RECOMMENDATION:
SUPPORT Assembly Bill 1275 (DeSaulnier), legislation that would authorize a county board of
supervisors to authorize an increase in the fees for certified copies of marriage certificates, birth
certificates, fetal death records, and death records, for the purpose of funding governmental oversight
and coordination of domestic violence prevention, early intervention, and prosecution efforts in the
county, up to a maximum of $4, as requested by Assembly Member DeSaulnier.
FISCAL IMPACT:
None for Contra Costa County. Contra Costa was successful in obtaining legislation for this purpose
in 2006.
BACKGROUND:
The County's 2006 Stati Legislative Platform included the following sponsored bill proposal:
Reauthorization of SB 425 (Zero Tolerance for Domestic Violence) — SB 425 authorizes
Contra Costa County to impose a fee of up to $2.00 per vital record copy to support the
County's Zero Tolerance Initiative. The current law sunsets January 1, 2007 and a report on
the results of the pilot is due to the Legislature by July 1, 2006. The County is requesting
reauthorization of the legislation. Rationale for bill sponsorship: SB 425 provides funding for
oversight and coordination of the Zero Tolerance for Domestic Violence Initiative. If SB 425 sunsets,
there will be no funding for core staff or for activities such as training, evaluation, systems development
and grant management($937,000 of federal grants for FFY 2006).
Contra Costa County was successful in this legislative effort, owing in large part to the support of
Senator Torlakson, who carried bill SB 968. This legislation has ensured the successful continuance
of the County's Zero Tolerance for Domestic Violence program.

During this current legislative session, Assembly Member DeSaulnier has authored a bill with a
similar purpose, though extending the opportunity to other counties in the state.
AB 1275 would authorize a county board of supervisors, upon making findings and declarations
supporting the need for governmental oversight and coordination of the multiple agencies dealing with
domestic violence, to authorize an increase in the fee for certified copies of marriage certificates, birth
certificates, fetal death records, and death records, for the purpose of funding governmental oversight
and coordination of domestic violence prevention, early intervention, and prosecution efforts in the
county, up to a maximum of $4. (The same authorized maximum was approved for Contra Costa
County under SB 968. Note that the increase to $4 per certified copy was based on the elimination of
the fee authority for marriage licenses.)
Similar to SB 968, AB 1275 would also require a county that elects to increase these fees for the
purpose of funding oversight and coordination of domestic violence prevention, early intervention, and
prosecution efforts in the county, to submit an annual report to the Assembly Committee on Judiciary
and the Senate Committee on Judiciary that contains specified information related to the funds
received and expended from the fee increase.

An act to add Sections 103629 and 103629.5 to the Health and Safety
Code, relating to domestic violence.
LEGISLATIVE COUNSEL'S DIGEST
AB 1275, as introduced, DeSaulnier. Domestic violence: certified
copies of vital records: fees.
Existing law requires the collection of fees for certified copies of fetal
death or death records and marriage or birth certificates.
Existing law authorizes certain cities and counties, upon making
findings and declarations supporting the need for governmental oversight
and coordination of the multiple agencies dealing with domestic
violence, to authorize an increase in the fees for certified copies of
marriage certificates, birth certificates, fetal death records, and death
records, and to provide funding for governmental oversight and for the
coordination of domestic violence prevention, intervention, and
prosecution efforts in the county.
This bill would authorize a county board of supervisors,upon making
findings and declarations supporting the need for governmental oversight
and coordination of the multiple agencies dealing with domestic
violence, to authorize an increase in the fees for certified copies of
marriage certificates, birth certificates, fetal death records, and death
records, for the purpose of funding governmental oversight and
coordination of domestic violence prevention, early intervention, and
prosecution efforts in the county,up to a maximum increase of$4.

fees for these purposes to authorize, effective July 1 of each year, an
additional increase in these fees by an amount equal to the increase in
the Consumer Price Index for the state for the preceding calendar year,
as specified.
The bill would also require a county that elects to increase these fees
for the purpose of funding governmental oversight and coordination of
domestic violence prevention,early intervention,and prosecution efforts
in the county to submit an annual report to the Assembly Committee
on Judiciary and the Senate Committee on Judiciary that contains
specified information related to the funds received and expended from
the fee increases.

The people of the State of California do enact as follows:
1 SECTION 1. Section 103629 is added to the Health and Safety
2 Code, to read:
3 103629. (a) A county board of supervisors, upon making
4 findings and declarations supporting the need for governmental
5 oversight and coordination of the multiple agencies dealing with
6 domestic violence, may authorize an increase in the fees for
7 certified copies of marriage certificates, birth certificates, fetal
8 death records, and death records, up to a maximum increase of
9 four dollars ($4).
10 (b) Effective July 1 of each year,a county that elects to increase
11 fees for certified copies of marriage certificates,birth certificates,
12 fetal death records, and death records,pursuant to subdivision(a),
13 may authorize an additional increase in these fees by an amount
14 equal to the increase in the Consumer Price Index for the state for
15 the preceding calendar year, rounded to the nearest half dollars.
16 (c) Proceeds collected pursuant to this section shall be used for
17 governmental oversight and coordination of domestic violence
18 and family violence prevention, intervention, and prosecution
19 efforts among the court system, the district attorney's office, the
20 public defender's office, law enforcement, the probation
21 department,mental health,substance abuse,child welfare services,
22 adult protective services,and community-based organizations and
23 other agencies working in the county in order to increase the

1 effectiveness ofprevention,early intervention,and prosecution of
2 domestic and family violence.
3 (d) In addition to the fees prescribed by subdivisions (a) and
4 (b), any applicant for a certified copy of a birth certificate, a fetal
5 death record, or death record in a county shall pay an additional
6 fee to the local registrar, county recorder, or county clerk, as
7 applicable, as established by the county board of supervisors.
8 SEC. 2. Section 103629.5 is added to the Health and Safety
9 Code, to read:
10 103629.5. If a county elects to increase fees pursuant to Section
11 103629, the county shall submit a report to the Assembly
12 Committee on Judiciary and the Senate Committee on Judiciary,
13 by July 1 of each year, commencing in 2010, that contains both
14 of the following:
15 (a) The annual amount of funds received and expended from
16 fee increases for the purpose of governmental oversight and
17 coordination of domestic violence prevention, intervention, and
18 prosecution efforts in the county.
19 (b) Outcomes achieved as a result of the activities associated
20 with the implementation of Section 103629.
