(Flood Control Zone 3B Funds) (Districts lI& IV)Project No. 7520-6B8345 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: DETERMINE that there is a need to continue the emergency action taken by the Board of Supervisors on April 10,2007,pursuant to Public Contract Code Sections 22035 and 22050,to implement the Lower Walnut Creek Interim Protection Measures project, Pacheco area. FISCAL IMPACT: The total estimated contract cost is $8,500,000, funded by Flood Control Zone 3B Funds. (Flood Control Zone 3B Funds) (Districts H&IV)Project No. 7520-6B8345 DATE: August 14, 2007 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: A. On April 10, 2007, the Board of Supervisors declared an emergency and authorized the Chief Engineer to proceed in the most expeditious manner to repair or replace the Lower Walnut Creek flood control facility as directed by the US Army Corps of Engineers. B. Repair status: The Contra Costa County Flood Control and Water Conservation District (District) has prepared the Lower Walnut Creek Corrective Action Plan and presented this to the US Army Corps of Engineers for consideration on June 11, 2007. A status report, including this Corrective Action Plan,was presented to the Transportation, Water and Infrastructure Committee on June 25, 2007. Project plans are being prepared and the District has begun initial outreach efforts to contractors to generate interest in the project among potential bidders. The current schedule calls for starting the work in mid-August 2007 and completing the needed interim protection measures in early November 2007. CONSEQUENCES OF NEGATIVE ACTION: Nonconcurrence.of the above recommendation will significantly delay implementation of the needed capacity improvements in Lower Walnut Creek flood control facility and prevent the District from meeting the correction schedule required by the US Army Corps of Engineers.
