Executive Director DATE: May 15. 2007 SUBJECT: CONTRACT WITH THE COUNTY OF CONTRA COSTA OFFICE OF THE SHERIFF FOR COMMUNITY POLICING SERVICES AT THE BAYO VISTA PUBLIC HOUSING DEVELOPMENT IN RODEO AND THE LAS DELTAS PUBLIC HOUSING DEVELOPMENT IN NORTH RICHMOND SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION APPROVE and AUTHORIZE the Executive Director of the Housing Authority to execute a contract. on behalf of the Housing Authority. with the Contra Costa County Office of the Sheriff to provide the Housing Authority's Las Deltas and Bayo Vista developments two Deputy Sheriffs for a twelve month period beginning April 1. 2007 and ending March 31. 2008. i II. FINANCIAL IMPACT The cost for this service is S320.000 and is budgeted under the Authority's federally funded Capital I Fund Program. No County Genera! Funds are required. I III. REASONS FOR RECOMMENDATION/BACKGROUND For thirteen (13) years the Office of the Sheriff has provided community policing duties at the Las Deltas and Bayo Vista housing developments. These are allowable costs under the federal Department of Housing and Urban Developments guidelines. The Deputies provide an opportunity for residents to participate in crime prevention, provides them with enhanced security and maximizes enforcement of laws regarding-criminal activity. including loitering. j IV. CONSEQUENCES OF NEGATIVE ACTION Should the Board elect not to approve and authorize the Executive Director to execute this contract. the Office of the Sheriff would not have sufficient resources to provide law enforcement services at the Las Deltas and Bayo Vista Housing Develpments. County's Obligations During the term of this Agreement.the Contra Costa Count-Office of the Sheriff(County)shall provide the Housing authority of the County of Contra Costa(Agency)with two full time deputies assigned to the elimination of drug-related activities, violent crimes and other related unlawful acts at the Las Deltas and Ba}o Vista Public Housing Developments. A. The Deputies will be assigned to work a forty-hour workweek on site under the supervision of the Office of the Sheriffs Bay Station Commander. No overtime costs are authorized under the terns of this Agreement. B. While on site.within the framework of the Community Oriented Policing Program,the Deputies will: > flake even-effort to become an integral pan of the Las Deltas and Bayo Vista communities: > Exchange accurate information with residents about crime,the community and the goals of policing: ➢ Provide residents with an increased sense of police care and build trust and harmony between residents and the Office of the Sheriff: > Engage both residents and police in the mutual identification and resolution of issues of crime and disorder: > Reduce the fear of crime. and enhance the quality of life in Las Deltas and Bayo Vista- > The Deputies will continue the D.A.R.E. program in conjunction with the local school district that will specifically target the youth who live in Las Deltas and Bayo Vista Public housing developments. C. The Deputies will work with other units in the Contra Costa County Office of the Sheriff to maximize enforcement strategies directed specifically against the use and sale of illegal drugs in Las Deltas and Bayo Vista. D. The Office of the Sheriff will provide the Agency with(1)monthly program report that describes the activities conducted by the Deputies at Las Deltas and Bayo Vista during the month-. and(_) quarterly statistical reports and analysis measuring increases or decreases in the number of reported incidents of crime in North Richmond and Las Deltas,and in Rodeo and Bayo Vista:and(i)a final statistical year end report and anal%sis of the program that documents the extent to which incidents of reported crime has increased or decreased in\orth Richmond Las Deltas and Rodeo Bayo Vista. 2. Compensation In consideration of the provision of services as described in Section 1,the Agency will pay the Office of the Sheriff for actual costs in a sum not to exceed the Payment Limit in Section 4 of the Interagency Agreement. 3. Billing and Pavment The Office of the Sheriff will submit to the Agency a properly documented demand for payment monthl} in the form and manner prescribed by Agency. The payment demand shall not exceed the equivalent to one third(1.3)of the total compensation identified in Section '-2 above. Payment shall be based on Service actually rendered. Independent Contractor Status This Agreement is by and between two independent contractors, and is not intended and shall not be construed to create a relationship of agent,servant, employee, partnership, joint venture or association. I 2. Subcontract and Assignment The Office of the Sheriff shall not subcontract any of the services or assign anv rights or obligations under this agreement without prior written consent of the Agency. 3. Records The Office of the Sheriff shall at all times keep a complete and thorough record of the time expended and services performed on behalf of Agency. and shall also make available to Agency for audit all such records maintained. 4. Indemnification County shall defend. indemnifi, sage and hold harmless Agency and all its officers and employees from all liabilities and claims for damage for death, sickness or injury to persons or property, including,without limitation, all consequential damages from any cause whatsoever arising from or connected with operations or the services rendered Agency hereunder and resulting from the conduct negligent or otherwise of officer,agents or employees. 5. Insurance The Office of the Sheriff is self-insured and will immediately advise the Agencv if it ceases to be self-insured. 6. Restrictions Pursuant to Government Code section 6509,the powers of the parties under this Agreement shall be subject to the restrictions on such powers applicable to the Sheriff. i i.
