SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
APPROVE and AUTHORIZE the Redevelopment Director to execute a contract amendment
with Ninyo & Moore, Geotechnical Consultants, effective February 23, 2007, to increase the
payment limit by $100,000 to an amount not to exceed $650,000 to provide a Predevelopment
Assessment for the Rodeo Waterfront.
FINANCIAL IMPACT:
No General Funds are involved. The contractor will be funded through Rodeo Redevelopment
Project Area funds.
BACKGROUND:
The Rodeo Waterfront is a critical component of Rodeo's Revitalization effort. The waterfront
was identified as a priority for redevelopment during the Redevelopment Plan Adoption
Process. The County adopted the Rodeo Downtown/Waterfront Specific Plan (Specific Plan) in
1991 that outlined broad goals and policies for revitalization that include capitalizing on
Rodeo's waterfront location as a major focal point, visitor attraction, community gather plan and
amenity to commercial and residential uses.
In 2001, the Agency brought together representatives from the Rodeo community, regulatory
agencies, developers and other interested parties to identify the barriers to implementation of
the Specific Plan. The primary obstacles regarding development of the waterfront included
uncertainty related to environmental contamination, the regulatory environment and costs
associated with dredging and maintaining the marina and the economic feasibility of a
revitalization plan.

BACKGROUND (continued
The Agency determined that a Predevelopment Assessment was needed to conduct an in-depth
study of environmental contamination and other characteristics of the waterfront area soils and
groundwater, as well as environmental contamination and other characteristics of silt in the
marina/tidal area. The goal of the Predevelopment Assessment is to provide the necessary
resources to create a development plan for a revitalized waterfront that is a regional destination
with an active marina, recreation activities, retail opportunities and parks. Ninyo & Moore and its
team of sub-contractors were selected for this assessment.
The amount of the original contract with Ninyo & Moore was $300,000 with a term from December
15, 2003 through December 31, 2005. Increased environmental assessment goals and objectives
required by the governmental regulatory agencies resulted in an increased project Scope of Work
and an extended timeline for the overall project and the contract term was amended to December
31, 2007. The completed Phase I Environmental Site Assessment dictated that a more detailed,
multi-tiered Phase II Environmental Site Assessment was in order. When the need for additional
funding was realized, staff applied for a second Environmental Protection Agency (EPA) grant to
cover the costs. The grant was subsequently awarded to the Agency in the amount of $200,000.
Currently, the Agency has applied for and is awaiting word on the outcome of two additional
grants from the EPA to complete the environmental assessment.
