III. BACKGROUND/REASONS FOR RECOMMENDATION
In 2002, the owner (Massoud Fanaieyan) filed with the County a rezoning
application (County File #RZ033125) to rezone a portion of APN 177-140-001 from
R-20 (Single Family Residential, 20,000 square feet required) to R-15 (Single
Family Residential, 15,000 square feet required) and a subdivision application
(SD028694) to subdivide a 2.42-acre parcel into five lots. The County Planning
Commission heard the matter on July 8, 2003. Commissioners Mehlman and .
Terrell expressed their concern regarding the steepness of the site and its
appropriateness for five lots rather than four lots which would have been allowed
under the existing zoning. The Commission, after evaluating the proposal and the
evidence submitted, voted to recommend approval of the proposed rezoning to the
Board of Supervisors. The County Planning Commission's approval of the vesting
tentative map for five lots was contingent upon the Board's approval of the
rezoning.
On September 9, 2003, the Board of Supervisors heard the applicant's request to
rezone a portion of proposed Lot 1. The Board ultimately denied the rezoning
thereby allowing four lots on the site.
IV. REQUEST FOR TIME EXTENSION
In a letter dated February 15, 2007, the property owner Massoud Fanaieyan
requested a three-year extension of the period for filing a parcel map. The
applicant has been working diligently with the Public Works Department, the
Contra Costa County Fire Protection District and the East Bay Municipal Utility
District to complete the conditions of approval. The applicant is requesting an
extension of time to fulfill all the requirements.
V. DISCUSSION
Government Code Section 66452.6(e) of the Subdivision Map Act allows a
subdivider to apply to the County for extending the period for filing the map for up
to five additional years beyond the initial period allowed by ordinance. Staff sees
no reason why the subject request should not be granted.

We like to request an extension to our application that was approved in March 2004. We have been
diligently working with Public Works and Community Development Department of Contra Costa County
to complete their requirements to record this subdivision. We have faced challenges that for the most part
we have been able to resolve. However there are two more Public Works requirements that we are working
on to finalize.We are expecting to complete the required documents within the next 30 to 60 days.
A$600 check as an extension fee is attached.
