The Federal Aviation Association (FAA)was unable to perform a walk-thru on the project until 2005. In December 2005,Public Works received the final punch list from the FAA. We negotiated the change order with the contractor and they have ordered their materials. The work has been completed in 2006. We are currently working with the FAA to get over full reimbursement of dollars from the Federal Government. We expect to complete the final reports shortly, but are allowing additional time on the contract to allow for any follow-up with the FAA. This Board Order will update our consultant's contract by extending the completion date until the end of the year and approve inflationary adjustments to the payment provisions. CONSEQUENCES OF NEGATIVE ACTION: If the Consultant Services Agreement Amendment with Summit Associates is not approved,it may not be possible to receive Federal Grant Money. Y ' I AMENDMENT NO. 4 CONSULTING SERVICES AGREEMENT PROJECT NAME: Buchanan Field Airport (Airport Electrical Upgrades) 1. Parties: Effective on December 31, 2006, the County of Contra Costa County, a political subdivision of the State of California, hereinafter referred to as "Public Agency," and Summit CM, Inc., hereinafter referred to as "Consultant," mutually agree and promise as follows: 2. Purpose: The parties desire to amend the agreement entitled "Consulting Services Agreement" with the effective date of September 1, 2003. This Amendment provides for an extension of the term of the Consulting Services Agreement due to the necessity for continued assistance in negotiating with the FAA for federal reimbursements. 3. Amendment(s) to Agreement: A. The completion date, Item 1(f) of the existing Consulting Services Agreement is hereby amended to read December 31, 2007. B. The Cost Schedule (Appendix B to the Consulting Services Agreement) is hereby deleted in its entirety and replaced with the Cost Schedule (Appendix B) attached hereto and incorporated herein by this reference. The amended Cost Schedule reflects inflationary adjustments to the payment provision. C. The name of the consultant in the Consulting Services Agreement is hereby deleted and replaced with "Summit CM, Inc." 4. Remaining Provisions: Except for the changes made by this Amendment, all provisions of the Consulting Services Agreement shall remain in full force and effect. 5.
