SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommended Action:
ADOPT Resolution No. 2007/ accepting the filing of the Preliminary Engineer's Report fora lighting
assessment on the parcels within the San Pablo Dam Road Street Light Installation Project to be annexed into
County Service Area L-100 and declaring the intent to levy and collect assessments. The Preliminary
Engineer's Report is on file with the Office of the Clerk of the Board and Public Works Department.
FIX .a Public Hearing for June 12, 2007 at 9:30 a.m. in Room 107 of the Board of Supervisors' Chambers, 651
Pine Street, Martinez, California as the time and place for a public hearing on levying the proposed annual street
lighting service charges on parcels within the San Pablo Dam Road Street Light Installation Project and to
certify the tabulation of the ballots submitted for the proposed assessment.
DIRECT the Public Works Director, or designee, to mail by first class mail, a written notice and ballot to each
parcel owner within the San Pablo.Dam Road Street Light Project annexation in compliance with Proposition
218.

Fiscal Impact:
There is no impact to the County General Fund. All costs will be covered with revenue from County Service
Area L-100.
Reasons for Recommendations and Background:
Residents along the section of San Pablo Dam Road from May Road to D'Avila Way approached the County ill
2005 requesting additional street lights be installed. The Public Works Department agreed to pursue installation
of street lights if the majority of the property owners agreed to annex into County Service Area L-100 and assess
themselves. Homes and subdivisions in this area were built prior to the requirement of property owners to
install street lights and annex into the County's street light program (County Service Area L-100).
To promote public health, safety and welfare, the Public Works Department is working with residents and
homeowners along San Pablo Dam Road to provide additional street lighting. On October 17, 2006, the Public
Works Department mailed.a letter to property owners along this section of San Pablo Dam Road soliciting
support or opposition to installation of additional street lights. The Public Works Department communicated
that we would only proceed with the installations if the property owners who will be benefiting from the lights,
annex into County Service Area L-100.
On January 31, 2007, a second letter was sent, to verify that property owners understood that even though they
may not agree with the annexation and installation all parcels will be annexed into County Service Area L-100 if
the Public Works Department receives a majority of. vote in favor of the project. Public Works also
communicated that if a majority of votes opposing the placement of street lights and the annexation of their
property into County Service Area L-100 were received, the Public Works Department will not be able to
proceed.
Of the replies the Public Works Department has received, there has been.a definite majority of responses in
favor of the installment of street lights. Therefore, the owners of the parcels within the San Pablo Dam Road
Project are required to annex to the County's street light program to contribute to the continued maintenance
and operation of street lights. Proposition 218 provides that any new assessment may not be approved if it is
opposed by a majority of the property owners voting on the proposed assessment. The Board Order and
Resolution complies with the requirements for new assessments under Proposition 218. .
Properties along this section of San Pablo Dam Road not included in this project have either already been
annexed into County Service Area L-100 and are currently being assessed this levy or are located within the City
of Richmond's boundaries. Annexation of these parcels to County Service Area L-100 is contingent upon the
approval of the Local Agency Formation Commission.
Consequences of Negative Action:
Without Board of Supervisors' approval, the Public Works Department will be unable proceed with the San
Pablo Dam Road Street Light Installation Project.

The Board of Supervisors of Contra Costa County FINDS THAT:
1. Residents along San Pablo Dam Road, from May Road to D'Avila Way, have requested the installation
of additional street lights. Homes and subdivisions in this area were built prior to the requirement for
property owners to install street lights and annex into the County's street light program County Service
Area(CSA) L-100.
2. The County is currently processing the San Pablo Dam Road Street Light Installation Project (the
"Project") consisting of 83 (eighty-three) parcels, more specifically described in Exhibit A. The County
will proceed with the installation of street lights along San .Pablo Dam Road contingent on a majority
vote from the 83 (eighty-three) property owners to annex into CSA L-100.
3. Once the parcels are annexed into CSA L-100, the parcels will receive a special benefit over and above
that received by the general public in the form of lighting services. This service is a miscellaneous
extended service (the "Extended Service") as defined in Section 1012-2.406 of the Contra Costa County
Code.
4. In order to fund the Extended Service that will be provided to the parcel(s) within the Project, it will be
necessary to levy a service charge (the "Assessment"). The service charge meets the requirements of an
"Assessment" under Article XIIID of the California Constitution because it is conferred to provide the
special benefit, defined above, on the parcel(s) within the development.

5. A copy of the Addendum io the Final Engineer's Report to the Board of Supervisors for establishing a
street light service charge for Fiscal Year 2006/2007 (the "Engineer's Report") is attached as Exhibit B.
The Engineer's Report meets the requirements of a tentative report under Section 1012-2.602 of the
Contra Costa County Code. The Engineer's Report includes: a description of each parcel of real property
receiving the Extended Service, the Assessment Diagram, the total Assessment chargeable to the entire
service area; the estimated Assessment chargeable to each parcel, the calculations supporting the
Assessment, and the duration of the Assessment.
6. The Board has adopted the Final Engineer's Report for the Countywide Street Light Program Fiscal Year
2006/2007 on July 25, 2006. Based on its review of the Engineer's Report, the Board finds that:
(a) The Extended Service financed by the Assessment will directly benefit the parcels within the
project.
(b) The cost of the Assessment on each parcel within the project is proportional to the benefits that
the Extended Service will confer on each parcel.
Now, therefore the Board of Supervisors ORDERS and RESOLVES as follows:
1. The Board approves the Preliminary Engineer's Report and opens the Report to public inspection at both
the Clerk of the Board and Public Works Department offices.
2. The Board will conduct a public hearing (the "Hearing") on June 12, 2007 at 9:30 a.m. in Room 107 of
the Board of Supervisors' Chambers, 651 Pine Street, Martinez, California 94553.
3. The Board directs the Clerk of the Board to immediately provide the Public Works Department of Contra
Costa County with a copy of this resolution. The Board directs the Public Works Director, or designee,
mail the written notice of the Hearing (the "Ballot Notice") attached as Exhibit C to the record owners of
each parcel within the project. The ballot attached as Exhibit D shall be attached to the Ballot Notice.
4. At the Hearing, the Board shall consider any objections or protests to the Assessment. Immediately after
the Hearing, the Public Works Department shall tabulate the ballots and certify the tabulation of the
ballots. The Board shall not impose the Assessment if there is a majority protest. A majority protest
exists if, after the close of the Public Hearing, ballots submitted in opposition to the assessment exceed
the ballots submitted in favor of the assessment (more than 50%). In tabulating the ballots, the ballots
shall be weighted according to the proportional financial obligation of the affected property.
5. At the Hearing, if there is no Majority Protest, the Board may adopt a resolution which: confirms the
Engineer's Report; levies the Assessment in the Engineer's Report; finds that the Director of the Contra
Costa County Public Works Department, acting as the designated director, has concluded that the
Engineer's Report conforms to the official assessment roll for the year in which the assessment will be
collected and, therefore, constitutes the Final Engineer's Report for the Assessment; confirms the Final
Engineer's Report; and levies the Assessment for the Fiscal Year referred to in the Engineer's Report.
