RECOMMENDATIONS:
ADOPT Ordinance No. 2007-22, which would prohibit waterskiing on a portion of Indian Slough and on a
portion of Werner Dredger Cut near Discovery Bay during weekends and specified holidays from April l
through September 30.
FISCAL IMPACT
If the ordinance is adopted, enforcement costs will depend on the number of ordinance violations.
BACKGROUND / REASONS FOR RECOMMENDATIONS
Ordinance No. 2007-22 would prohibit waterskiing, and all other activities where a person is towed behind
or alongside any type vessel, on the portion of Indian Slough between the Discovery Bay Marina Channel
and the intersection of Werner Dredger Cut and Kellogg Creek, and on the portion of Werner Dredger Cut
between the Orwood Road bridge and the intersection of Indian Slough and Kellogg Creek. These
waterways are located adjacent to and north of Discovery Bay. This prohibition would be in effect every
Saturday and Sunday from April 1 through September 30, and every Memorial Day, July 4th, and Labor Day.
The purpose of the ordinance is to address a serious safety problem along the waterways affected by the
ordinance. These waterways have multiple blind turns. It is difficult for vessel operators to navigate these
blind turns and also avoid boats towing waterskiers who sto ircl back to retrieve downed waterskiiers.
There have been several major injury accidents involving aters iers d personal watercraft along these
waterways in recent years. These waterways have also b en t gh some fatal accidents.

Background (continued):
The state Harbors and Navigation Code authorizes the County to adopt regulations that prohibit waterskiing in
portions of County waterways. Harbors and Navigation Code section 268 authorizes counties to "adopt
restrictions concerning the navigation and operation of vessels and water skis, aquaplanes, or similar devices
subject to the provisions of subdivision (a) of Section 660, "and extends this authority to all navigable
waterways. Harbors and Navigation Code section 660(a)authorizes counties to adopt ordinances that pertain to
special-use areas. A "special-use area" is "all or a portion of a waterway that is set aside for specified uses or
activities to the exclusion of other incompatible uses or activities." (Harb. &Nay. Code 651 (v).) "Water skis,
an aquaplane, or a similar device" includes "all forms of water skiing, barefoot skiing, skiing on skim boards,
knee boards, or other contrivances, parasailing, ski kiting, or any activity where a person is towed behind or
alongside a boat." (Harb. &Nay. Code 651 (bb).) The courts have upheld the authority of a county to establish
a special use area in a waterway where certain types of watercraft are excluded from the area. (Personal
Matercraft. Coalition v. Nfarin County Bd. of Supervisors(2002) 100 Cal.App.41h 129.) Harbors and Navigation
Code section 660(a) also authorizes counties to adopt ordinances that pertain to time-of-day restrictions.
If the ordinance is adopted by the Board of Supervisors, the Contra Costa County Sheriff's Department and
Marine Patrol will be authorized to enforce it. (C.C.C. Ord. Code, 410-2.012.) The attached ordinance
would authorize the sheriff to place regulatory markers indicating the no ski zone at the boundaries of the
special use areas. (14 CCR, 7003.)
A version of this ordinance was first introduced on May 15, 2007. Following introduction, Supervisor Piepho
proposed moving the date of adoption from May 22 to June 5, 2007 to allow two weeks for additional
community outreach.
The Town of Discovery Bay CSD held a Community Forum on May 30, 2007. The forum attracted
approximately 300 residents and non-residents of Discovery Bay. Many in attendance expressed very strong
views on how the proposed ordinance would affect them and their enjoyment of the sloughs. At the
conclusion of the Community Forum, the Town of Discovery Bay CSD voted to request an amendment to
the initial version of Ordinance No. 2007-22. The CSD recommended that the boundaries of the special use
area be as follows: the portion of Indian Slough between the Discovery Bay Marina Channel on the east and
the intersection of Werner Dredger Cut and Kellogg Creek on the west; and the portion of Werner Dredger
Cut between the Orwood Road bridge on the north and the intersection of Indian Slough and Kellogg Creek
on the south.
On June 5, 2007, the Board of Supervisors held another public hearing on Ordinance No. 2007-22.
Following the public hearing, the Board modified the initial version of the ordinance and introduced
Ordinance No. 2007-22. The ordinance, as introduced on June 5, would prohibit waterskiing, and all other
activities where a person is towed behind or alongside any type vessel, on the portion of Indian Slough
between the Discovery Bay Marina Channel on the east and the intersection of Werner Dredger Cut and
Kellogg Creek on the west, and on the portion of Werner Dredger Cut between the Orwood Road bridge on
the north and the intersection of Indian Slough and Kellogg Creek on the south. The prohibition would be in
effect every Saturday and Sunday from April 1 through September 30, and every Memorial Day, July 4`h,
and Labor Day.
The California Department of Boating and Waterways has advised the County that the attached ordinance
conforms to the special use area provisions of Harbors and Navigation Code section 660 and that the County
is authorized to adopt restrictions that are in effect only during specified days and months.
ORDINANCE NO. 2007-22
WATERSKIING PROHIBITION
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical
footnotes from the official text of the enacted or amended provisions of the County Ordinance'
Code):
SECTION I. SUMMARY. This ordinance prohibits waterskiing, and all other activities
where a person is towed behind or alongside any type of vessel, on the portion of Indian Slough
between the Discovery Bay Marina Channel and the intersection of Werner Dredger Cut and
Kellogg Creek, and on the portion of Werner Dredger Cut between the Orwood Road bridge and
the intersection of Indian Slough and Kellogg Creek, near Discovery Bay. This prohibition is in
effect every Saturday and Sunday from April 1 through September 30, and every Memorial Day,
July 4`h, and Labor Day.
SECTION H. Section 410-6.022 is added to the County Ordinance Code, to read:
410-6.022 Waterskiing prohibited.
(a) No person shall operate any vessel that is pulling or towing water skis, an aquaplane, or a
similar device, nor shall any person ride water skis, an aquaplane, or a similar device, in
any of the special use areas designated in subsection (b) of this section. This prohibition
is in effect every Saturday and Sunday from April I through September 30, and every
Memorial Day, July 4`h, and Labor Day.
(b) The following waterways are designated as special.use areas:
(1) That portion of Indian Slough between the Discovery Bay Marina Channel on the
east and the intersection of Werner Dredger Cut and Kellogg Creek on the west.
(2) That portion of Werner Dredger Cut between the Orwood Road bridge on the
north and the intersection of Indian Slough and Kellogg Creek on the south.
(c) The sheriff is authorized to place regulatory markers giving notice of the restrictions .
specified in subsection (a) at the boundaries of the special use areas designated in
subsection(b). (Ord. 2007-22 § 2.)

On this day, the Board of Supervisors considered adopting Ordinance No. 2007-22, which would
prohibit waterskiing on a portion of Indian Slough and on a portion of Werner Dredger Cut near
Discovery Bay during weekends and specified holidays from April 1 through September 30.
Supervisor Piepho introduced the item and asked County Counsel if there would be any liability
if the Board acknowledged that unsafe conditions exist but did not take action today.
Silvano Marchesi, County Counsel, said he did not believe there would be any liability.
Supervisor Piepho said she feels the current language of the ordinance meets the needs of the
community and the area and said there needs to be a balance of recreation and lifestyle and
safety. She noted the proposed ordinance has been changed from a 365 days a year ban to a ban
during peak times of year on weekends, and further noted the proposed ordinance has been
changed to reduce the affected area. But, she said, concerns linger from the experienced
waterskiers in the area, and so she asked the Board to re-introduce the ordinance with new
language that would change the range of prohibited dates to weekends and holidays, Memorial
Day through Labor Day.
Supervisor Bonilla said she supports the proposed compromise in light of the Sheriff's June 5
comments about what makes for the most enforceable laws.
Supervisor Glover said he appreciates the steps taken to work with the community. He noted that
returning to the Board for a review is going to be very important, and said he supports the
proposed compromise.
Supervisor Gioia said he also supports the proposed compromise. He noted previous suggestions
that the prohibition should begin at 10:00 a.m. on the effective days, but said he thought that
would make the law too difficult to enforce.
The Chair called for public comment and the following people spoke:
Bob Doran, Discovery Bay Community Service District, spoke in support of the
ordinance and said the Board should listen to the local agencies. He said the elected
officials of Discovery Bay have a responsibility to present this request to the Board.
Patty Knight, Discovery Bay Community Service District, said the ordinance is the right
thing to do for safety.
Scott Pellaton, Brentwood resident, said he thinks it has been misstated that this is a
dangerous area. He said he is curious as to how the ordinance's effectiveness will be
determined as there are currently no statistics to show the dangers to waterskiers.
Supervisor Gioia responded, saying he hopes the Board does not have to wait for a statistic to
take action. He said all involved seem to agree that it is a busy waterway and that it is a
dangerous, crowded area. He commented generally that the Board is criticized if they do not take

action and then there is a death, and they also get criticized for over-regulating when they take a
preventive action.
Jeff Barber, Discovery Bay resident, said that the majority of the accidents involve
personal watercraft. He said signs warning to keep a safe speed and distance could be
more effective than any law. He said the additional morning hours being sought are
critical to local waterskiers.
Michael Jollet, San Ramon resident, cited waterway hazards and spoke about the death of
a friend. He commended the Board for taking action and spoke of his boating experience
to say he does not feel safe boating with his family on the Delta on weekends.
Supervisor Piepho asked Mr. Jollet what the conditions were like on the Delta last Saturday.
Mr. Jollet responded that he saw people loading little kids into inner tubes to tow them
and it made him wonder, What were they thinking? But, he said, they were probably so
excited to be out there, and maybe they had a new boat. Speaking about the audience, he
noted, "It's not the people in this room we're trying to protect, but those who are naive."
Todd Scruggs, Discovery Bay resident, suggested there was a pre-biased opinion of the
Board to pass this ordinance. He supported the desire to leave the mornings available to
skiers.
Scott Rister, Discovery Bay resident, said he appreciates the compromises being made
but added much could be gained from adding signage to the busiest areas of the Delta.
Jim Schafer, Byron resident, spoke in opposition to the ordinance. [Written comments

Rick Palmer spoke to support excluding mornings from the ban.
Michael Temby, Discovery Bay resident, suggested the ban begin at a later time of day to
allow mornings for skiers. He said the law could later be amended if needed, but noted it
is hard to get a bad law off the books once it is in effect.
Rob de la Cruz, Discovery Bay resident, said he is amazed that Board members have not
come to Discovery Bay to see the conditions for themselves.
Jennifer Nixon, Discovery Bay resident, spoke in support of the ordinance and said
public safety is the number one issue.
Dave Kroske, Past President of the Bay Area Waterski Club, spoke against the ordinance.
Frank Middleton, Discovery Bay resident, said that people not obeying existing laws and
not staying to the right are the main causes of accidents. He said he supports changing the
effective times of day from 24 hours to 10:00 a.m. to sunset.

Supervisor Piepho commented that when consulted, both a judge and the Sheriff said that hourly
restrictions are difficult to enforce.
Kristen Hamstra, Mothers of Discovery Bay Club, spoke in opposition to the ordinance.
She said her family moved to Discovery Bay to be on the water. She said she supports
changing the effective times of day from 24 hours to 10:00 a.m. to sunset. [Written

Eric Boltz, Discovery Bay resident, said he agreed with those requesting a 10:00 a.m.
start to the ban.
The Chair returned the matter to the Board.
Supervisor Glover said that public comments have already brought quite a bit of change to the
proposed ordinance. He stressed its importance as a preventive measure and said he would hope
that putting signage in place as soon as possible would be included in the motion.
Supervisor Bonilla noted there have been several suggestions regarding signage. She said the
Sheriff estimates the cost for signs to be at $1,200, and said she would suggest the Sheriff look at
other places on the Delta where signs could be beneficial for public safety.
Supervisor Piepho said that safety drives this issue and said she would not want to wait until
there is a statistic of a death to begin this preventive measure. She said that conditions on the
Delta are not the same as they were even five years ago and that they will continue to change.
Supervisor Bonilla suggested community involvement to pursue traffic calming measures on the
Delta.
By a unanimous vote with Supervisor Uilkema absent, the Board of Supervisors took the
following action:
AMENDED and RE-INTRODUCED Ordinance No. 2007-22, which would prohibit waterskiing
on a portion of Indian Slough and on a portion of Werner Dredger Cut near Discovery Bay,
effective 24 hours a day on Saturdays and Sundays and on the July 4 holiday, beginning on the
Saturday of the Memorial Day weekend through the end of Labor Day; FIXED June 26, 2007 for
adoption; DIRECTED implementation of a swift educational process and appropriate signage for
the area, for which the Sheriff's office should work with the Public Works Department and
Reclamation District 800 upon adoption of the ordinance; and REQUESTED ongoing
discussions about Delta safety with local stakeholders and all other interested parties.

Indian Slough
Members of the Board ...
My name is Jim Schafer. I have lived on Indian Slough for 20 years. I have been skiing
on Indian Slough since the early 60's. I still can remember climbing over the levee on the
south edge of Indian Slough and wondering what the heck those bull dozers were doing
digging that big hole on the other side. They were digging Discovery Bay. That hole is
now Lido Bay.
I apologize in advance for my sarcasm ...
I, like most of us here, am totally mystified by the events that transpired in this room last
week. While 1 totally abhor the adoption of needless controls and unenforceable laws, I
did find myself being drawn in to the acceptance of the proposal that was laid out by the
Sheriff. Had that proposal gone through, I might even have added to the applause that I'm
sure would have accompanied such a decision. But, such a decision was not made.
Instead, you, the members of the Board, driven, in your own words, by simplicity, opted
to choose the period of April through September over the more common summer
boundaries of Memorial Day and Labor Day. You struck down the idea of a time
boundary as being too complicated, even though such hourly limits are imposed on nearly
every freeway in the county. You expressed concern over the difference between 9:55
and 10:15, when really the difference should be expressed in terms of a busy sough or an
empty slough. Instead of trusting your Sheriff to know that difference, you ask him to be
on that slough at the crack of dawn to make sure that no one violates your law. By the
way, this is what the Sheriff was referring to when he used terms such as "enforceable"
and"support of the community".
Enough of that, I'm sure you've heard it and if it hasn't sunk in yet it probably never will.
I'd rather talk about Indian Slough and skiers.

First, from a skier's perspective you are violating sacred ground. You intend to prohibit
early risers from taking advantage of the glassy water that exists on Indian Slough nearly
every morning in the year, including weekends. Granted, there is very little difference in
time between starting your skiing at the entrance of Lido Bay to that of starting at the
Marina boundary. The psychological difference, however, is tremendous. Idling out onto
glassy water, with Mount Diablo as a backdrop, is the perfect way to start a day, a perfect
way to forget about the hustle and bustle of work. Instead, if the ban currently being
proposed is accepted, the experience of idling out onto that slough, which will still be
glassy, will no doubt be a weekly reminder of how little the leaders of Contra Costa
County respect the area they control and the people they are supposed to represent.
Now, from a fisherman's perspective, skier's are, in general, a nuisance. Any action to
close off a section of water from skiers would be a plus. Not having to worry about
potential skiers in the water of Indian Slough would allow me, Joe Fisher, to make sure
that my boat is in perfect running order and still capable of hitting 60 MPH before I get
too far from home. I approve the ban, in fact skiers should be banned from the Delta
completely.
From an off-shore boater's perspective, again, skiers are a nuisance. My boat is so big
that if I get too close to a small boat I can't even see it, let alone any skier that may be in
the water. True, if the ban goes through I will still have to exercise caution in the rest of
the Delta, but I won't have to worry about being careful in Indian Slough. There wdn't be
any skiers. I'm all for the ban.
Now, how about the yachts,the really big boats. Skiers? Yep, you guessed it, a nuisance.
Skiers on Indian Slough are especially annoying. Do you know how much gas it takes to
get my boat on plane?Naturally if there are skiers on Indian Slough I'll hold off on the
throttle until the coast is clear. I don't want to be wasteful. But skiers are tricky. You
never know when they might fall. Heck, on most days there won't be a skier in sight and
I'll have my boat up on plane by the time I get to the entrance at Lido Bay. But then there
are those days when a skier will round the bend ahead of me and fall. I really should stop
... but I'm on plane ... okay I'll stop. Once I get away from Indian Slough I normally
stick to the larger channels. I can continue on plane for miles, saving gas and getting to
my destination quickly. Please get rid of those pesky skiers on Indian Slough. It will save
me time and money.
Safety? Did you hear anything about safety? Hurry here, hurry there, don't want to stop.
Being safe to most of these other groups means a sacrifice on their part. A sacrifice
they'd rather not have to make.
The Delta is a resource to be shared by all groups. Please do not pass ANY sort of ban on
water skiing.

p.s. Congestion and the perception of danger? Congestion is a relatively common
occurrence in boating, whether on a lake or in the Delta or anywhere. Naturally you try to
avoid it, but it happens. You slow down, exercise caution and move to a different area.
Having congestion at Discovery Bay's doorstep is a good reminder to everyone that
congestion happens. Removing that local congestion would actually serve to lessen the
caution that should be present during busy times.
As a past president of the Mothers Of Discovery Bay Club, I have been appointed to issue this
statement to you:
As mothers we want nothing but the best for our children and would not intentionally put them in
harms way. Through email and phone campaigns over the past few days, it is clear that the vast
majority of Moms in our club support the Sheriffs proposal to allow towing along the waters in
question on Weekends before 10 am between Memorial Weekend and Labor Day.
We moved to Discovery Bay to be on and in the water. The proposed ordinance is unnecessary
at best. The newly worded proposed ordinance still limits our quality of life and property values.
We urge you to start with a 10am to sunset restriction on weekends ONLY between Memorial and
Labor Day weekends. By starting with a smaller restriction, you will be recognizing the outcry of
your constituents, and still satisfy your desire to pass an ordinance regarding safety.
My personal views:
Please don't change our quality of life on Indian Slough. Please don't start the down the road to
lowering our property values. Please reword the existing proposed water ski ban ordinance to
that suggested by the very enforcement agency you are meant to support, the Sheriffs
Department.
Quality of Life: My family is not unique in that my husband works in the bay area. However, we
do live on Indian slough between the two entrances to fast water at Lido Bay and the Marina
outlet. We wake up every morning, get coffee for us and chocolate milk for our children, and sit
at the breakfast table and watch the early morning wake boarders and water skiers getting their
first runs in. We are all excited for the day that our boys will be old enough to get out there and
ski, but for now we just watch and enjoy. My husband does not get to watch during the week as
he is in the Bay Area all week. His only days to enjoy the water are the weekends. Still, we enjoy
watching our friends ski by and jump the wake for us.
A few years back I had friends visiting; The husband was eager to learn how to wake board, but
the wife was pregnant and not allowed to go out on the boat. We were able to teach him to get
up, and then pull him along Indian Slough so she could watch him from our deck. I thought this
was a unique situation until last Tuesday's Supervisors meeting when a gentleman said his aging
parents got to see their grandson get up on skis on Indian Slough from the view of his deck.
When I was pregnant with my second son and keeping an eye on the first born, I also enjoyed
watching my husband ski Indian Slough from the view of our deck. Please allow us just a few
hours in the morning on weekends when the water is not freezing to enjoy our way of life!
Property Values: The view is precisely why we bought a house in this specific location of
Discovery Bay. We want to see all the fun on the Delta and not look across the bay at other
homes. Everyone buys for a varying degree of reasons in Discovery Bay but no matter where
you buy you will not escape ANY realtor's tour without hearing a comment on the proximity to
"fast water'. Ask any Realtor in Discovery bay if you would have to pay more for a home that was
2 minutes to skiing or 45 minutes to skiing and be ready for their resounding "YES"! By
eliminating the Lido Bay access point to begin skiing on Indian Slough, you are increasing my
property values compared to everyone who lives West of me. That doesn't seam fair to my
friends and neighbors over there! You are also decreasing my property value compared to
everyone who lives East of me.. and I don't appreciate that either! Please keep our property
values consistent by passing the Sheriff Department's proposed changes. Sadly, I would hate to
have to join a class action laws suit to defend our property values-but I would if the need arose.

I for one in addition to many of my neighbors firmly believe all this waterski
ban nonsense has more to do with sucking the development fees out of the
Pantages project than it does with boating safety.
The Pantages EIR will soon be released and it will include discussion of
increased boat traffic and waterway impact. By this proposed action the BOS
will be mitigating (in-theory) one of the factors that detractors could use to
push for non-approval.
What other conceivable reason could there be other than doing the Pantages
developer a big favor? The CADBW says skiing is not a problem, the sheriff
says skiing is not a problem.-yet the all knowing BOS says it is a problem.
BOS you are not fooling anyone. We all know the county has huge money problems
and the developer fees from east county do not stay in east county...they go
right to Martinez to help cover for systemic inadequacies. Just admit it.
Better yet back off the ski ban and we will help you keep your dirty little
secret!

As a person who uses many county recreational facilities I am shocked by this
entire proposed watersports ban, even its modified version.
When this all first emerged last month the news was full of scary stats that
made it seem like every time one skied near Discovery Bay one was taking their
life in their hands. More recently I have heard and read that there have been
11 watersports injuries (no deaths) since 1995 and all have been self induced.
That seems to be slightly less than one injury per year. Not too bad
considering the type of risk inherent activity(s) in question. Now consider
sports like skateboarding and mountain biking, swimming, diving, soccer, ect.
that take place within county venues. I seriously doubt there is a skateboard
venue in the state that has an injury record as low as the watersports injury
rate in the waters near Discovery Bay.
If you insist upon restricting watersports near Discovery Bay please be
reasonable and modify the ordinance to exactly coincide with what Sheriff Rupf
proposed. The few weeks and three hours in the mornings you are taking away
are critical to many locals enjoyment of their chosen form of recreation.
If you choose not to be reasonable with respect to watersports then I expect
you to immediately move to restrict any form of recreation within the county's
control (occurring on a county venue) that averages even ONE injury per year.
Please be reasonable.

At this juncture I (and many others) can only conclude the Discovery Bay
waterski probation is not about improving boating safety it is about politics.
History (documented by the CA Department of Boating and. Waterways) clearly
.does not show waterskiing to be a safety issue and the sheriff does not think
waterskiing to be a safety issue. So what is it about? Politics, plain and
simple. If it were truly about safety you the Board of Supervisors would not
be diverting the marine patrol's precious and limited patrol capacity away
from high traffic/high risk times. we all know the marine patrol only has a
few officers and fewer boats. They have a lot of water to cover; Discovery Bay
isnot the only busy area, in-fact last month 4 boating accidents occurred
elsewhere in the county. This ordinance as presently proposed would call on
the marine patrol to .be out looking for skiers early in the mornings which we
all know is the lowest risk time of the day. In response to a question th!
e sheriff said marine patrol is on duty from 8 am until 10 pm. You asked the
wrong question. The right question would have been; what time are the marine
patrol boats typically on the water near Discovery Bay? The answer would have
been well after 10 am. I know this for a fact as every boat that exits or
enters the marine patrol dock at the Discovery Bay marina must pass by my home
at idle speed. By the Board of Supervisors causing the marine patrol boats to
go out early you will be taking away from their overall mission. Let us not
forget the boating accident rate proximate to Discovery Bay has been falling.
The marine patrol is doing a good job; please do not jeopardize the safety of
my family and others to advance your political agenda.

I'm writing to you in hopes that you will reconsider your proposed ordinance for vote tomorrow.
Even though the community has proven that waterskiing has not been the cause of the accidents and
wouldn't have prevented any of the accidents in these sloughs, the water-ski community has
compromised with a plan together with the sheriff to reduce the water-ski activity in this area at the
times of high traffic flow. This plan does address the concerns of the BoS but only from May 1 st to
September 30th weekends and holidays and from the hours of 10 AM to dark. Together with this plan,
you must approve a comprehensive signage plan to reduce the real problem of speed, and rules of the
road. The community has spent countless hours on this subject and together we can have a win win

Dear Honorable Supervisors of Contra Costa County,
You have before you the opportunity to make the right choice and not go ahead with
ordinance 2007-22 as voted on at your last meeting on June 5. You should either
amend the ordinance to be in line with Sheriff Rupfs recommendation or drop the
ordinance entirely and listen to the experts in the area to come up with a solution that
would make the area in question safer. A couple of caution signs placed in the
appropriate turns would have an immense affect on increasing awareness and safety.
You have had a large number of individuals come before you at your weekly meeting
and present you with the facts as they really are. The true facts given to you provide
you with the information needed to act appropriately on this manner.
You should come to Discovery Bay/Indian Slough this weekend to see what the real
story is for yourself. You should be angry and feel insulted that you were presented
with false data and information that was incorrect and was being misused in order to
persuade you to vote in favor of this ordinance. There has been no study done to
show that this ordinance would make the delta any safer.
Please come join us this Saturday or Sunday morning and get the real story. Feel free

Dear Supervisor Phiepo,
Let me reiterate: "Close Relationships" are conflicts of interests or have the appearance of
conflict of interests. The appearance of conflict of interest is a conflict of interest. Particularly;
when you support a proposal to ban certain water-ski activities submitted by your husband. 1
doesn't matter how hard you tried to be fair. The appearance is still there. See the references in
my previous e-mails. As a public official,you should disqualify yourself from making or
participating in a government decision, or using your official influence or attempt to influence a
goverriment decision. See the California Fair Political Practices Manual. As our elected official,
you must support the will of the people. The 1500 odd signatures on the referendum and the
outflow of resistance to the proposal by it self should be enough to shelf the proposal. At times
you have brought up the silent majority. Who are they? Where are they? How many are there.?
At other times you have stated that you wanted to be proactive with safety issues. I will give you
examples why your support of this proposal will not enhance safety.
Take for instance a child with his/her first bike. It doesn't matter how hard we try, the child will
go through a learning process that includes an X amount of bruises, cuts, sprains and sometimes
broken bones before the child is ready to perform wheelies. Injuries will also occurr in football,
baseball, basketball, etc. and is accepted in order to progress and participate in the sport.
Water-skiing is no exception. We progress from double skis; with bumps, bruises and sometimes
ear perforations,to a single ski and finally to a fine-tuned slalom ski that slices through the
water. An X amount of injuries will occurr as we go through these phases, but it is worth it and
accepted. Now, you're supporting a proposal to ban skiing on smooth waterways that are
protected from the wind by the levee and transfer that skiing to a six hundred foot wide waterway
that is no longer protected from the wind. The wind of this waterway has a longer reach and
therefore produces bi;ger waves. This makes it more difficult for skiers at all skill levels and
may cause additional injuries. It doesn't enhance safety since you are only transferring these
iniuries from one side of an imaginan, line to the other side of this line.
I will be in Oregon during the next Supervisors meeting and will not be able to bring this to your
attention personally and request that you will bring these conserns to the board. .As an intelligent
woman, I am sure that you will understand that transferring a sport from a a well-groomed field
to an area that has roughness and bumps will not enhance safety. On the contrary, it will increase
injuries.

I wanted to add my bit as a local to Discovery Bay, I have been enjoying the waterways there for
many _years. approx. 16 years. I hang out there every weekend to get away from work and home
to relax and enjoy.
You started with Salisbury, then Golden Gate Isle, Tracy Oasis/Grant Line now the Discovery
Bay area, where does it end? When are you going to be happy? Oh, I know, I'm in the mortgage
industry, it must be money in your pockets, development! Come on, that means more people,
boats and accidents and if you shove us all into one area, its going to happen more, atleast spread
us out on the water. This does not make sense.
You and the county have got to compromise with the people especially those that have paid to
live there!
What the Sherriffs suggested is the best solution, holidays and possibly weekends but not every
day and should only be in the immediate areas of the marinas/launching.
