SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommended Action:
A. DETERMINE that the proposed vacation will not have a significant effect on the environment, and that it
has been determined to be exempt from the California Environmental Quality Act (CEQA) under State
CEQA guidelines pursuant to Article 5, Section 15061 (b)(3), and DIRECT the Director of Community
Development to file a Notice of Exemption with the County Clerk,and DIRECT the Public Works Director
to arrange for payment of a $50.00 fee to the County Clerk for filing and a $25.00 fee to Community
Development for processing of the Notice of Exemption. This Board having considered the general plan,
FIND pursuant to Government Code Section 65402 that this proposed vacation is exempt from general plan
conformance review.
B. DETERMINE that this summary vacation of an excess portion of right of way of a street or highway Saranap
Avenue no longer required for street or highway purposes is made pursuant to Division 9,Part 3,Chapter 4 of
the Streets and Highways Code, commencing with Section 8 30, et. seq. A descVption of the portion to be
vacated is attached hereto as Exhibit"A"and shown as Exh' it`B"and incorp ated herein by reference.

C. DETERMINE that this summary vacation is for excess right of way of a street or highway not required for
street or highway purposes. (S&H Code Section 8334)
D. DIRECT the Real Property Division to record a certified copy of this Board Order in the office of the County
Recorder.
E. DECLARE from and after the date this Board Order is recorded,the described proposed vacation is HEREBY
ORDERED VACATED subject to any reservation and exception described in Exhibit "A" and it no longer
constitutes a public highway.
Financial Impact:
No Fiscal Impact
Reasons for Recommendations and Background:
An excess portion of right of way area(approximately 49 ft. x 144 ft) at the corner of Saranap Avenue and Juanita
Drive is no longer required for street or highway purposes. A 10-foot wide access easement from the edge of the
roadway will be retained by the County for future sidewalk and utility improvements.
Consequences of Negative Action:
The County may be responsible for the maintenance of this area.

Real property in an unincorporated area of the County of Contra Costa, State of
California, being a portion of the County Road (Saranap Avenue) as shown on the
map titled "Sun Valley Estates Contra Costa County" filed February 8, 1946 in
Book 28 of Maps at Page 27, Contra Costa County records, described as follows:
Parcel One —Vacation
Beginning at the northwest comer of Lot 57 as shown on said map (28 M 27),
being also the northwest corner of Parcel A as shown on Subdivision MS-
010015A, filed August 14, 2002 in Book 184 of Parcel Maps at Page 48; thence
from said Point of Beginning, easterly along the north line of said Lot 57 (28 M 27)
being the north line of said Parcel A (184 PM 48), south 82014'48" east, 91.00 feet
(the bearing south 82014'48" east being taken for the purpose of this description) to
the northwest corner of Parcel B .as shown on said map (184 PM 48); thence
continuing along the north line of said Lot 57 (28 M 27) being the north line of
Parcel B of said parcel map (184 PM 48), south 82014'48" east 53.00 feet to a point
on a tangent curve, concave to the southwest, a radial from said point bears south
7°45'12" west; thence southeasterly along said curve, having a radius of 20.00 feet,

1975 in Book 7666 of Official Records at Page 766 records of said County; thence
northerly along said southerly line, north 16037'29" west 13.61 feet to a point on a
tangent curve, concave to the southwest, a radial from said point bears south
73022'31" west; thence northwesterly along said southerly line (7666 OR 766) and
along said curve, having a radius of 60.00 feet, through a central angle of
56033'32", an arc length of 59.23 feet to a point on a compound curve, concave to
the south, a radial from said point bears south 16048'59" west; thence westerly
along said southerly line (7666 OR 766) and along said curve, having a radius of
770.05 feet, through a central angle of 7°22'49", an arc length of 99.19 feet to the
northerly prolongation of the westerly line of said Lot 57 (28 M 27) being the

Project Description: The activity consists of vacating a portion of Contra Costa County(County)
right of way(approximately 49ft. wide by 144 ft. long)along the north side of APN 185-390-043and APN
185-390-044 on Saranap Avenue near the corner of Juanita Drive.
The County has determined that the right of way is no longer needed for roadway purposes and can be
conveyed to the property owner/s. A 10-foot wide access easement from the edge of the roadway will
be retained by the County.
Project Location: The activity is located in south Contra Costa County in the unincorporated area of
Walnut Creek.
This project is exempt from CEQA as a:
