Our customers launch at our facility because they enjoy watesports on the Orwood Slough. We are concerned that by banning watersports on this slough it will just make that waterway a freeway for Offshores and jet skiis. I think this proposed ban on waterskiing is a totally ineffective way to halt the problem, which is alcohol and excessive speed of boats mostly like cigarette boats, built only for speed, which make no sense to anyone, except males between 15 and 25 who have some wierd need for speed. So make a 40 mph zone (between say noon and 7 pm. or crack down on alcohol on the Delta whether it is the driver or occupants, that makes a lot more sense. Requiring more education on boat driving would also be a better and more effective solution like a special liscense to drive a boat requiring driver education and boating safety which we used to have to get a driver's license for a car. Or raise the age limit of driving to 21. . . . .that might be helpful as well. Or make them all go 5mph? Attack the CAUSE of the problem: Hefty fines on those casuing accidents, whoever they may be. Also, everyone knows a great many accidents are from people with too much alcohol in them, so if it's dangerous to drink and drive on roads, its even more so on waterways with no lanes and other controls, so why not some legal limit for body alcohol content? This Ordinance proposes to ban all forms of water-skiing in a major section of the Delta. I would like to request the country reject this Ordinance. There is no documented evidence that water-skiing related accidents have occurred in this area. Banning sections of the Delta to water-skiing will result in consolidation of skiers and boaters into other areas of the delta. Laws currently exist to protect skiers and boaters such as how close a boat can follow a boat towing a skier plus laws related to sending wake rollers towards idle/docked boats. I feel this will adversely affect community of Discovery Bay as this is the primary reason people live here. The existing rules and regulations should be enforced against all users of the public waterways as opposed to discriminating against a particular group of users, when in fact that said group has been (at most) a minority contributor to the safety concerns used to justify the proposed ordinance. The proposed ordinance seems to be misdirected and unnecessary. If the intent is to ban activities where boats slow down and/or circle in Indian Slough, why stop with skiing? Why not 'ban fishing, or towing a boat in need of assistance, or sailing, or swimming. The reason we live in Discovery Bay is to be able to avail ourselves of the opportunity to use (all of) the public waterways. If that right is taken away in Indian Slough, where will it stop? And, how will we as residents be any safer as a result? Further, as specifically mentioned in the proposed ordinance, personal watercraft were involved in at least some, if not a majority of the accidents cited as the justification for the proposed ordinance, yet despite this fact, the use of personal watercraft is not prohibited in the proposed ordinance (except when towing) . All of the concerns and ,accidents mentioned in the proposed ordinance seem to be the result of behavioral problems involving boats/watercraft operated in an unsafe manner, whether due to intoxication, inexperience, or negligence. That would indicate that the issue is an enforcement issue as these activities and behaviors are already governed by existing laws and regulations. I am all for enforcing the existing rules and regulations which govern the use of our waterways, but I think the proposed ordinance is misdirected and unnecessary. If the goal is to improve the safety of these waterways, then let's start with enforcing the existing rules and regulations rather than making unnecessary additional rules and regulations. I'd like to offer the most recent statistics submitted by the California Department of Boating and Waterways. Granted these statistics are from 2002, yet I haven't seen any other more topical study so please bear with me. The intention is that by banning waterskiing and other towed activities, the accident rates, incidences, injuries and casualties will decrease. Let me throw some numbers at. you and see if you agree targeting the waterski community is the answer to this issue. Personal Watercraft (PWC) such as Jet Skis account for 18 percent of registered vessels, but were involved in 25 percent of the accidents on the Delta. Cabin motor boats and houseboats accounted for 35% of all accidents. Nearly 25 percent of all boating injuries occurred on three-day holidays for Memorial Day, 4th of Julyiand Labor Day. Alcohol played a role in 38 percent of fatal boating accidents in 2004, nearly twice the 2003 rate of 21ipercent. Operators age 21 to 30 were involved in more accidents than any other age group I I s Waterskiing accidents account for 13% of the total accidents in the Delta relative to the number being much high in larger more open bodies of water (32% on Lake Shasta and 19% on Lake Berryessa) . 65% of all boating accidents of any kind take place on the weekend with a total of 25% of all accidents occuring on holiday weekends. Personal Note: The only boats I have ever seen beached on the hard Delta were offshore race boats on a Delta poker run as documented by the local rag in Discovery Bay. Given this set of data, itiseems really clear that the waterski community is being targeted when waterskiing is such a relatively small contribution to the danger on the Delta. I submit that banning waterskiing and towing activities does nothing to address wreckless boaters, drunk boaters, large cabin cruisres, Personal Watercraft and inexperienced boaters which do contribute to the danger in that particular area of the Delta. It's also clear that the level of danger on Indian Slough and Werner Cut is significantly different depending on the time of day, week, year and holiday schedule. Personally,' I have observed Indian Slough and Werner cut vacant most weekday afternoons and weekend mornings. , I'd be 'interested to see the statistics augmented to account for those times of the day to determine Delta safety. My final thought: Target the appropriate behavior and target the appropriate windows of time that offer the greatest amout of protection for the safe and responsible boaters, fisherman and skiers of Discovery Bay. Let me throw some numbers at you and see if you agree targeting the waterski community is the answer to this issue. * Personal Watercraft (PWC) such as Jet Skis account for 18 percent of registered vessels, but were involved in 25 percent of the accidents on the Delta. * Cabin motor boats and houseboats accounted for 35% of all accidents. * Nearly 25 percent of all boating injuries occurred on three-day holidays for Memorial Day, 4th of July and Labor Day. * Alcohol played a role in 38 percent of fatal boating accidents in 2004, nearly twice the 2003 rate of 21 percent. * Operators age 21 to30 were involved in more accidents than any other age group * Waterskiing accidents account for 13% of the total accidents in the Delta relative to the number being much high in larger more open bodies of water (32% on Lake Shasta and 19% on Lake Berryessa) . * 65% of all boating accidents of any kind take place on the weekend with a total of 25% of all accidents occuring on holiday weekends. * Personal Note: The only boats I have ever seen beached on the hard Delta were offshore race boats on a Delta poker run as documented by the local rag in Discovery Bay. Given this set of data, it seems really clear that the waterski community is being targeted when waterskiing is such a relatively small contribution to the danger on the Delta. I submit that banning waterskiing and towing activities does nothing to address wreckless boaters, drunk boaters, large cabin cruisres, Personal Watercraft and inexperienced boaters which do contribute to the danger in that particular area of the Delta. It's also clear that the level of danger on Indian Slough and Werner Cut is significantly different depending on the time of day, week, year and holiday schedule. Personally, I have observed Indian Slough and Werner cut vacant most weekday afternoons and weekend mornings. I'd be interested to see the statistics augmented to account for those times of the day to determine Delta safety. N i My final thought: Target the appropriate behavior and target the appropriate windows of time that offer the greatest amout of protection for the safe and responsible boaters, .fisherman and skiers of Discovery Bay. I have been waterskiing on the delta for 16 years in this area and other areas. Also, a member of the BAWSC (bay area water ski club) and other organizations. The area marked in red from Orwood Marina to Discovery Bay Marina is heavily populated and has traffic on the weekends. There has to be a compromise! I think it should be a no wakeboard/ski zone on the weekends only, midweek with fess people it should be ok to ski or wakeboard. There are other areas to handle this situation/issues. Please call or email if I can be of any assistance is supporting the ban.
