(Drainage Area 10, 13, and 16 Funds) (Districts III and IV) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: AUTHORIZE the Chief Engineer, Flood Control and Water Conservation District, to reimburse developers in Drainage Areas 10, 13, and 16, in addition to drainage fees for reimbursement purposes per the current Drainage Area Credit and Reimbursement Policy. FISCAL IMPACT: Ad-valorem tax revenues collected in Drainage Areas 10, 13, and 16, in addition to drainage area fees collected in those drainage areas,will be used for reimbursement purposes in each drainage area, and there will be no impact to the County General Fund. (Drainage Area 10, 13, and 16 Funds) (Districts III and IV) DATE: May 15, 2007 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: Drainage Areas 10, 13, and 16 are the only Drainage Areas that receive ad-valorem tax revenues in addition to drainage area fees. Both funding sources provide funds to construct drainage area facilities and can be made available to reimburse developers who install drainage area improvements over and beyond their proportional share of costs. The current reimbursement policy allows developers to be reimbursed with drainage area fees.Since these three drainage areas are essentially built out,there are few drainage fees being collected. On the other hand,there are adequate ad-valorem tax revenue balances to reimburse the developers for installing the Drainage Plan Facilities. Following completion of the drainage improvements, the facilities are transferred to the local agencies for maintenance and operation in accordance with the Fee Collection, Right of Way, and Maintenance Agreement in effect. The Drainage Area 10 improvements go to the City of Danville; Drainage Area 13 facilities go to Contra Costa County; and Drainage Area 16 facilities go to the City of Pleasant Hill. This Board action will allow the Chief Engineer of the Flood Control and Water Conservation District to reimburse developers with funds on hand, whether collected via ad-valorem tax revenue or drainage area fees. CONSEQUENCES OF NEGATIVE ACTION: If this action is not taken, the Flood Control and Water Conservation District will not have the flexibility to use ad-valorem tax revenues to reimburse developers for the costs to construct drainage infrastructure that exceed their drainage fee obligations.
