FISCAL IMPACT: No impact from accepting this report. BACKGROUND: The Family and Human Services Committee reviewed the attached report updating the Board of Supervisors on the progress made with implementation of the County's Secondhand Smoke Ordinance. On November 17, 2006 a new ordinance to reduce secondhand smoke exposure among residents and workers in all unincorporated community of Contra Costa County took effect. The attached report provides an update on the outreach conducted with businesses to date and upcoming outreach to landlords, education efforts and other implementation activities that will be completed this year. The Board of Supervisors also directed staff to develop an outreach and education plan for businesses and landlords regarding the ordinance, to be implemented after adoption of the ordinance in October, 2007. Outreach Conducted to Businesses A. Conducted independent interviews with restaurant owners and the CA Restaurant Association to determine methods to communicate the provisions of the new ordinance, signage options for businesses, and information to be included in educational pamphlet. B. Developed an education pamphlet on the new ordinance along with a "No Smoking"window decal, available in mid-May. C. Explored signage options for business owners and developed downloadable signage in English and Spanish. D. Worked with the County Business License Office to include a letter from the Public Health Director, the education pamphlet and decal in the annual business license package (Mailer expected to be sent by end of May, 2007). E. Television public service cable presentation to educate the community on the new ordinance is scheduled for summer programming. F. Contra Costa Health Services and Business License Office websites are both expected to be updated by end of May to include specific information on the provisions of the new ordinance that affect businesses, as well as the community at large. The signage options and education pamphlet will also be accessible to businesses and the general public on these websites. G. Facilitated two press releases related to the new ordinance: one on the Regional Medical Center and Health Centers going Smoke Free (November 2006); and one awards given to the Board of Supervisors for protecting public from Secondhand Smoke (December 2006). Upcoming Outreach to Landlords (To be completed by October 2007) A. Consult with the Northern California Landlords Association to determine methods of communication to landlords. B. Develop an educational pamphlet for landlords on the MUH provision of the new law. C. Get feedback from the Northern California Landlords Association on the draft educational pamphlet. D. Work with County Building Inspection Department to secure mailing list for all landlords in the unincorporated county and mail educational material. E. Investigate feasibility of television programming on cable to educate the community on the multiunit housing provision of the ordinance. F. Provide technical assistance to landlords as requested and as resources allow on issues of implementation. G. Send out press releases on ordinance benchmarks, as appropriate. Community Education A. In addition to the website updates, a 1-800 complaint line for reporting violations (888-877-4202) has been installed. B. Developed secondhand smoke complaint follow-up protocol. Additional Implementation Activities (To be completed by December, 2007): A. Work with County Environmental Health Department to coordinate compliance inspections of businesses in the unincorporated county. B. Consult with managing agencies of public parks and trails (Le*. Contra Costa Public Works Department and Contra Costa County Canal Regional Trail agency) to provide technical assistance on installation of signage and communication with park and trail users and staff for compliance efforts. C. Present information to the various transit authorities (Tri-Delta, WestCAT and County Connections) regarding the applicable provision of the Secondhand Smoke Protection ordinance. Consult with each Transit authority or assigned staff to provide technical assistance on methods of communicating the appropriate provisions of the Secondhand Smoke Protection Ordinance. D. Communication with Contra Costa Housing Authority staff about provisions of the ordinance and signage requirements for properties in the unincorporated county. (Service area means an area used to receive or wait for a service, enter a public place or make a transaction, including ATM's,bank teller windows,ticket lines, bus stops and taxi stands) • hi public event venues(such as stadiums,fairs,pavilions,farmers markets) • On the campus of Contra Costa Regional Medical Center and all county-operated healthcare clinics. In Multi-Unit Housing Residences,smoking is prohibited: • In common indoor and outdoor areas of multi-unit housing residences of 4 or more unit • All areas within 20 feet of doors,windows, air ducts and ventilation systems of multi-unit housing residences,except while walking from one destination to another. • While walking from one destination to another through a common area. Landlords may designate a common outdoor area of a multi-unit housing residence as a smoking area,as long as it does not overlap with any area where smoking is otherwise prohibited by local, state or federal law; must be located at least 25 feet in all directions from non-smoking areas; and must not include areas used primarily by children. This ordinance expands secondhand smoke protections to prohibit smoking within 20 feet of doors, operable windows, air ducts, and ventilation systems of any enclosed place of employment or enclosed places open to the public. Outdoor dining areas, restaurants, and outdoor lounges and dining areas at places of employment are also designated smoke-free. The ordinance prohibits smoking in public parks and on public trails; in service areas (such as ATM lines, tickets lines, and bus stops); at public events; and in common indoor and outdoor areas of multi-unit housing. The law applies to these locales in the unincorporated communities of the county. This law was passed based on scientific studies from CAL-EPA (California Environmental Protection Agency, 2006) and the Surgeon General's Report (July 2006) that clearly show that secondhand smoke is a health risk. The enclosed information packet provides with information necessary to comply with the law. All areas that must be smoke-free are detailed in the enclosed informational brochure. ** Posting signage is a requirement for comuliance by the law ** The following tips may make the compliance easier for you, your employees, or your customers: ■ Review and provide copies of the brochure to your employees, customers, clients, and visitors. Persons requesting additional information may be referred to our website: www.cchealth.org/topics/tobacco or call 888-877-4202. ■ Since smokers tend to smoke near ashtrays, place these at least 20 feet away from any doors, windows, vents, or air ducts. Research shows that 80% of all smokers would like to quit and that smoke-free public places provide a more supportive environment. Information about cessation programs (to quit smoking) are available by calling the California Smoker's Helpline at 1-800-NO- BUTTS or www.californiasmokershelpline.org We look forward to working with you to comply with this new law by creating a healthy smoke-free environment.
