FINANCIAL IMPACT No impact to the general fund. A portion of the fines collected from violations of fish and game regulations in the County is deposited in the Fish and Wildlife Propagation Fund, which has a current balance of approximately $72,000. State law defines how money in this fund may be spent, but the Board of Supervisors is responsible for authorizing specific expenditures.The project recommended to receive funding is consistent with the expenditure criteria established by State Law. REASON FOR RECOMMENDATION/BACKGROUND Since 1996,the Fish and Wildlife Committee(FWC)has implemented a structured process for reviewing funding requests. The intent of this structured review process was to replace case-by-case decision-making (such as occurred previously and such as is the norm with most other Fish and Wildlife Committees)with a grant process that enables comparative and efficient review of applications. In the fall of 2006, application packets were sent to the Fish and Wildlife Committee mailing lists and to anyone who requested one. A press release was issued on the availability of funding for fish and wildlife projects. A total of twenty funding applications requesting a total of$190,921 were received during the application period,which ended December 28, 2006.Two additional applications were received after the due date,which the applicants asked that their applications be considered as a part of the 2006/2007 grant review process. The Fish and Wildlife Committee discussed the funding applications at its January, February and March 2007 meetings. Some applicants came to our meetings to talk about their applications during the public comment section of the agenda. The FWC acknowledged the hard work that went into all of the applications received and appreciates the commitment to improving the resources of the County demonstrated by these applications. The amount of funds currently in the Fish and Wildlife Propagation Fund is larger at present than in years past. The increase may be partially due to increased awareness among agencies enforcing fish and game regulations and that the Fish and Wildlife Propagation Fund is an appropriate account to deposit fine monies resulting from negotiated settlements of regulation violations. At the March 2007 meeting,the Committee recommended funding 12 proposed projects to the County Board of Supervisors. 1) Require three general commitments from all projects receiving funding from the Fish and Wildlife Propagation Fund: a) return funds if the project is not performed; b) provide documentation and/or accounting to show that funds were spent for the purpose described in applications; and c) provide a brief summary report on the progress or results of the project by April 17, 2008 [unanimous (7 ayes/0 noes)] 2) Appropriate $5215 to the Contra Costa Mosquito and Vector Control District for Aquatic Invertebrate Insect Collection and Identification Guide [6 ayes/0 noes (1 Abstention, Pellegrini)]. 3) Appropriate $4630 to KIDS for the BAY for Watershed Action Program [7 ayes/0 noes]. 4) Appropriate $2690 to Lindsay Wildlife Museum for the purchase of raptor handling equipment [6 ayes/0 noes (1 Abstention, Heckly)]. 5) Appropriate $2850 to Legless Lizard Working Group c/o Matthew Bettelheim for Sandshed analysis for the California Legless Lizard [7 ayes/0 noes]. 6) Appropriate $5024 to Contra Costa Resource Conservation District for Community Based Habitat Enhancement and Endangered Plant Preservation in Kirker Creek Watershed Project [7 ayes/0 noes]. 7) Appropriate $4500 to Regional Parks Foundation for the East Bay Regional Park District for California Quail Habitat Enhancement and Community Outreach Project[7 ayes/0 noes]. 8) Appropriate $5080 to SPAWNERS (San Pablo Watershed Neighbors and Education and Restoration Society)for streamside revegetation project [7 ayes/0 noes]. 9) Appropriate $3730 to Contra Costa Resource Conservation District for establishing Barn Owl habitat [7 ayes/0 noes]. 10)Appropriate $5783 to California Wildlife Foundation for East Bay Trout in the Classroom [7 ayes/0 noes]. 11)Appropriate $1329 to Contra Costa County Animal Services Department for the Wildlife Immobilization Project [7 ayes/0 noes]. 12)Appropriate $1200 to Friends of Pinole Creek Watershed for Pinole Creek Restoration and Demonstration Project [7 ayes/0 noes]. 13)Allocate $6526 to San Ramon Historic Foundation c/o City of San Ramon Parks and Community Services Department for Forest Home Farms Wildlife Garden Expansion and Creek Restoration Project [7 ayes/0 noes]. The Fish and Wildlife Committee did not consider the following proposals for the 2006/2007 Fish and Wildlife Propagation Fund grant program (a brief, partial explanation is provided below): • Wagner Ranch Nature Area Bridge Project, proposed by the Orinda Union School District. The Committee felt that the project was not going to improve the quality of natural environment significantly. • Removal of Wildlife Barriers Project, proposed by Mt. Diablo Interpretive Association. The Committee felt that other proposals could bring about more significant impact to Appropriation from Fish and Wildlife Propagation Fund April 17, 2007 Page 3 the fish and wildlife of the County. • San Pablo Creek Restoration (Wagner Ranch Nature Area) Project, proposed by Friends of the Wagner Ranch Nature Area and Orinda Union. The Committee felt that other proposals could bring about more significant impact to the fish and wildlife of the County. • Walnut Creek Watershed Restoration Project, proposed by LifeGarden. A similar effort is currently being done by the County Community Development Department and Public Works Department. Hence, the Committee felt that funding other projects would be suitable. • Livestock Grazing Management of CA Red Legged Frog and CA Tiger Salamander project, proposed by Lawrence D. Ford. The Committee has not provided a large fund to a private individual in the past. It prefers to give the Prop Fund to an organization which Mr. Ford proposes to provide the research findings after his research is completed. • Establishing Habitat for Beneficial Insects Project, proposed by Contra Costa Resource Conservation District. The Committee felt that the proposed project location and proposed scope of work would not benefit the fish and wildlife resources of the County significantly. • Fern Creek Willow Planting project, proposed by the Muir Heritage Land Trust. The Committee felt that other projects had more benefits to the natural resources of the County. • Wildlife Habitat Restoration Project (Elkhorn and Edwards Creeks), proposed by Carquinez Regional Environmental Education Center. The Committee felt that other projects had more benefits to the natural resources of the County. • Habitat Usage of Feral Pigs on EBMUD lands in Contra Costa County Project, proposed by East Bay Municipal Utility District. The Committee felt that other proposals could bring about more significant impact to the fish and wildlife of the County. • Water Delivery for Riparian Plantings on Wildcat Creek, proposed by Urban Creeks Council. The Committee felt that other projects had more priority to be funded through this year's grant cycle. In case this project needed funding later on this year, it may be a good idea to submit this proposal again to be considered as an out of cycle grant proposal. • Fisheries Survey on Alhambra Creek, proposed by Urban Creeks Council. The Committee felt that other proposals could bring about more potentially significant impact to the fish and wildlife of the County. • Implementation of Habitat Restoration Practices and Education Programs for Kellogg Creek Watershed, proposed by Agricultural Trust of Contra Costa County. The proposal lacked assurance on completing the deliverables successfully when this project is completed. • Antioch Dunes National Wildlife Refuge Habitat Restoration Project, proposed by US Fish and Wildlife Service. This grant proposal was received after the due date, hence, the Committee decided not to review this proposal during the 2006/2007 grant cycle. • Marsh Creek Watershed Native Plant Nursery& Demonstration Garden Project, proposed by Contra Costa Resource Conservation District. This grant proposal was received after the due date, hence, the Committee decided not to review this proposal during the 2006/2007 grant cycle. Grant applications must be received by December 28, 2006. The Fish and Wildlife Committee especially encourages applications relating to activities to protect and conserve fish and wildlife in Contra Costa County.including improvement of fish and wildlife habitat.public education about fish and wildlife conservation, and scientific fish and wildlife research. The Fish and Wildlife Committee generally does not recommend funding for operating costs, overhead, or on-going staff support for an organization.Further, projects awarded funds from the Fish and Wildlife Propagation Fund must meet the requirements of Section 13103 of the Fish and Game Code. Funding for the grant program is generated from fines for violations of the Fish and Game Code and Title 14 of the California Code of.Regulations. The Contra Costa County Board of Supervisors receives the committee's recommendations and holds final decision-making authority over the awarding of grants. During the 2005/2006 grant cycle, a total of $44,160 was awarded to 11 projects. The awards ranged from $490 to $10,000. A copy of the 2006/2007 grant application packet is attached to this press release. 13103. Expenditures from the fish and wildlife propagation fund of any county may be made only for the following purposes: (a) Public education relating to the scientific principles of fish and wildlife conservation, consisting of supervised formal instruction carried out pursuant to a planned curriculum and aids to education such as literature, audio and video recordings, training models. and nature study facilities. (b) Temporary emergency treatment and care of injured or orphaned wildlife. (c) Temporary treatment and care of wildlife confiscated by the department as evidence. (d) Breeding, raising. purchasing. or releasino fish or wildlife which are to be released upon approval of the department pursuant to Sections 6400 and 6401 onto land or into waters of local. state, or federal agencies or onto land or into waters open to the public. (e) Improvement of fish and wildlife habitat, includina. but not limited to, construction of fish screens, weirs, and ladders: draina�(ye orotherwatershed improvements; gravel and rock removal or placement; construction of irrigation and water distribution systems: earthwork and grading; fencing; planting trees and other vegetation management: and removal of barriers to the migration of fish and wildlife. (f) Construction, maintenance. and operation of public hatchery facilities. (o) Purchase and maintain materials, supplies. or equipment for either the department's ownership and use or the department's use in the non-nal performance of the department's responsibilities. (h) Predator control actions for the benefit of fish or wildlife following certification in writing- by the department that the proposed actions will significantly benefit a particular wildlife species. (i) Scientific fish and wildlife research conducted by institutions of higher learning. qualified researchers. or governmental agencies, if approved by the department. (i) Reasonable administrative costs, excluding the costs of audits required by Section 13104, for secretarial service. travel, and postage by the county fish and wildlife commission when authorized by the county board of supervisors. For purposes of this subdivision. "reasonable cost" means an amount which does not exceed 3 percent of the average amount received by the fund during the previous three-year period, or three thousand dollars ($3,000) annually. whichever is greater. excluding any funds carried over from a previous fiscal year. (k) Contributions to a secret witness program for the purpose of facilitating enforcement of this code and regulations adopted pursuant to this code. The creek drains 41 square miles of land ranging from near pristine oak woodlands in portions of the upper watershed to the suburbanized and urbanized regions in the lower watershed of El Sobrante, Richmond, and San Pablo. Midway along San Pablo Creek lies the East Bay Municipal District's San Pablo Dam and Reservoir. Below the Dam, the creel: flows through a broad valley draining Richmond and El Sobrante before entering San Pablo and flowing to the Bay. As it flows through the F_.1 Sobrante Valley it is joined by three year-round and more than twelve ephemeral creeks. Most of the creek main stem is above ground and more than eighty percent of it is privately owned.
