SPECIFIC REQUEST(S) OR RECOMMENDATION(S)AND BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Approve the request of the Green Valley Recreation & Park District to consolidate elections with Statewide General Elections. FINANCIAL IMPACT: Revenues will go down for odd year elections and will go up slightly for even numbered year elections. REASON FOR RECOMMENDATION/BACKGROUND: On March 04, 2007, a copy of Resolution No. 2-28-07 adopted by the Green Valley Recreation&Park District Board of Directors on February 28,2007,was received by the Clerk of The Board office to consolidate with the even numbered year elections. Pursuant to Election Code 10402.5, any State, County, Municipal, Special & School Districts, election consolidation may only be denied if the Board of Supervisor finds that the ballot style,voting equipment, or company capacity cannot handle the election. By approving their consolidation request, the Board is allowing the jurisdiction to share costs where their jurisdictional boundaries overlap. CONSEQUENCES OF NEGATIVE ACTION: Green Valley Recreation & Park District would be subject to higher election costs in an odd year election. BACKGROUND: Green Valley Recreation & Park District has been conducting their elections in the odd years. Stockton seb-ueu-queb p. e RESOLUTION OF THE BOARD OF DIRECTORS OF THE GREEN VALLEY RECREATION AND PARK DISTRICT, COUNTY OF CONTRA COSTA,CALIFORNIA RESOLUTION NO.2-28-07 RESOLUTION THAT ELECTION OF DIRECTORS BE HELD ON THE SANTE DAY AS THE STATEWIDE GENERAL ELECTION WHEREAS,the Elections Code Section 1304 provides that unless the principal act of the District provides that an election shall be held on one of the other dates specified in Chapter 1 (commencing with Section 1000)of Division 1 of the Election Code,a General Election shall be held in each District on the first Tuesday after the first Monday m November in each odd-numbered year to choose a successor for each elective officer the term of whose office will expire on the following first Friday in December,and WHEREAS,the next Grueral District Election for the Green Valley Recreation and Park District is scheduled for November 6,2007;and WHEREAS,Elections Code Section 23302.1 was added to the Elections Code by Chapter 188 of the statutes of 1986,was effective January 1, 1987 and has been rerrumbered Elections Code Section 10404;and WHEREAS,Elections Code Section 10404 permits the Board of Directors of the Green Valley Recreation and Park District to pass a resolution requiring that elections of its Board of Directors shall be held on the same day as the Statewide General Election;and WHEREAS,Elections Code Section 10404 further provides that if the election of directors is held on the same day as the Statewide General Election,those directors whose terms of office would have,prior to the adaption of the resolution,expired prior to that election shall,instead, continue in their offices tmtil their successors are elected and qualified,bat in no event shall the toren be extended beyond December 31 of the year following the year in which the request for consolidation is approved by the County Board of Supervisors;and WHEREAS,Elections Code Section 10404 further provides that elections following the.adoption of such a resolution shall be held on the same day as the Statewide General Election,unless the resolution is question is later repealed;and WHEREAS,the Board of Directors of the Green Valley Recreation and Park District finds that the following are in the best interests of said District and its taxpayers;that the election of its Board of Directors be held on the same day as the Statewide General Election;that the directors whose terms of ince would have,prior to the adoption of this Resolution,expired prior to the next Statewide General Election shall continue in their offices until their suers are elected and qualified,but in no event shall their terms be extended beyond December 31 of the year following the year in which the request for consolidation is approved by the County Board of Supervisors;and that all future elections of members of the District's Board of Directors shall be held on the same day as the Statewide General Election,unless this Resolution is later repealed. NOW,THEREFORE,RE IT RESOLVED that the Board ofDirectors of the Green Valley Recreation and Park District,Contra Costa County,California hereby requires pursuant to Elections Code Section 10404 that the elections of its Board of Directors shall thereafter be held on the same day as the Statewide General Election. BE IT FURTHER RESOLVED that the members of this District's Board of Directors whose terms of office would have,prior to the adoption of this Resolution,expired prior to the next Statewide General Election shall,instead,continue in their offices until their successors are elected and qualified,but in no event shall their terns be extended beyond December 31 of the year following the year in which the request for consolidation is approved by the County Board of Supervisors. BE IT FURTHER RESOLVED that future elections following the adoption of this Resolution shall be held on the same day as the Statewide General Election,unless this Resolution is later repealed by the Board of Directors of the Green Valley Recreation and Park District. BE IT FURTHER RESOLVED that pursuant to Elections Coco Section 10404,the dates that are consistent with the primary or general election with respect to nominations,notices,canvass of votes,certification of election,and all other procedural requirements of the Elections Code pertaining to the primary or general election shall be all such dates as are required by the Uniform District Election Law,Elections Code Section 10500 et seq.
