(County Service Area L-100 Funds) (District V)ProjectNo. 7394-6X5001 DATE: February 27, 2007 PAGE: 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: The developer is required by Condition of Approval to annex to the County's street light program, CSA L-100, for continued maintenance and operation of street lights. Proposition 218 provides that any new assessment may not be approved if it is opposed by a majority of the property owners voting on the proposed assessment. The Board Order and Resolution comply with the requirements for new assessments under Proposition 218. CONSEQUENCES OF NEGATIVE ACTION: Without Board of Supervisors' approval, this project will not be in compliance with the Conditions of Approval for Land Use Permit 05-2051 and an alternative means to finance public right of way street lighting would have to be identified. (County Service Area L-100 Funds) (District V)Project 7394-6X5001 The Board of Supervisors of Contra Costa County RESOLVES: 1. On June 6, 2006, the Board of Supervisors adopted Resolution No. 2006/343 directing the filing of the Engineer's Report for street light charges for County Service Area L-100 (CSA L-100). As directed by the Board,the Engineer of Work has filed the Engineer's Report. 2. On June 6, 2006, the Board adopted Resolution No. 2006/343 declaring the Board's intention to levy and collect street light charges to operate and maintain facilities and services within CSA L-100 for Fiscal Year 2006/2007 and setting a public hearing for July 25, 2006. Notice of the hearing was given in the time and manner required by law. 3. On January 9, 2007 the Board adopted Resolution No. 2007/10 directing the Engineer of Work (Public Works Director) to mail to the property owners within Land Use Permit 05-2051 the notices and ballots required by Section 4 of Article XIII D of the California Constitution(Proposition 218). 4. The notices and ballots have been mailed to property owners and the returned ballots are ready to be tabulated. NOW,THEREFORE,the Board FINDS,DETERMINES and RESOLVES that: 5. A public hearing was held before this Board on February 27, 2007, at 9:30 a.m. At the hearing, the Engineer of Work presented to the Board all ballots received from property owners within Land Use Permit 05-2051. The Board heard and considered all protests against the proposed assessments and tabulated the returned ballots according to the proportional financial obligation of the affected properties. The Board also afforded to every interested person an opportunity to make a protest to the engineer's report, either in writing or orally, and the Board considered each protest. 6. A majority protest, as defined in section 4(e)of Article XIII D, does not exist. 7. The Board hereby confirms the diagram and assessment as set forth in the report of the Engineer of Work and hereby authorizes the levy of the street light charges set forth therein in Land Use Permit 05-2051 for fiscal year 2006/2007 to be collected on the tax rolls. The importance of helping others in order to build a better future is a lesson she learned from her parents, who themselves immigrated from El Sal- vador to give their children brighter opportunities. As a young woman, she started a small business that specialized in helping in- jured workers find jobs.Herself a fluent Spanish speaker,she saw at ' an early age that many Latinos were disengaged in California's po- litical process, so she decided to become a role model. In 1994, she 7 was elected to the State Assembly, becoming the first Latina from Northern California ever elected to the State Legislature. During her time in the State Legislature, Senator Figueroa has always stood up for the interests of regular Californians, and has been a powerful advocate for women and chil- dren. Working with then-Assembly Speaker Antonio Villaraigosa, she helped create the Healthy Families Program, which has provided health care to more than 500,000 chil- dren. Later, she fought the insurance industry and wrote the landmark law that gave patients the right to sue negligent HMO's. Perhaps Senator Figueroa's most popular leg- islation created the "Do Not Call List," which enabled Californians to block telemarket- ing calls and prompted the Bush Administration to follow her lead with a national "Do Not Call"program. Senator Figueroa also recognizes the importance of protecting our environment,and has worked hard to make our communities safer. For her efforts, she received the 2003 Coastal Guardian Award from Vote the Coast, and she consistently has received high marks from the California League of Conservation Voters. Senator Figueroa knows that California's future is tied to the strength of its workers. That is why she has always defended workers' rights and stood behind labor unions. During the course of her career, Senator Figueroa has received a 98%voting rating from the California AFL-CIO. Throughout her years in the legislature, Senator Figueroa has always emphasized the importance of reaching out and listening to all Californians. She put her principle of listening to hardworking Californians into action when she met a local woman whose personal story led to an important new law to help defend women's rights against the interests of powerful HMO's. That woman was a teacher in Senator Figueroa's district who was discharged by her hospital less than one day after mastectomy surgery. Her story prompted Senator Figueroa to write a new law requiring at least a 48-hour hospital stay after such surgeries, which gained national attention against the practice of HMO's allowing "drive-through mastectomies." She has also defended a woman's right to choose and has earned a 100% Pro-Choice voting rating from the Planned Parenthood of California. Though Senator Figueroa is proud of her accomplishments, she knows that more must be done to build the California she envisions for her children and grandchildren. She continues to stand up for California's families and gives a voice to those who are seldom heard, and continues to overcome adversity in order to build a brighter future for all Californians. ® 0 0 0 1177-- in. ' 0 �- = Good Samaritan: Sarah Dittmore - age 14, 8`h grade, Charlotte Wood Middle School Representing youth who go out of their way to do good without getting recogni- tion. Sarah addressed a tragedy in her community by creating a website to sell hand- made flip flops. The proceeds will help cover the medical expenses for a teacher who was seriously injured in a car accident."1 admire how someone so young would take the initiative to reach out and help a family in need." Valiant Volunteer: Vanessa Beals-age 17,11`h grade,Pittsburg High School Representing youth who give their time and energy to a worthy organization or cause. Vanessa is a dedicated volunteer with the National Association for the Advancement of Colored People (NAACP). She organized the East County Youth Council's participa- tion at a Health Fair by mobilizing youth and distributing information about health con- ditions that affected the African American community. As a result, many residents re- ceived diabetes and blood pressure screenings. Vanessa is a wonderful example of how a teen can volunteer and become a community leader. Artiste: Trisha Daye-age 16,Home Schooled Representing youth who use their musical, literary or artistic talent to benefit the school or community. Trisha has been teaching instructional dance and exercise classes to chil- dren for over five years. Trisha goes above and beyond her dance instruction duties by acting as a role model and big sister to her peers and students. Trisha"gives of herself and helps teach the gift of dance to all that come,unconditionally." School Leadership: Caroline Sheahan-age 18, 12`h grade, San Ramon Valley High School Representing youth who exhibit outstanding school pride and who lend a help- ing hand for the good of the school. Caroline's goal is to spread peace, equality, diver- sity and justice for all in the world. "Within the walls of the school, Caroline has led others to learn from each other's diverse experiences." Her dedication to her causes - Awareness and Activism, and the Gay-Straight Alliance is apparent through the large amount of time she devotes to her clubs and peers. Sports Leadership: Troy Faulk-age 18, 12`h grade,Mt.Diablo High School Representing youth who work unselfishly for the good of the team. Troy is an honor roll student who has played basketball all four years at Mt.Diablo High School.As a senior, Troy is co-captain of the team and is the editor-in-chief of the Yearbook. Troy is a won- derful example of how student athletes can set an example for other teens by being a school leader while maintaining excellent grades. Adult Advocate: Mike Nicholson—Northgate High School Representing adults who work diligently to support our youth. Mike is being recog- nized by his students as "one of the best teachers" but also as the kind of teacher who continues the teaching even after the last bell rings.As a teacher advisor for Junior State of America, Mike gives up many weekend hours to chaperone students at conferences.
