FINANCIAL IMPACT: The request for placement at the fourth step in the salary range is within the approved budget for Fiscal Year 06/07 and 07/08. REASONS FOR RECOMMENDATION AND BACKGROUND: The District Attorney's Office recently hired a DA Senior Inspector who previously worked as a deputy sheriff for the Sheriff's Office. The County Salary Regulations, adopted in 1983, do not allow for promotional salary increases above five percent, or, the next highest salary range in the classified salary range without benefit of resolution. The salary regulations provide for using an employees base pay when determining the step that an employee will be placed given the five percent rule. However, in addition to being paid at the current top step of the class of Deputy Sheriff the recently promoted DA Senior Inspector received a Career Incentive Allowance of $318.44 per month, Uniform Allowance of $72.67 per month, Holiday Pay averaging $441.00 per month and corporal pay of $318.44 per month increasing his monthly compensation (excluding overtime he might learn) by a total of $1,150.55. Therefore, according to the Salary Regulations, the new senior inspector would have to take a pay cut of $592.06 per month upon his promotion to DA Senior Inspector. Therefore, we are requesting that the Salary Regulation 4.1 be waived, and that the Board adopt a resolution permitting the hiring of DA Senior Inspector Shawn Pate at the fourth of the DA Senor Inspector range. It should be noted that, if DA Senior Inspector Pate's total compensation (as define for retirement purposes) were considered, instead of base pay only, we would be hiring him into the fourth step, using the five percent rule in the salary regulation. WHEREAS the placement of the Senior Inspector indicated below does not take into consideration his previous salary and incentives in the position of Deputy Sheriff, It is therefore recommended by the District Attorney that the Board adopt this Resolution to address the circumstances listed above.
