DATE: May 15, 2007 County SUBJECT: Ordinance Prohibiting Waterskiing - � I SPECIFIC REQUEST(S)OR RECOMAIENDAT-ON(S)&BACKGROUND AND,:USTIFICATION I RECOMMENDATION: I INTRODUCE Ordinance No. 2007-22, which would prohibit waterskiing on Indian Slough and on a I portion of Werner Dredger Cut near Discovery Bay, WAIVE reading, and FIX May 22, 2007 as the date for adoption. FISCAL IMPACT: I If the ordinance is adopted, enforcement costs will depend on the number of ordinance violations. BACKGROUND: I i Ordinance No. 2007-22 would prohibit waterskiing, and all other activities where a person is towed behind or alongside any type of vessel, on Indian Slough and on the portion of Werner Dredger Cut between the Orwood Road bridge and the intersection of Indian Slough and Kellogg Creek. These I waterways are located adjacent to and north of Discovery Bay. The purpose of the ordinance is to address a serious safety problem along the waterways affected by the ordinance. These waterways have multiple blind turns. It is difficult for vessel operators to navigate these blind turns and also avoid boats towing waterskiiers who stop or circle back to retrieve downed waterskiiers. There have been several major injury accidents involving waterskiiers and personal watercraft along these waterways in recent yeluding some fatal accidents. Harbors and Navigation Code section 268 authorizes counties to "adopt restrictions concerning the navigation and operation of vessels and water skis, aquaplanes, or similar devices subject to the provisions of subdivision (a) of Section 660," and extends this authority to all navigable waterways. Harbors and Navigation Code section 660(a) i authorizes counties to adopt ordinances that pertain to special-use areas. A "special-use area" is "all or a portion of a waterway that is set aside for specified uses or activities to the exclusion of other i incompatible uses or activities." (Harb. & Nay. Code, § 651(v).) "Water skis, an aquaplane, or a similar device" includes "all forms of water skiing, barefoot skiing, skiing on skim boards, knee boards, or other contrivances, parasailing, ski kiting, or any activity where a person is towed behind or alongside a boat." (Harb. & Nay. Code, § 651(bb).) The courts have upheld the authority of a county to establish a special use area in a waterway where certain types of watercraft are excluded from the area. (Personal Watercraft Coalition v. Marin County Bd. of Supervisors (2002) 100 Cal.AppAth I 129.) I Ordinance No. 2007-22 would establish a special-use area on Indian Slough and on the portion of Werner Dredger Cut between the Orwood Road bridge and the intersection of Indian Slough and Kellogg Creek. The ordinance would ban, in that special-use area, all forms of water skiing, barefoot skiing. skiing on skim boards or knee boards, parasailing, ski kiting, and any other activity where a person is towed behind or alongside any type of vessel, including behind or alongside a boat or behind or alongside a personal watercraft. i If the ordinance is adopted by the Board, the sheriff will be authorized to enforce it. (C.C.C. Ord. Code. § 410-2.012.) The attached ordinance would authorize the sheriff to place regulatory markers indicating the no ski zone at the boundaries of the special use areas. (14 CCR, § 7003.) I The California Department of Boating and Waterways has reviewed the attached ordinance and determined it is in conformity with the special-use area provisions of Harbors and Navigation Code section 660(a). '%<ATERSKILNG PROHIBITION The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical ! footnotes from the official test of the enacted or amended provisions of the County Ordinance Code): I I SECTION I. SCININIARY. This ordinance prohibits waterskiing, and all other activities where a person is towed behind or alongside any tpe of vessel, on Indian Slough and on the portion of Wether Dredger Cut between the Orvood Road bridge and the intersection of Indian Slough and Kellogg Creek, near Discovery Bay. SECTIOit II. Section 410-6.022 is added to the County Ordinance Code, to read: ! I I 410-6.022 Waterskiing prohibited. (a) No person shall operate any vessel that is pulling or towing water skis, an aquaplane, or a j similar device,nor shall any person ride water skis, an aquaplane, or a similar device, in any of the special use areas designated in subsection (b) of this section. I (b) The following waterways are designated as special use areas: I (1) The entirety of Indian Slough, between OId River on the east and the intersection i of Wether Dredger Cut and Kellogg Creek on the west. ! (2) That portion of Werner Dredger Cut between the Or,%-ood Road bridge on the i north and the intersection of Indian Slough and Kellogg Creek on the south. I (c) The sheriff is authorized to place regulator,markers giving notice of the restriction ! specified in subsection(a) at the boundaries of the special use areas designated in I subsection (b). Marine Services.provided the Board with an analysis of the waterway based on his fire}-ears of working the area. He said there is a high volume of vessels of all shapes and sizes that traverse this waterway. and he pointed out areas of blind turns. shallow-areas.tree stumps. and clocks._ all of which. he said.combined with the increased water traffic, can make this a dangerous area for eater skiing. He presented the Sheriffs position.which is to support this ordinance. ! Tom Geiaer. Count-Counsel. said that if enacted.the Sheriff would enforce the ordinance with fines. I Supervisor Piepho asked how the fines would be determined. ! i Deputy Sheriff Powell responded that if adopted,the ordinance would go through the bail process to determine the fine schedule. Supervisor Glover said he thinks this ordinance is timely as we continue to see growth in the Delta. He asked how-it would be enforced. and asked about anx associated costs y ' I Deputy Sheriff Powell responded that the area would be posted with signs. which would be the primary cost. and said it would be enforced like anv other law". He added that the Marine Patrol also educates the � public. and noted that up to 80%of stops are educational. Although. he added. educational stops would not be as necessary for this ordinance because of the signs that would be posted. Supervisor Glover suggested community meetings could be held to let people know about this ordinance. I The Chair called for public comment on this item. and the following people spoke: ! ■ David Piepho.President of Discoven Bay Community Services District(CSD)and resident of Discover Bay. spoke in support of the ordinance.He said the area is dangerous not just on weekends but at any time of day-because of dangerous curves and boats on the-'wrong side of the road.`He said that with new development bringing 200 more houses.that could mean 200 more vessels on the watemays. He said that locally the CSD has received favorable comments on the proposed ordinance. i I ■ Patty-Knight.Discover-Bay CSD. spoke in support of making the area a no-tow zone. ■ Robert Doran. Discovery Bay CSD. said he has heard good comments from the community about the ordinance. i I ■ Fred Taverner. He suggested that.with laps already in place for speeding and drunkenness. enacting this ordinance for public safety is redundant. ! ■ Rich Sellers. Discovery Bay resident. said the ordinance could affect area property values ! because many people want to move to the area for the fast water sport lifestyle. He also suggested this ordinance could result in ski traffic moving to the more dangerous area known locally as "Suicide Beach." v I ■ David Baca_ Discovery Bay resident. suggested putting the matter to a neighborhood rote. He j also suggested there could be a conflict between Supervisor Piepho bringing this item to the Board when her husband is President of the Discovery Bay Community Service District. ! i ■ Jeff Barber. Discovery Bay resident, said that an all day-everyday restriction is excessive. ■ Matt Ellison. Discover-Bay resident. suggested the ordinance be effective holidays and j weekends only. I I ■ Jennifer Sellers.Discover-Bay resident. said she is out on the water five times a week and does i not see the traffic that is being suggested. ■ Kevin Kirkpatrick, Discover Bay resident. said he has been out on the water at 5:00 p.m. every day for the past 60 days and hasn't seen high traffic. ■ Scott Pellford.Discovery Bay resident. said at times there are dangers but said he doesn't see nater skiers as the problem: he said that the biggest problem is people who don't knot-how to drive on the Delta. He said he would like to see"Keep Right"signs put into place. • Kristen Hamstert.Discover-Bay resident. said education is needed more so than a ban on water skiing. j i ■ 'Maureen O'Toole.Discover-Bay resident. said the ordinance unfairly targets skiers and � boarders.and commented that area home prices are related to their proximity to fast water. ■ Jennifer Nixon. Discovery Bay resident. spoke in support of the ordinance and said safety should ! be the top priority. j I ■ Todd Scruggs. Discovery Bay resident. said the ordinance is not the will of Discovery Bay l residents and said he feels the item is being fast tracked. I ■ Rodrigo Donoso.Discovers Bay resident. agreed that drivers should be educated.but said weekenders and the influx of new people to the area are the problem. He suggested licensing I boaters. I I Supervisor Piepho commented that the ordinance is not to suggest that water skiers cause a problem. but is to respond to the fact that in this environment.they are at risk. i Super-visor Glover said he would like to ensure that there has been appropriate community outreach. � Mr. Piepho said there has been community outreach and discussion that began a year ago. and suggested that there is a silent community majority in support of this ordinance. He added that the more simple and clear a rule is.the easier it is to follow. He said there are I thousands of miles on the Delta for boating and eater skiing. and said that while he appreciates that I experienced and responsible water skiers have shown up to speak on this issue.the issue is safety. and � said the goal is to prevent [accident] statistics on the Delta. I I am proposing that this ordinance be changed to restrict the recreational use to pull or tow water skiers i or other like activities. I think we should restrict these activities and not allow them on weekends or Holidays. This proposed change would help in two ways. It would allow the long time residence of Discovery bay to still ski during the weekdays as the do today and limit the congestion and accidents on the weekends. I I We also need to educate our boat operators by showing more law enforcement. I do not think it is far to classify any type of water activity as being the cause of the issues and accidents we face I i I see this type of ordinance being proposed at the same time you and your committees are considering a new planned development of over 6.000 homes of which 1,000+ are to be deep water home sites. This proposed ordinance will be just another rule to drive away those who love and respect the Delta the most. Is this what we want? New residence that do not care about there surroundings?
