TO PROVIDE ADDITIONAL INSPECTION AND MATERIALS TESTING SERVICES FOR THE CONTRA COSTA COUNTY DISTRICT ATTORNEY'S OFFICE BUILDING PROJECT, 950 WARD STREET, MARTINEZ (WH224Y) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION 1. APPROVE Amendment No. 2 to the Consulting Services Agreement dated September 12, 2006 with Kleinfelder, Inc., which would increase the payment limit by $96,000 from $44,000 to $140,000 for additionall,inspection and materials testing services for the Contra Costa County District Attorney's Office Building Project, 950 Ward Street, Martinez. 2. AUTHORIZE the Director of General Services, or designee, to execute the amendment. FINANCIAL IMPACT Plant Acquisition funds (4405-4224) are budgeted for the cost of these additional services. BACKGROUND The project involves constructing a new four-story District Attorney Headquarters Building at the downtown Martinez site bo'l nded by Las Juntas, Court, Green, and Ward Streets. The project commenced construction in jNovember 2006, and structural steel work is currently in progress. The project is currently on schedule and there have been no major issues to date. Kleinfelder is providing special inspection and materials testing services for the project. During the current course of foundation Ond structural steel work, additional design and fabrication requirements were implemented to address various unanticipated field and production conditions. As a result, additional inspection and testing services are required beyond what was originally anticipated. The additional inspection and testing services include shop and field welding inspections, shop fabrication inspections, non-destructive!! testing, materials testing, overtime work to maintain the construction schedule, submittals review,,and consultation. The proposed amendment is necessary to cover the time and expense of the additional services. The amendment also includes a $5,026 contingency amount to be utilized for anyladditional unanticipated changes that mny be warranted. Effective Date and Parties: Effective May 1, 2007, Kleinfelder, Inc. (herein called "Consultant"), a California Corporation, and the County of Contra Costa(herein called"County"),a political subdivision of the State of California,mutually agree as follows: 2. Purpose: On September 12, 2006, the parties entered into a contract entitled "Consulting Services Agreement," referred to as the "Agreement," which covers special inspection and materials testing services. The Agreement has previously been amended as follows: First Amendment dated January 25,2007. The parties desire to further amend the Agreement to expand the scope of service and to increase the payment limit accordingly. 3. Amendments to Agreement: A. In the Agreement, Section 1(e), change the Payment Limit from $44,000.00 to $140,000.00, an increase of$96,000.00, which includes a contingency amount of$5,026.00. See attached Scope of Services. B. In accordance with Section 14 of the Agreement provide the following: In summary: • Overtime work required f6r shop and field welding inspections to support construction schedule. • Additional shop fabrication inspections. • Additional shop and field(welding inspections. • Additional non-destructive shop and field welding and ultrasonic testing inspections. • Additional materials testing, submittals review,project management,and consultation. 4. Effect: Subject to the revisions made by this and any prior amendments,the Agreement shall remain in full force and effect. 5.
