SUBJECT: Approval to Submit Application and Execute Grant Award Agreement with California
Department of Insurance for Funding Life and Annuity Consumer Protection Program for
Fiscal Year 07/08
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
Adopt a resolution to approve and authorize the District Attorney to submit an application and execute a
grant award agreement, and any extensions or amendments thereof, pursuant to State guidelines, with
the State Department of Insurance for funding of the Life and Annuity Consumer Protection Program in
the amount of $25,385 for the period July 1, 2007 through June 30, 2008. (State Funds- No match
required)
FINANCIAL IMPACT:
The grant application will fund one-eighth of the salary and benefits for an attorney assigned to the
program. The position will operate out of the District Attorney's Special Operations Division. The Life and
Annuity Consumer Protection Program award is allocated from a trust fund financed by an assessment
on each individual life insurance policy and each individual annuity product with a value of fifteen
thousand or more issued to a resident of the state, paid by the insurer. Of the assessment amount, fifty
percent of the funds are distributed to District Attorneys for investigating and prosecuting individual life
insurance and annuity product financial abuse cases involving insurance licensees or any persons
holding themselves out to be insurance licensees. Expenditures and revenues for grant position are not
included in the District Attorney's 07/08 budget, appropriation adjustment will be prepared upon receipt of
grant award.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The State Legislature has determined that there is a need to protect consumers of life insurance and
annuity products in the state. While fraud is recognized as a growing problem across the county,
California is an area of concerted criminal activity in insurance fraud.
CONSEQUENCES OF NEGATIVE ACTION:
Failure to approve the recommendation will result in the loss of State funds available to combat the
problem of insurance fraud in Contra Costa County.

SUBJECT: Funding of the Life and Annuity Consumer Protection Program
RESOLUTION OF THE GOVERNING BOARD
WHEREAS the Board of Supervisors, Contra Costa County, desires to undertake a
certain project designated as the Life and Annuity Consumer Protection Program to
be funded in part from funds made available under the authority of California
Insurance Code section 10127.17 and administered by the California Department
of Insurance (hereinafter referred to as DOI),
NOW, THEREFORE BE IT RESOLVED that the District Attorney of the
County of Contra Costa District Attorney's Office Special Operations Division is
authorized, on its behalf to submit the attached proposal to the California
Department of Insurance and is authorized to execute, on behalf of the Board of
Supervisors, the Grant Award Agreement, including any extensions or amendments
thereof.
BE IT FURTHER RESOLVED that the grant funds received hereunder shall not
be used to supplant expenditures previously authorized or controlled by this body.
