(District III) DATE: April 24, 2007 PAGE: 2 NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of April 24,2007 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT NAME OF BANK/SURETY June 27, 2006 National Fire Insurance Company of Hartford i BE IT FURTHER RESOLVED that the $1,000.00 cash security for labor and materials (Auditor's Deposit Permit No. 459659,/dated February 28, 2006) deposited by Shapell Homes be RETAINED for the six-month lien guarantee period until October 24, 2007, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file. BE IT FURTHER RESOLVED that the private improvements have been COMPLETED and are NOT ACCEPTED by the County, at this time. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the$1,000.00 cash security for performance(Auditor's Deposit Permit No. 459659,dated February 28,2006)plus interest in accordance with Government Code Section 53079,if appropriate,to Shapell Homes pursuant to the requirements of the Ordinance Code; and the Subdivision Agreement and surety bond, Bond No. 929270310, dated February 7, 2006, are exonerated.
