APPROVE and DIRECT Human Resources Department to make a 5% adjustment increase in the County Administrator's base-pay, in accordance with his Employment Agreement and based on an over-all performance evaluation. 2. APPROVE and AUTHORIZE Chair, Board of Supervisors, to execute First Amendment to Employment Agreement with John B. Cullen, to authorize payment of a monthly allowance of$385.00 to enable Mr. Cullen to obtain additional life insurance coverage effective August 1, 2006. FISCAL IMPACT The base-pay adjustment will have an annual impact of$11,000. The additional life insurance benefit will have an annual impact of$4,620 on the County's General Fund. BACKGROUND On January 24, 2006 the County entered into an Employment Agreement with John Cullen to act as County Administrator. Section 5(c) of the Agreement authorizes the Board to make a base- pay adjustment, either an increase or a decrease, of up to 5%, after an uation of Mr. Cullen's over-all performance. Performance objectives and goals have been reached on the following items: • County's Fiscal Year 2005=2006 budget year was closed out timely and the county's 5% unrestricted reserve goal was not only met, but surpassed by 3%. • Finalized labor contracts (one remains outstanding), which meets the Board of Supervisors' "Fiscal Health Objectives: including lowering on-going COLAs, increasing health care co-pays, lowering workers' compensation payments and increasing retired employee health vesting requirements. • Completed two meetings with bond rating agencies that resulted in removal of negative outlooks from Moody's and Standard&Poor's, therefore receiving excellent ratings that supported low c6"st borrowing. • Completed the first major step in development of an Other Post Employment Benefit (OPEB) strategy with actuarial and financial consultant analysis. • Re-established salary competitiveness, as budget allows, for positions lagging far behind the comparable labor market. • Refined and redefined the County Administrator's Office structure and ability to support the Board of Supervisors and county departments. Based on these performance outcomes, we have concluded that a 5%base-pay adjustment increase is fully warranted and should be effective November 1, 2006. During the negotiations leading to the contract approval, Mr. Cullen expressed a desire to purchase additional life insurance coverage, and we as the Board's negotiators, and the Board itself, informally approved this request. However, the specific information as to the cost of such coverage was not available at the time, and the parties agreed to add this provision later by contract amendment, so that the Employment Agreement could be entered into promptly. This amendment is presented so that the parties' entire negotiation can be reflected in the Agreement. FIRST AMENDMENT TO EMPLOYMENT AGREEMENT Effective August 1, 2006, the County of Contra Costa, a political subdivision of the State of California, hereafler referred to as COUNTY, and John B. Cullen, hereafter referred to as EMPLOYEE, in consideration of the mutual promises made herein, agree as follows: I. Amendment: The Employment Agreement, entered into by the parties on January 24, 2006, is hereby amended by adding subparagraph (e) to Paragraph 6, as follows: (e) In addition to the provisions of subsection (a), EMPLOYEE shall be entitled to a flat monthly allowance of$385.00 to enable EMPLOYEE to purchase additional life insurance coverage.
