Three (3) of these fire engines will be sold to the Knightsen Firefighters Association for the sum of$1.00 each. One (1)fire engine will be sold to the East Contra Costa Historical Society for the sum of$1.00 each. The Knightsen Firefighters Association currently has a Contra Costa County Board Order, Resolution#95 / 162 in regards to the use of two(2) of these fire engines. In agreement with the Knightsen Firefighters Association, the Association will obtain title and take possession of these fire engines for their use. SEAL • December 18,2006 Brian Helmick Battalion Chief ;. / East Contra Costa Fire Protection District ° 134 Oak Street Brentwood,,CA 94513 Re: Antique Fire Engines Dear Battalion Chief Helmick: This letter is in response to your e-mail of December 71h to Ah Hing concerning two (2) antique fire engines that are neither registered nor operational, but owned by the East Contra Casta Fire Protection District. My understanding is the fire engines have been restored or are in the process of being restored by the Knightsen Firefighters Association, who along with the Knightsen Town Advisory Counsel, would like to use them in community and fire prevention education activities, and otherwise put them on'display. First of all, as I read Board Resolution No. 95/162, only the Knightsen Firefighters Association is allowed to operate the fire engines, but only with the prior authorization of the district's fire chief... The resolution seemingly does not include the Knightsen Town Advisory Counsel. As to liability for injury to persons or damage to property arising from the ownership, operation and use of the fire engines, the district alone is covered by the County's self-insured general and automobile liability insurance programs. So while the association may have permission to operate or otherwise use the fire engines, the permission does not extend to including the association under the district's (County's) self-insured general and automobile liability insurance programs. In order to be properly protected from liability claims arising from the permissive use of the fire engines, the association needs to procure its own stand-alone liability insurance and to provide evidence of such insurance to the district. Because the fire engines are not.registered (for use on public roads), many insurance companies will not consider them for automobile liability insurance, so the pure} ase of automobile insurance may not be appropriate... in which case a general liability insurance policy may be more appropriate. In any event, evidence of the appropriate liability insurance, in the form of a certificate of insurance, issued in the name of the Knightsen Firefighters Association should be furnished to the district; the coverage should be for a minimum of $500,000 per occurrence and must describe the coverage as applying to the permissive operation or use of the fire engines (described) along with a description and date(s) of the event and include,the district as an additional insured... Otherwise, we can accept evidence the liability insurance being provided by an individual member of the association, provided the coverage.is similar to that which we've asked of the association, but also includes the association (and district) as additional insureds.
