SUBJECT: DETERMINATION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
RELATED TO A PROJECT TO BE FUNDED WITH COMMUNITY DEVELPOMENT BLOCK
GRANTFUNDS
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
(1) FIND, as the Responsible Agency, that the City of Concord as the Lead
Agency for the Matteo's Dream Americans with Disabilities (ADA) accessible
playground project, determined that this project is exempt from the California
Environmental Quality Act pursuant to Public Resources Code Section
15301(f), and
(2) DIRECT the Community Development Director, or designee, to file a Notice of
Exemption with the County Clerk, and
(3) DIRECT the Community Development Director, or designee, to arrange for
payment of the $50 handling fee to the County Clerk for filing such Notice of
Exemption.
FISCAL IMPACT
No General Fund impact. CDBG funds are provided to the County on a formula basis
through the U.S. Department of Housing and Urban Development.

BACKGROUND /REASONS FOR RECOMMENDATIONS
On April 24, 2007, the Board of Supervisors will consider approving the County's
FY 2007/08 CDBG Action Plan including providing financing to the following project:
Friends of Concord Park, Recreation and Open Space, Inc. (Friends): This project
proposes to demolish what is currently the playground section of Hillcrest Park in Concord,
replacing it with a playground that is fully accessible to persons with disabilities. The
planned playground includes considerations for persons with a variety of disabilities
including mobility-impaired, blind, deaf, and autistic. There is no other playground of this
type in the County. The playground will include a rubberized surface on the ground of the
entire play area making the play structure, swings, bars, and other activities accessible to
persons (children and parents/guardians) with wheelchairs, canes, walkers, etc. The
specifications of the project require it to be custom designed and constructed, which
significantly add to the cost. The City of Concord, as the Lead Agency, has determined that
this project is exempt under the California Environmental Quality Act (CEQA). Providing
financing for this project is exempt under Section 15061(b)(3) of CEQA.
By taking the recommended actions, the County ensures the above project complies with
the requirements under the California Environmental Quality Act and, if the Board approves
allocating CDBG funds, the project may proceed without further delay.

Project Description:City of Concord–Hillcrest Playground Renovation,County File#CP 2007-11. The County is providing
financing, under the federal Community Development Block Grant (CDBG) program, to the Friends of Concord Parks,
Recreation and Open Space, Inc.,to help renovate a playground by making it fully accessible(ADA compliant).This project
only involves the financing portion of the project under the CDBG program. The City of Concord has determined that the
actual renovation of the playground is exempt under Section 15301(f) of the CEQA guidelines.
Project Location: The subject property is located at 2050 Olivera Road, Concord CA 94519
This project is exempt from CEG1A as a:

Declared Emergency(Sec. 15269(a)) x General Rule of Applicability(Section 15061(b)(3)

Act(CEQA) pursuant to Article 5, Section 15061(b)(3) of the CEQA Guidelines. It can be seen with certainty that there is
