Barry, AICP Community Development Director DATE: April 3, 2007 SUBJECT: REQUEST FROM CONTRA COSTA CRISIS CENTER FOR THE COUNTY TO RECONVEY ITS DEED OF TRUST AND RELEASE AND TERMINATE THE DEED OF DEVELOPMENT RIGHTS ON PROPERTY ACQUIRED WITH COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION AUTHORIZE the Deputy Director—Redevelopment to execute the Substitution of Trustee and Deed of Full Reconveyance and,the Release and Termination of Deed of Development Rights for property acquired with CDBG funds by the Contra Costa Crisis Center(305 Lennon Lane, Walnut Creek). FISCAL IMPACT No General Funds are involved. BACKGROUND /REASONS FOR RECOMMENDATIONS In 1989, the Board of Supervisors approved the allocation of $75,000 in Community Development Block Grant (CDBG) funds to the Crisis Centerto acquire an office condominium located at 305 Lennon Lane in Walnut Creek to house programs provided by the Crisis Center. County funding was matched by$90,000 from the City of Walnut Creek and$70,000 from the City of Concord CDBG programs. Because of the nature of the acquisition (office space versus a specialized facility that could provide an incentive for the Crisis Center to cash out) and the relatively short track record the Crisis Center had in 1989, the County recorded a Deed Trust and a Deed of Development Rights on the property. The County's Deed of Trust and Deed of Development Rights are currently recorded against the property in second lien position to a first mortgage held by Union Bank. Since 1989, the Crisis Center reports providing the following services: • Answered 760,000 crisis calls on its 24-hour hotlines from people who were abused, depressed, grieving, suicidal, homeless or mentally ill • Provided face-to-face counseling to 12,000 youths and adults who were mourning the death of a loved one • Trained 77,000 students and adults in youth violence prevention • Received over 474,000 hours of donated labor from volunteers in the community • Received approximately $11.5 million dollars in funding from public and private sources to provide services The requested action is consistent with CDBG regulations and staff believes the County's investment in the Crisis Center has been realized during the last 18 years. Consequently, staff recommends removing the County's liens on the subject property.
