are complying with the requirements of the growth management program of Measure C-88. The Measure C-88 growth management program requires local jurisdictions to develop a five- year capital improvement program to meet and maintain adopted performance standards.. It is CCTA policy that all capital improver ent programs be amended, taking into account changes in project costs, funding sources,project development and timing. Jurisdictions can avoid annual updates by developing longer range capital improvement programs. The County has elected to use a seven-year horizon for the CIP. CONTENTS OF THIS DOCUMENT: The CIP is based on a seven-year horizon, 2008-2014, growth estimates for that time period are presented in Section II. Section III of the CIP reviews the performance standards, which were established by the Growth Management Element of the Contra Costa County General Plan, and describes the status of County's compliance with these standards based on the estimated population growth. Section IV describes the program facilities needed to meet the demands of future growth as dictated by the performance standards set forth in the Growth Management Element. II. POPULATION ESTIMATES Table 1 provides an estimate of past population growth in the unincorporated area since adoption . of the County's Grotinth Management Element in 1991. It also describes projected population growth for the seven-year period of the CIP, 2008-2014. GROWTH MANAGEMENT PERFORMANCE STANDARDS The Gronvth Management Element establishes standards for the provision of certain public services in the unincorpo:�ed ar-eas. These performance standards are applied to all development that was approved since the adoption of the County General Plan in January 1991. The standards apply to the entire unincorporated area, countywide. Park Facilities: The growth management standard for park facilities is three acres of neighborhood parks per 1,000 population. Table 2 evaluates this standard as of.2007. This' _ evaluation is based on population growth for the 1991 - 2007 time period and the park acreage opened during that period. Since January 1991,the County has opened approximately 116 acres of new park facilities that meet the neighborhood park classification. Actual park construction exceeded the growth management standard by 28 acres. These facilities represent a broad range of accomplishments, including contribution to joint school/park facilities, pro-rated credit for park facilities of cities or special districts funded partially by County revenues or land-dedication, and linear parks that serve the local area. See Appendix A for a description of these park facilities. TABLE 2 EVALUATION OF COMPLIANCE WITH THE PARK FACILITIES STANDARD AS OF 2007 REQUIRED FACILITIES FACILITIES OPENED SURPLUS/(DEFICIT) 88 acres 116 acres 28 acres Sheriff Facilities: The growth management standard for Sheriff facilities is 155 square feet of patrol and investigation facilities per 1,000 population. Table 3 evaluates compliance with the performance standard as of 2007. The evaluation is based on population growth for 1991-2007 time period and the square footage of Sheriff Facilities opened as of 2007. The population growth between 1991 and 2007 created a demand for 4,536 square feet of patrol. investigation and support facilities. Since 1991, the County has opened 21,039 square feet of facilities that serve patrol, investigation and support activities. Actual Sheriff Facility construction exceeded the growth management standard by 16,503 square feet. See Appendix B for the inventory of Sheriff Facilities. SEVEN-YEAR PROGRAM FOR PARK AND SHERIFF FACILITIES The 1Vleasure C-88 growth management program requires that capital improvement programs include approved projects, their estimated costs and a financial plan for providing the improvements. This section describes a seven-year program of projects to maintain compliance with the County's adopted growthmanagement standards for park and Sheriff Facilities. Park Facilities: The projected growth during the 2008-2014 time period will generate the need for 26 acres of neighborhood and community parks. Table 4 describes the park facilities programmed for construction during the 2008 to 2014 time period. Nearly 55 acres of neighborhood parks are programmed for construction. By adding the acreage from Table 4 to the current "surplus" of 28 acres, programmed park construction will exceed the performance standard by approximately 1 acre based on the growth projected to occur in the unincorporated area by 2014. The formula utilized to evaluate this need for facilities in 2012 is detailed in Table 5. The limited park facility surplus identified in this document will be examined by staff in 2008. A report will be provided to the Board of Supervisors with recommendations on actions to address the limited surplus. Parks are financed largely by park dedication fees assessed against new development in the unincorporated area. A Park Impact Fee Nexus Study was approved by the Board in 2007 and fees were updated shortly thereafter. Fees range from $1,969 to $7,238 depending on dwelling type and location. Unless otherwise indicated, the parks shown on Table 4 occur on County- owned parcels or land dedicated by developers to the County. Expenditures are for park improvements only. 4 Sheriff Facilities: The projected growth during the 2008-2014 time period will generate the need for 1,360 square feet of Sheriff facilities to serve patrol and investigation activities. The surplus square footage resulting from Sheriff facilities opened as of 2007 is 16,503 sq. ft. This "surplus" of facility capacity is sufficient to serve all growth projected to occur in the unincorporated area by 2014, with approximately 15,143 sq. feet of capacity remaining by that time. The formula utilized to evaluate this need for facilities in 2014 is detailed in Table 5. No construction or acquisition of additional sheriff facilities is programmed for the next seven years. Existing capacity is expected to be more than sufficient to accommodate population growth for the next seven years. Fees are currently in place for new development in the unincorporated area to provide ongoing support for Sheriff operations. The fees do not cover additional facilities that may be needed in the future Since 1991, a significant inventory of space for patrol and investigation activities has been made available on a short-term basis to the Sheriff through donations or leases. These facilities total 2,660 square feet and are listed in Appendix C. The Sheriff recommends that this space not be claimed by the Board-for the purpose of meeting the growth management standard for Sheriff Facilities. As you are aware, this Department is required to review adopted housing elements and report our findings to the locality pursuant to Government Code Section 65585(h). Telephone conversations with Ms. Kara Douglas, Mr. Patrick Roche, and Ms. VeronJca Tata,the County's consultant,facilitated our review. Contra Costa County's adopted element adequately addresses all of the statutory requirements described in our October 19, 2001 review. Therefore, the element is in compliance with State housing element law (Article 10.6 of the Government Code). Compliance is conditioned on the County's implementation of Program 19 to rezone at least 10 acres to,M29 zoning to facilitate lower-income housing development by 2003. We understand the County is in the process of rezoning a number of parcels(amounting to approximately six acres)neat-the Pittsburg-Bay Point BART station to allow densities of 40 du/acre. This proposed re-zoning would clearly meet a portion of the need addressed in Program 19. We commend the.County for its housing programs and detailed site analysis. The County has and continues to effectively use a variety of financial and regulatory incentives to encourage lower- income housing development. Additionally,we recognize the County's successful efforts to work with non- and for-profit developers to increase the supply of housing affordable to low- and moderate-income households. '§'bile the County does not need the sites in Dougherty Valley to identify adequate sites, we recognize the commendable efforts the County has undertaken to facilitate housing development affordable to lower-income households. Through the County's negotiated development agreements, 1,377 units will be affordable to lower-income households. The County's leadership ensured that the needs of lour- and noderate-income households were addressed in this planning area. Mr.Sweeten,County Adtn.., ',trator Page 2 However as you know,when allocating housing need to the County and cities within the County, ABAG considered the agreement between the City and County and determined that any growth" associated with this planning area would be attributed to the City. The housing needs allocation was clarified in a February 22, 2000 memo from Mr. Alex Amoroso,of ABAG. The County's housing needs contact was also forwarded a copy of this memo. As a result, mots built on sites annexed to the City of San Ramon will be credited to the City.
